Description/Agenda

The meeting will be streamed live on the Department of Natural Resources YouTube channel with the Board Hearing available at https://youtu.be/T-WS09J4Z7g. The Board will hear the following Matters at 10:00 a.m.: 1. Per Acre Bonding Costs for Small Mines and Exploration - The Division will present information about average costs per acre for reclamation, followed by an opportunity for public comment. The Board will be asked to approve a figure that will be used for bonding small mines and exploration operations. 2. Docket No. 2019-004 Cause No. 250-03 - In the matter of the Notice of Agency Action for an order: (1) Forfeiting Surety Bonds Nos. SU46341 and SU46334 provided by American Aspen Insurance Company to secure the plugging and restoration obligations of UTAH GAS OPERATING SOLUTIONS, INC.; and (2) Authorizing the Division use the amounts forfeit to plug and reclaim the wells secured by these sureties which are located in Township 13S Range 7E, Sections 17, 19, 20, 29 and Township 13S Range 10E, Sections 11, 15 and 16 and Township 14S Range 7E, Section 5 Carbon County, Utah. 3. Docket No. 2018-022 Cause No. 139-159 - In the matter of the Request for Agency Action of EP ENERGY E&P COMPANY, L.P. for an order amending the Board's order in Docket No. 85-007, Cause No. 139-42 and the Board's order in Docket No. 2008-024, Cause No. 139-84, and establishing overlapping 640-acre drilling units and overlapping 'lay down' 1,280-acre drilling units, for the production of oil, gas and associated hydrocarbons from the Lower Green River and Green River-Wasatch Formations in: (1) Sections 29-32, Township 1 South, Range 2 West, U.S.M., (2) Sections 13-22 and 25-36, Township 1 South, Range 3 West, U.S.M, (3) Sections 19-22 and 27-36, Township 1 South, Range 4 West, U.S.M, (4) Sections 19-36, Township 1 South, Range 5 West, U.S.M, and (5) Sections 1-18, Township 2 South, Ranges 4 West through 5 West, U.S.M., all in Duchesne County, Utah. 4. Docket No. 2019-001 Cause No. 139-160 - In the matter of the Request for Agency Action of NEWFIELD PRODUCTION COMPANY for an order partially vacating the Board's orders entered in Cause Nos. 139-8, 139-42, 139-90 and 139-98 and instead establishing lay-down (horizontal) and stand-up (vertical) 1,280-acre (or substantial equivalent) drilling units for the production of oil, gas and associated hydrocarbons from the Lower Green River-Wasatch Formations comprised of Sections 1 and 2, 11 and 12, and 35 and 36, respectively, Township 3 South, Range 4 West, USM, Sections 5 and 8, and 6 and 7, respectively, Township 4 South, Range 3 West, USM, and Sections 25 and 36, and 26 and 35, respectively, Township 4 South, Range 4 West, USM, Duchesne County, Utah. 5. Docket No. 2018-013 Cause No. S0030034 - In the matter of reclamation of the LUCIN VARISCITE MINE located in the E1/2 of Section 21, Township 8 North, Range 18 West, in Box Elder County, Utah. 6. Docket No. 2019-002 Cause No. 139-161 - In the matter of the Request for Agency Action of AXIA ENERGY II, LLC for an order pooling all interests, including the compulsory pooling of the interests of certain non-consenting and unlocatable owners, within four 1,280-acre drilling units (or substantial equivalent) established for the production of oil, gas and associated hydrocarbons from the Lower Green River-Wasatch (Colton) Formations, comprised of all of Sections 13 and 24, 18 and 19, and 30 and 31 of Township 2 South, Range 2 West, U.S.M., Duchesne County; and Sections 15 and 16 of Township 2 South, Range 3 West, U.S.M., Duchesne County, Utah. 7. Docket No. 2019-003 Cause No. 139-162 - In the matter of the Request for Agency Action of AXIA ENERGY II, LLC for an order modifying the Board's spacing orders entered in Cause Nos. 139-138, 139-140, 139-149 and 139-153 to include a provision granting the Right of First Refusal to the Majority Interest Owner to drill and operate a well proposed by a Minority Interest Owner. 8. Docket No. 2019-008 Cause No. 140-17 - In the matter of the Request for Agency Action of EP ENERGY E&P COMPANY, L.P. for an order authorizing the flaring of gas in excess of the amounts allowed under Utah Admin. Code Rule R649-3-20(1.1) from the Duchesne City 1-25-26-C5-1H Well and the Duchesne City 1-25-26-C5-2H Well located in Section 25, Township 3 South, Range 5 West, USM, Duchesne County, Utah. (The Petitioner is requesting an emergency order allowing the continued flaring of gas in excess of 1,800 MCF per month from the Duchesne City 1-25-26-C5-1H Well, and the Duchesne City l-25-26-C5-2H Well, from January 27, 2019, the date when the Division's Sundry Approvals expire, until January 30, 2019, at which point EP Energy will appear before the Board to discuss extension of any emergency order issued until the RAA is heard on February 27, 2019.)
