Board of Adjustments
March 30, 2017
Braden Smith
Property Line Adjustments
Present: Mayor Korry Green, Attorney Reed Richards, Chairman Gerald Peterson, Kim Christensen, Brent Zaugg, Chad Anderson and Chris Paulsen
Minutes: The minutes for the April 22, 2014 meeting were reviewed by the Board.
Motion: Chairman Gerald Peterson made a motion to approve the minutes. Seconded Kim Christensen seconded the motion and it was passed unanimously by the Board.
Request: The Information was presented by Mayor Korry Green. Five years ago Braden Smith purchased property at 5282 South 5500 West which he thought was .53 acres. When Mr. Smith wanted to finish his basement he drew up the site plans and realized his property and frontage was not what he thought it was supposed to be. After further investigation it was determined that Mr. Smith only had .34 acres and only 90 feet of frontage which would be considered an illegal lot. He decided he needed to correct the property lines which one of them went through one of the buildings. This also affects his neighbor to the north which is Arthur Davis. It was decided to move the property line to be in line with the fences which is about where Mr. Smith and his neighbor Mr. Davis thought the lines were in the first place.
Attorney Reed Richards explained to the Board what their options were to approve or disapprove the request. One of the requirements is that the problem is not self-imposed which in this case was not since this property has been sold several times without anyone catching the property line problem.
Braden Smith and Joe Adair, the realtor for this transaction, was called into the room to present their information. After the information was presented it was determined that this is not self-imposed and Mr. Smith is trying to make the situation work for everyone.
Motion: Chris Paulsen made a motion to approved the property line adjustment and allow Braden Smith's property to be considered a legal lot with only the 90-foot frontage.
Seconded: Chairman Gerald Peterson seconded the motion and it was unanimously approved by the Board.
There are deeds that have been drawn up to transfer the properties to the correct property owners and will be recorded at the Weber County Recorder's office. Attorney Richards will create a document to be recorded that Braden Smith's property will be considered a legal lot even though it has only the 90-foot frontage.
Motion: Chairman Peterson made a motion to approve Chris Paulsen to be the Chairman of the Board of Adjustments.
Seconded: Chad Anderson seconded the motion and it was approved with a unanimous vote from the Board.
Motion: Brent Zaugg made a motion to adjourn.
The meeting was adjourned at 5:30 p.m.
