MONA CITY COUNCIL MEETING JANUARY 22, 2019 7:30 PM COUNCIL CHAMBERS THE MEETING WAS CALLED TO ORDER BY MAYOR WILLIAM MILLS PRESENT: William M Mills - Mayor Randy Christensen - Councilmember Katrina Long - Councilmember Frank Riding - Councilmember Micheal Stringer - Councilmember GUEST: Carlene Ingram, Megan Thomas, Arlene Bassett, Mike McDonald, Kasey Wright, City Attorney, Dr. Michael Clay BYU, Melinda Matheson, Mona Recreation, John Bradley, Nephi Recreation, Tyler Faddis, Jay Mecham, Leonard Trauntvein ALSO PRESENT: Myrna Trautvein - Times News Reporter Michelle Dalton-Secretary/Treasurer Everd Squire -Director of Finance, Lyla Spencer -City Recorder OPENING PRAYER: Councilmember Katrina Long APPROVAL OF JANUARY 08, 2019 MINUTES: Councilmember Katrina Long moved to make a motion to accept the minutes of January 08, 2019 as written. Councilmember Frank Riding made a second to that motion. The vote was unanimous, motion carried. (1st Motion) OPEN MEETINGS TRAINING: City Attorney Kasey Wright presented the annual 2019 Open Meetings Training for the staff. Kasey asked the council, 'Why are we here'? 'The presiding officer of the public body shall ensure that the members of the public body are provided with annual training on the requirements of [the Open and Public Meetings Act].' Utah Code Section 52-4-104. The Purpose is to conduct the people's business with transparency. Actions must be taken openly. Deliberations must be conducted openly. Who must comply? Any 'administrative, advisory, executive, or legislative body of the state or its political subdivisions that is vested with the authority to make decisions regarding the public's business.' Examples, City Council, Appeal Authority, Planning and Zoning. MONA CITY COUNCIL MEETING JANUARY 22, 2019 7:30 PM COUNCIL CHAMBERS OPEN MEETINGS: All Meetings must be open to the public unless specifically allowed to be closed under the act. What is a 'meeting'? The convening of a public body, with a quorum present, whether the meeting is held in person or by means of electronic communications, for the purpose of discussing, receiving comments from the public about, or acting upon a matter over which the public body has jurisdiction or advisory power. Regular meetings, special meetings, workshops, executive session, site visits, traveling tours. Open Meetings do not include a chance meeting, a social meeting, and convening solely for discussion or implementation of administrative or operational matters if: no formal action is taken or the matters would not come before the body for discussion or action. Electronic Meetings: A public meeting convened or conducted by means of a conference using electronic communications. A public body may not hold an electronic meeting unless it has adopted specific procedures for conducting it. These may include considerations of budget, logistics, and presence of a quorum at an anchor location; vote to establish an electronic meeting, notice requirement, etc. Nothing restricts a member of a public body from transmitting an electronic message to other members of the public body at a time when the body is not convened in an open meeting. Utah Code Ann. 52-4-207 Closed Meetings: For what purpose? A closed meeting may only be held: To discuss the character, professional competence, or physical or mental health of an individual. Strategy sessions for: collective bargaining, pending or reasonable imminent litigation, purchase, exchange, or lease of real property or water rights/shares, sale of real property or water rights/shares, to discuss the deployment of security personnel, devices, or systems , to investigate proceedings regarding allegations of criminal conduct. May NOT do the following in a closed meeting: Approve any ordinance, resolution, rule, regulation, contract or appointment, interview a person to fill an elected position, take final action (final votes must be open and on the record). How do we close a meeting? The body must first hold a public meeting with proper notice, a Quorum must be present, 2/3 vote of the body must vote to close the meeting, the body must publicly disclose: The vote by name of each member for or against entering into the closed meeting, the reasons for holding the closed meeting, and location of the closed meeting. The information discussed in executive sessions is confidential and may not be discussed outside of the meeting, including with: members of the public, spouses, family members or significant others or the local newspaper as an 'anonymous' source. The Public Body must give notice not less than 24 hours notice of each meeting, must also give notice of annual meetings scheduled in advance over the course of a year. Public notices must include the following: Agenda for the meeting, date, time and place for the meeting. Public notice shall be satisfied by: posting written notice at the principal office or the building where the meeting will be held; and on the Utah Public Notice Website. Providing notice to: At least one newspaper of general circulation within the geographic jurisdiction of the public body; or a local medial correspondent. MONA CITY COUNCIL MEETING JANUARY 22, 2019 7:30 PM COUNCIL CHAMBERS Agenda: The public notice must provide reasonable specificity to notify the public as to the topics to be considered at the meeting. A topic raised by the public may be discussed during an open meeting, even if not included on the agenda, however, except for emergency meetings; the public body may not take final action on a topic not listed on the agenda. Emergency Meetings: Regular notice requirements may be disregarded if: Because of unforeseen circumstances it is necessary to hold an emergency meeting to consider matters of an emergency or urgent nature. Still required to give the best notice practicable. May not hold an emergency meeting unless: an attempt has been made to notify all the members of the public body; and a majority of the members approve the meeting. Public Hearing: The public notice for a public hearing must additionally follow any notice requirements specified in the statute requiring the public hearing. Meeting Minutes and Recordings for Open Meetings: The public body must keep written minutes and a recording. Written minutes must include; the date, time and place of the meeting, the name of members present and absent, the