1. Call to Order/Pledge of Allegiance.
Meeting called to order at 7:04 PM and the Pledge of Allegiance recited.
2. Discussion/action on minutes.
Vice-Chair Meyerhoffer pointed out a typographical correction in the minutes dated September 18, 2018, page 3, paragraph 2. Motion by Vice-Chair Meyerhoffer to approve the minutes with this correction, seconded by Mr. Pitcher. All in favor, none opposed.
3. Public Hearing on amending architecture requirement of Chapter 15.18.
Motion by Vice-Chair Meyerhoffer that we close the Public Meeting and open a Public Hearing, seconded by Chair Syme. All in favor, none opposed.
Mr. Morris discussed and explained Ordinance 2018-09, Architectural Design Standards Amended. Mr. Morris introduced Gary Hunt, an architect from the Ogden area, who explained the new building materials which are now available and being used in the area. These materials are cost and energy driven, and the technology and styles have improved greatly over the past few years. Staff said this Ordinance amendment will allow for more flexibility in design of commercial building architecture.
Chair Syme asked for public comment.
No public comment was offered.
Motion by Chair Syme, seconded by Mr. Schofield, to close the Public Hearing and re-open the Public Meeting. All voted in favor.
4. Discussion/action on Public Hearing.
Chair Syme suggested an architectural design committee be formed to review all architectural designs. Mr. Morris suggested instead that a commissioner attend the Project Management meeting on the first Thursday of each month. This would give the Planning Commission involvement from the beginning of the planning process. Chair Syme felt this could possibly work if we had colored renderings of the structure and samples of the materials that would be used. Either Chair Syme or Vice-Chair Meyerhoffer will be invited to attend.
Mr. Pitcher feels that the City should not micro-manage development and make the process difficult. Vice-Chair Meyerhoffer clarified that the commissioners are only discussing commercial development, not residential. Mr. Tobias feels we should have general guidelines, but address each one on a case-by-case basis. Chair Syme feels the Commission should be somewhat flexible in order to make it the least restrictive as possible, but still maintain standards for that particular situation.
Motion by Vice-Chair to recommend approval of Ordinance 2018-09. Motion seconded by Mr. Schofield. Vote called with all in favor, none opposed.
5. Discussion/action on occupancy and Site Plan review for ConRock at 1900 West 1351 South.
Ryan Bowden from ConRock addressed the Commission and reviewed the changes he recently made in order to comply with the City requirements. At least monthly, unless needed more often, he will ensure the sides of the road and trail are cleaned off-site. He discussed the SWIPP log they maintain and provided copies to the Commission. The broom they use on-site was purchased exclusively for their pavement and is used several times a day. Two of his managers have recently attended a class which now certifies them as a Certified Visible Emissions Reader. This means they are now qualified to conduct EPA Method 9 Tests for visible opacity in accordance with the methods established by the EPA. He talked about the height of the rock piles in their yard and pointed out that the farthest pile to the west is their asphalt pile. The asphalt has to be at a certain temperature before it can be crushed. This leaves them a narrow window in the winter to be able to crush the asphalt for spring. This pile is currently three (3) feet above the limit, and they hope the City will allow them to be over the height limit with this pile so it can be crushed before the window closes. Also, foam dampeners were installed in the back-up noise devices and a rubber mat has been installed on the crusher screen to reduce noise.
Chair Syme commented on the improvements he noticed when he visited the site. However, he is still concerned about the side sweeper which sweeps everything into the canal. Mr. Bowden discussed a new berm just installed that should prevent the dirt from entering the canal. The asphalt tailing pile which is three (3) feet too high generates no dust, as it is asphalt. Vice-Chair Meyerhoffer stated that we don't want the pile any higher. Chair Syme said it is absolutely not to be any higher or placed closer to the road than it is right now. Chair Syme also asked if there was a full tire rotation on the track out and Mr. Bowden said there was.
Vice-Chair requested that the silver bolt on the new building be rust color to blend in with the rest of the exterior. Mr. Pitcher commented that it is a vast improvement now that the asphalt has been installed. All in all the Planning Commission is very pleased with the improvements that have been made and expressed their appreciation to Mr. Bowden.
Regarding the OSHA standard for back-up beepers on their large equipment, staff indicated that there is no requirement on the amount of decibels emitted. The business is only required to have the reverse signal or a person stationed there to direct them as they back up. Regarding air quality standards for ConRock, the state considers this operation to be a minor source polluter and they are right where they should be on the scale. The state will conduct an air quality inspection if the City requests one.
Motion by Vice-Chair to approve the Site Plan/Amended Conditional Use Permit subject to the following stipulations:
1. Compliance with affected entity, staff, and agency requirements.
2. Compliance with requirements of the City Engineer.
3. Subject to staff approval of the final occupancy.
4. Height of only the asphalt tailings can exceed three (3) feet above the overpass located at SR39 and SR126.
5. Continue to maintain the corrective action measures provided to the Planning Commission on October 16, 2018.
6. Subject to approval of Ordinance 2018-09 by the City Council.
7. Continue with all prior approvals and the Conditional Use Permit subject to the amendments.
Motion seconded by Mr. Tobias. All voted in favor of the motion.
6. Discussion/action on one (1) lot subdivision 250 South 2700 West by Kim Slater.
This property is zoned A-2 and is located on an existing road with utilities. The developer proposes a minor lot subdivision with one (1) new lot. Staff presented the application. Commissioners briefly discussed the application and found it compliant.
Motion by Chair Syme to approve this minor lot subdivision with the following stipulations:
1. Compliance with affected entity, staff, and agency requirements.
2. Compliance with requirements of the City Engineer.
3. Plat and development to conform to Municipal Code requirements.
4. Adequate water shares to be provided and perpetually maintained for the benefit of the new lot.
Motion seconded by Vice-Chair Meyerhoffer. All voted in favor, none opposed.
