3. Election of 2019 Chair and Vice-Chair.
Motion by Mr. Hunsaker, seconded by Mr. Pitcher, to open nominations for Chair and Vice-chair for the year 2019. Motion passed.
Motion by Mr. Hunsaker to suspend the rules and vote by acclamation that the present Chair Syme and Vice-chair Meyerhoffer continue in those positions for 2019. Seconded by Mr. Pitcher. Chair Les Syme and Vice-chair Kent Meyerhoffer were unanimously re-elected by acclamation.
4. Discussion/action on Annexation Policy Plan
A Public Meeting was held for the affected entities relating to the proposed Annexation Policy Plan. Mr. Morris said if the proposed Annexation Policy Plan were to take place, it would give Marriott-Slaterville complete authority of 2700 West, including the bridge over the river. In the future, West Haven City and Marriott-Slaterville would separate 12th Street, with West Haven City to annex the south side and Marriott-Slaterville the north side. Affected entities were invited to give their input at this meeting. They were also informed that the Planning Commission will accept and consider any additional written comments from affected entities for ten (10) days after this meeting prior to holding the required Public Hearing in the future.
Public Comments from Affected Entities:
Gordon James from West Weber asked what had instigated the annexation process. Staff explained that Weber County Planning has expressed interest in existing cities annexing unincorporated areas such as West Weber so the County does not have to provide municipal services.
Dan Hammer from West Weber asked what type of services would be provided if Marriott-Slaterville annexed them. Staff reviewed the services from the proposed Annexation Policy Plan. Mr. Hammer also asked how the City would protect them in the event of a flood. Mr. Morris explained how our City has dealt with flooding problems in the past.
Scott Slater, Dominion Energy, said they only have the facilities to serve the infrastructure for the now existing area. Dominion Energy calculates they would have to serve an additional 24 or 56 homes if development occurred, assuming they were annexed into 1-acre lots. Staff noted that annexation could include a possibility of 200 homes on the 80 acres as proposed by a property owner. Staff explained cluster development concepts.
Becky Hammer from West Weber said she is worried about the possibility of development and having so many homes and the zoning requirements. She is also concerned because there are large power poles in that area.
Mr. Schofield noted that if this annexation materializes there will be more Public Hearings and meetings before anything is finalized.
Eric Thomas, representing the Smart family, said they are supportive of this annexation with 12th Street as the border, which would include their property they are seeking to develop.
No further comments were received.
Mr. Morris reminded the audience that they have ten (10) days to submit additional comment for the Annexation Policy Plan.
Motion by Mr. Schofield to open the ten (10) day comment period as provided in state code. Motion seconded by Mr. Pitcher. Motion approved with all in favor, none opposed.
5. Public Hearing on Ordinance 2019-03 repealing and re-enacting Chapter 13.26 relating to Regulations Applicable To more than one zone.
Chair Syme closed the Public Meeting and opened a Public Hearing on Ordinance 2019-03.
Public Comments:
No comments were offered.
Chair Syme closed the Public Hearing and re-opened the Public Meeting.
6. Discussion/action on Public Hearing
Mr. Morris reviewed the Ordinance page-by-page.
Chair Syme expressed concern about the lot standards not being readable. Minor changes were made to the lot standards for clarity.
Chair Syme is concerned about people not having secondary water and then watering their lawns with culinary water. Staff noted that this is against city code, very costly, and places a huge burden on the culinary water system.
Mr. Hunsaker asked about regulating solar panels and was told that the building code regulates a large portion of that.
Motion by Chair Syme to recommend approval of this Ordinance as amended and forward to the City Council. Seconded by Mr. Tobias. Motion passed unanimously.
7. Public Hearing on amended plat for IFA at 1069 West 1200 South.
This property is zoned C-2P. The developer desires to amend the plat to combine two (2) lots along the 12th St frontage into one (1) lot and eliminate certain access/utility easements shown on the plat. Staff stated that the developer contacted the City and has requested this item be tabled or postponed pending litigation with Weber School District.
Public comment was opened:
Mr. Morris read an email received today from Lacy Richards, who is a parent of a student attending the Weber Innovation High School. The letter expressed support of the efforts of the Weber School District to obtain access for vehicles leaving the school property to access the traffic signal on 12th Street.
Kathy Borrett, Borrett Animal Hospital, is located next to IFA. She is concerned about changes to the easement and access to her property. Staff referred her to seek legal counsel for any changes as staff is not able to provide her legal advice. However, staff does not feel that she would have any change, as she indicated she has a separate legal easement document. Staff stated it does not have that legal easement document and again suggested she seek legal counsel. She also asked about speeding in the development. Staff introduced Mrs. Borrett to Craig Sellers, IFA, so they could discuss the issue together.
No other public comment was offered.
8. Discussion/action on Public Hearing.
Motion by Chair Syme to table this item until such time as the access can be resolved between the parties. Seconded by Mr. Pitcher. Vote called and passed with all in favor, none opposed.
9. Discussion/action on Site Plan for Weber School District at 955 West 1200 South.
This property is zoned A-1 and the developer desires to amend the Site Plan to provide additional access through IFA. Staff recommends this matter also be tabled until the access is resolved.
Motion by Chair Syme to table the proposed site plan amendment for access until the access issues are resolved by the parties or the court. Seconded by Mr. Pitcher. Motion passed unanimously.
10. Discussion/action on amended Site Plan for addition at Venture Academy at 495 North 1500 West.
This property is zoned A-1 and the developer desires to amend the Site Plan to construct an addition to the Elementary School.
Gary Hunt, architect for Venture Academy, said the school is remodeling and adding some classrooms to the south side of the Elementary School. The number of students will not increase. The project is currently out for bid and they expect to begin construction in the near future.
Motion by Mr. Schofield, seconded by Mr. Tobias, to grant final amended Site Plan approval subject to the following requirements:
- Compliance with affected entity and agency requirements.
- Compliance with requirements of the City Engineer.
- Development conform to Municipal Code requirements.
Vote called with all in favor, none opposed.
11. Commission and staff follow-up:
Staff noted that a homeless individual died of natural causes by the railroad tracks south of Old Castle. Mr. Schofield said the homeless enclosures are still on the property.
Cache Valley Electric backed out of the Slaterville Commercial Subdivision. We assume Peterbilt will be coming soon but we have not heard from them since the last Planning Commission Meeting.
The subdivision proposed by Frank Eggett is stalled by the LOMAR process and may not happen. Also, FEMA is in the process of modifying the flood plain.
Chair Syme thanked staff for their services.
12. Adjourn.
Being no further business, Chair Syme adjourned the meeting at 8:16 p.m.