substance of all matters proposed, discussed, or decided by the body which may include a summary of comments made by members of the public body, a record, by individual member, of each vote taken by the public body, the name of each person who is not a member of the public body who provided invited testimony or comments to the public body, the substance, in brief, of the testimony or comments provided above any other information that any member requests be entered in the minutes. A recording of an open meeting shall be a complete and unedited record of all open portions of the meeting from the commencement of the meeting through adjournment. Meeting Minutes for Closed Meetings: The Public Body must make a recording of the closed meeting, except for meetings to discuss an individual's character or to discuss security - in these cases the presiding officer shall sign a sworn statement affirming that these are the sole purposes for the meeting. The public body may keep detailed written minutes that disclose the content of the meeting. The recording and any minutes shall include: The date, time, and place of the meeting; the names of members present and absent; and the names of all others present except where confidentiality is needed to preserve the purpose of the closed meeting. Penalties: Any member of a public body who intentionally violate the closed meeting provisions is guilty of a class B misdemeanor. A court can avoid any action taken in violation of the open meetings law; the public body may have to pay court costs and attorney's fees if successfully challenged in court on a violation. REMEMBER: that you represent the people of Mona City and should at all times act with dignity and respect, discussions and debates among council members should always remain civil and professional, it is not appropriate for council members to attempt to influence criminal investigations or prosecutions. MONA CITY COUNCIL MEETING JANUARY 22, 2019 7:30 PM COUNCIL CHAMBERS 2019 COUNCIL AND STAFF ASSIGNMENTS: Mayor William M. Mills presented the 2019 Council and Staff Assignments. There was one change added to the 2019 assignments with Councilmember Randy Christensen assuming the responsibility of Economic Development, Liaison with Juab County and Six County Representative. All other assignments will remain the same. PLANNING AND ZONING: DELEGATIONS: Dr. Michael Clay BYU Professor from Urban Planning LLC Master Program presented Mona City's written general plan to the council and those present. The council thanked the firm for a job well done. John Bradley and Melinda Matheson (not on the agenda) from the Nephi Recreation Center in Mona presented an update on programs provided for the summer of 2018, fall 2018 and winter 2018. Also included in the report was the Nephi Recreation Participation for 2018 for Youth & adults. The grand total for Nephi, Mona, Levan, Rocky Ridge, Eureka Sanpete County, Utah/SL County, Millard County & do not know (Special Events) was 7,556 participants with Nephi 1,582, Mona 501, Levan 211, Rocky Ridge 35, Eureka 0, Sanpete County 72, Utah/SL County 18, Millard County 5, Do Not Know ( Special Events) 5,132. DIRECTOR OF FINANCES, SECRETARY/TREASURER & RECORDERS REPORT: Director of Finance Everd Squire presented The Mona City Disbursement Listing for checking dated 01/09/2019 to 01/22/2019. There was a question on Check #3190 in the amount of $1,439.02 issued to KS Statebank. Everd answered the questions sufficiently. There were four (4) checks over the allotted amount of $2,000. The Disbursement Listing is attached and will become a permanent part of the minutes for public viewing. COUNCIL BUSINESS: There was one new business license presented to the council for Allan Barney at 213 N Main Street. The council approved the license for Action Carpet Cleaning with Councilmember Micheal Stringer moving to make a motion to approve the above business license with a second by Councilmember Randy Christensen; the vote was unanimous in favor of the business. (2nd Motion) MONA CITY COUNCIL MEETING JANUARY 22, 2019 7:30 PM COUNCIL CHAMBERS Councilmember Katrina Long told the council and those present she is currently looking for two new committee members for the Pioneer Day Celebration to replace the members who have moved or whose terms have expired. Michelle will add the information to the newsletter. Councilmember Long is researching grant information for the basketball court. Council member Micheal Stringer said the snow removal it going well. Mayor William M. Mills and the council discussed the need for a security camera at the cemetery. The mayor said there were seven (7) applicants for the crossing guard position; he would like to get moving on the hire for the crossing guard. He would like to see crossing lights at 100 S and 300 S. There was one proposal turned in for the Utilities GIS bid from Jones & DeMille, submitted by Tyler Faddis. (Tyler was not on the agenda) Their Scope of Work (General Approach) is to provide GIS services to communities is to create user-friendly systems that empower city staff to access and maintain their own utility data. Jones & DeMille's bid came in at $18,000 with the city collection data, without the city collection data, the cost would be $25,000. The fee includes a one-year ArcGis Online subscription account that J&DE will administer. Tyler told the council they will work to complete the above scope of work in a reasonable, timely manner according to the project and funding needs. There was a brief discussion on the appointment for the midterm council vacancy. City Recorder Lyla Spencer told the council Jay Mecham applied for the council position. FYI: There were three (3) motions voted upon and passed, a motion to approve the January 08, 2019 minutes, a motion to approve the business license for Allan Barney, and a motion to adjourn this meeting of January 22, 2019. All motions are recorded and in the cities records. PAY FINANCES ADJOURNMENT: Councilmember Frank Riding moved to make a motion to pay the finances and adjourn, Councilmember Michele Stringer made a second to that motion, all were in favor, the vote was unanimous, motion carried. (3rd Motion) The city council meeting was then adjourned at 8:23 p.m., with no further comments. AN EXECUTIVE SESSION IF NECESSARY: An executive session was not necessary.