7. Discussion/action on Site Plan for Mill Creek Plaza commercial building at 366 North 1900 West by Bryce Wade.
Mr. Tobias was excused from this discussion/action and the meeting for this item after declaring a conflict of interest. Staff indicated that this property is zoned C-2P and the developer desires to construct a commercial building at the Mill Creek Plaza.
Gary Hunt, architect on this project, said this building will be a natural extension of the buildings that already exist in the plaza. Brian Boudrero, Great Basin Engineering, said there have been some slight changes in the drainage and the sewer line, which is connected through all of the sites. This system flows north. Mr. Morris asked about a dry line to connect to the future secondary water system. Mr. Boudrero said that should not be a problem and is easy to install. Before proceeding they will need to see where any existing dry line is located to match that location. Staff noted that no secondary water is currently available, but a line is close and will eventually connect to the property.
Motion by Chair Syme to approve this Site Plan with the following stipulations:
1. Compliance with affected entity, staff, and agency requirements.
2. Compliance with requirements of the City Engineer.
3. Construction to comply with all required architecture, landscaping, and screening regulations listed in Chapter 15.18 of the Municipal Code.
4. Earth-tone building materials and colors per Chapter 15.18 of the Municipal Code.
5. Development conform to all Municipal Code requirements.
6. Dedication of waters shares to the City, connection to pressurized secondary water system upon availability, and install secondary sleeve with this Site Plan.
7. Comply with the sign ordinance.
8. Dark Sky Ordinance compliance required.
Motion seconded by Mr. Pitcher. Vote called with all in favor, none opposed.
8. Discussion/action Site Plan for PC Glass at 910 West 1700 South by Gary Hunt.
Staff reviewed the application and indicated that this property is zoned M (Manufacturing) and the developer proposes a Site Plan for a glass business. Jim Flint, applicant's engineer, discussed the issue of sidewalk, curb, and gutter on this site. He inquired about whether these improvement are to be installed or deferred. He also discussed the problem with drainage at the site, at there is little grade. Several options were discussed. It was decided to only defer sidewalk. It was discussed to allow for drainage via curb cut-outs.
Staff noted that the building will be on a future corner lot. As it is presently it would not comply with the architecture requirements of Chapter 15.18 because all sides facing a street need to be designed to meet the code requirements for architecture. The side on the future corner will not meet code when the future road is installed. The commission agreed to interpret the code that since the road is not existing at the time of application that Chapter 15.18 does not apply to a future corner lot.
Motion by Mr. Schofield that we approve the Site Plan subject to the following:
1. Compliance with affected entity, staff, and agency requirements.
2. Compliance with requirements of the City Engineer.
3. Construction to comply with all required architecture, landscaping, and screening regulations listed in Chapter 15.18 of the Municipal Code.
4. Earth-tone building materials and colors listed in Chapter 15.18 of the Municipal Code.
5. Development conform to Municipal Code requirements.
6. All signs to comply with sign ordinance.
7. Dark Sky Ordinance compliance required.
8. Water shares to be turned over to the City.
Motion seconded by Mr. Pitcher. All in favor of the motion, none opposed.
9. Discussion/action on subdivision for Townhouse Estates Phase 5 by 1045 South 1200 West by Gardener Engineering.
Staff reported that this property is zoned R-4. The developer proposes to complete Phase 5 of the Townhouse Estates. The development was originally approved in the 1980s by Weber County as a PRUD (Planned Residential Unit Development). This Phase was previously tabled by this Commission pending review by the Fire Marshall for fire access.
David Reed, Fire Marshall for Weber Fire District, spoke saying that he had submitted a Plan Review dated July 16, 2018 to Gardner Engineering listing mandatory specific and general comments. He reviewed the comments and explained that because there is only a single access to this Phase 5 and there are more than 30 units in the development, they are required to have a second access. However, since this project was initially developed under different codes in the 1980's, he will require that this Phase 5 have a fire suppression system in each new unit because there is no second access. The Fire Marshal is also requiring a hammerhead turn-around area for fire trucks to be posted with 'No Parking' signs. He said that is the only way that the development can be approved and he is also asking them to bring up their water flow up to code, which means additional fire hydrants.
Spencer Priest, Gardiner Engineering, addressed the commission and said the plans do meet the requirements stated by Fire Marshal Reed.
Motion by Chair Syme to recommend final approval to the City Council subject to the following:
1. Compliance with affected entity, staff, and agency requirements.
2. Compliance with requirements of the City Engineer.
3. Construction to comply with all required architecture, landscaping, and screening regulations.
4. Earth-tone building materials and colors.
5. Development conform to Municipal Code requirements.
6. Dark Sky Ordinance compliance required.
8. Adequate water shares to be turned over to the City for this Phase and all future Phases, with a credit for all future Phases.
Motion seconded by Mr. Schofield. Vote called with all in favor, none opposed.
10. Commission and staff follow-up.
Chair Syme said the developer at Morris Meadows needs to complete the improvements on 700 South. Staff noted that the Planning Commission had previously deferred curb and gutter on 700 South, but City Council wants it installed. The plan is to eventually install asphalt to match the curb and gutter.
Staff also noted that Rocky Mountain Power refuses to remove the power poles located in the middle of the sidewalk on 700 South because they think the power poles will be too far out of alignment. If they did, they would have to replace all of the power poles on that street.
The commission asked about the status of the High Country Inn reception center. Staff noted that a sprinkling system should have been installed when construction began, but it was overlooked at the time. They have since complied, but it delayed construction for months.
11. Adjourn.
Being no further business, Chair Syme adjourned the meeting at 9:27 P.M.
