2. Discussion/action on minutes.
Prior to discussion on the minutes Vice-Chair Meyerhoffer conveyed a message from Chair Syme, who is absent, thanking Trent for completing the road repair on 700 South.
Motion by Mr. Neal, seconded by Vice-Chair Meyerhoffer to approve the minutes from October 16, 2018. Vote called with all in favor.
3. 2019 Meeting Schedule.
Mr. Morris presented the 2019 Planning Commission Meeting schedule.
4. Public Hearing on Brookside Acres Subdivision for 20 lots at approximately 2424 West 200 South.
Motion by Vice-Chair Meyerhoffer to leave the Public Meeting and open a Public Hearing, seconded by Mr. Schofield. Vote called and all in favor.
This property is zoned A-1 and the developer is proposing a subdivision of 20 new lots on 28 acres. The proposed use does conform to the General Plan.
Public Comments:
Dixie Little, resident, said she is not against development, but would like to keep the country feel. She would like to know more about the CC&R's, square footage and size of the lots, if livestock will be allowed, the wetlands, how will irrigation ditches be affected, the high water table, flooding and drainage problems, whether the homes will have basements, and how it will affect Mill Creek.
Blaine Draper, adjoining property owner, said he is neither for or against the subdivision, but asked about having adequate fencing between his property and the proposed subdivision to contain livestock. He also stated that the slough northwest of the Slaterville Park drains water into his property, which in turn drains into the subdivision property. He wants to ensure proper drainage from the slough on his property to Mill Creek, and prevent filling/blockage of the drains.
Jim Flint, engineer for the developer, addressed some of the questions asked. He said there will be CC&R's which will continue to be refined. The size of the lots are designed as a cluster subdivision, which means they will be 15,000 square foot minimum. Some of the lots are quite large so there will be a variety of lot sizes. Animals would be allowed per city code and wetlands/ground water will be addressed in the geotechnical report. There is no piped land drain system which means the houses will have to be elevated. Mill Creek will be dedicated to the City and there will be drainage channels similar to what exists in Morris Meadows, with overflow draining into Mill Creek. Fencing material needs to be a non-combustible type.
Ned Allred, resident, wants to know about the secondary water sources. He noted that the property is serviced by North Slaterville Irrigation and South Slaterville Irrigation. He doesn't think North Slaterville would be able to provide adequate water. He noted that the development must meet the Bona Vista requirements to provide secondary water.
Ken Little, resident, who lives west of the proposed development, said he is not against the subdivision. He said that irrigation regularly causes flooding across the street and even at times in his basement. Most residents have to install sump pumps in their basement. He is very concerned about more water being added to the water table and drainage. He would like to know how far the sewer is coming down 2550 South and if residents can connect.
Matthew Leavitt, adjoining property owner, asked about access and the transportation plan. He is being landlocked by these cul-de-sacs. He also suggested that the drainage system be under a public right-of-way.
No other public comment was offered.
Motion by Vice-chair Meyerhoffer to leave the Public Hearing and return to the Public Meeting. Second by Mr. Pitcher. Vote called with all in favor, none opposed.
5. Discussion/action on public hearing.
Staff asked the developer engineer to respond to the issues raised during the public hearing:
- CC&R's - the developer emailed an updated proposed CC&R today and staff will review those before final approval. The proposed CC&R's are public and can be obtained at the City Office. Lots will be reduced to 15,000 square feet under the rural residential cluster ordinance.
- Water table - a geotechnical report is required to show the lowest floor level above the water table.
- Mill Creek - the entire stream corridor in the development will be preserved and dedicated to the City.
- Fencing - non-combustible field fence for animals with barbed wire and boxed fencing will be required adjacent to agriculture.
- Drainage system - current piping will be perpetuated, no basements, underground piping with overflow into Mill Creek.
- Sewer - a pressurized sewer line will be extended further to 2550, residents can extend further or wait until it gets to them.
- Access - access is limited to 30 lots on a cul-de-sac under the fire code, this only has 20 lots and the length is similar to the Upland Ranches. There is no transportation plan requirements applicable to this development.
Mr. Hunsaker asked Mr. Flint about the irrigation drainage ditch on 200 South right in the middle of the road and Mr. Flint said it will be piped. The fence cannot be straight barbed wire and should include box fence. He questioned the placement of the stub road adjacent to his property and said he was not included in decision of that placement. Staff was under the impression that the developer had discussed this with Mr. Hunsaker and the stub road was resolved. Staff indicated that this must be resolved in order for the project to proceed.
Vice-Chair Meyerhoffer expressed concern that the CC&R's exclude brick homes. Mr. Flint noted that this is an error in the draft CC&R's and will be removed. Staff noted that the secondary water system needs to be completed before residents move in. It was noted that Section 12.02.060 - lot access to open space - needs to be revised, as a majority of lots should have access to open space.
Mr. Hunsaker recused himself during the motion and vote due to a conflict of interest with the possible stub road benefitting his property. Mr. Hunsaker left the meeting.
Motion by Mr. Neal to table preliminary approval until more of these issues can be worked out and it can be reviewed by staff. Second by Mr. Schofield.
Discussion on motion. Mr. Pitcher feels that the commission cannot move forward on preliminary approval because these issues must be resolved for final approval.
Vote called and failed.
Motion by Mr. Schofield to grant preliminary approval, subject to all requirements being completed within the time limit established by the Municipal Code. Seconded by Mr. Pitcher. Vote called with all in favor, none opposed.
6. Commission and staff follow-up.
In January there will be some commercial developments on the east side of the City for the Planning Commission to consider. The annual training will also be held in January.
Mr. Schofield asked about the suit against Sean Hart. Staff noted that since Mr. Hart died the suit will continue against his estate. Mr. Schofield also noted that the homeless camps are returning on the railroad property again.
Staff thanked Vice-Chair Meyerhoffer for attending Project Management. Staff introduced Foster Bateman who replaced Elijah as the Community Development Coordinator.
Trent Meyerhoffer updated the commission on Pioneer Road Project - Phase 1. The 1200 West reconstruction project from Farr West to 400 North will start July 2019. Widening will be from the BDO side and it is a $5 million project.
7. Adjourn.
Being no further business, meeting adjourned at 8:12 P.M.
