Action Items:
3. Larry Litchford - building shed on property - to be constructed by
Cleary Building Systems.
Measurements of shed will be 30' x 30 ' with an additional lean on side, making it a total of 46'. Shop will have electricity, but no water hookup. It will not be used for commercial use. Original discussion was that it would need a 15' side setback to meet accessory building code requirement. All other setbacks (front and back) were in code.
Litchford was compliant, but planning and zoning later concluded that this was not correct and would only need the 3 feet back and side setback according to 7.1.10, pg 6). Construction plans going ahead as planned.
MOTION: Commissioner Les Fryer moved to approve going forward with the building of the shed. Commissioner Eric Page seconded the motion. Motion passes unanimously.
Aye Votes: Chairman Whiteford Commissioner Fryer Commissioner Zobrist Commissioner Page
4. Brad Burbank & Tyler Scott - receive instruction from P & Z to move forward in the construction of the Scott home.
Tyler Scott presented a tentative plat map for P & Z to receive further instruction before moving ahead
in laying out the required easements. Since gaining access to Scott building property is through the Burbank property; access road goes around his field currently being farmed, and water/utility easement goes through the slough, this involves two separate deeds. Easements would need to be written into his property deeds. Scott said that a new mylar map would be drawn up by his engineer according to code including the deeds involved. Road easement would have to be off to the side of current farming access road. Cannot go under road. Recommendation also to talk to the fire marshal as being that far off the main road would need to include a fire hydrant or sprinkler system within home or possibly somewhere to pump the water from. Suggestion was made to talk to Nate Spackman who is over water concerning proper meter.
No motions to approve needed.
5. Discussion on property N of cemetery - Tony & Stephanie Mangum
Stephanie presented that things seemed to be moving right along in going ahead with building plans on said property. It was found that if house was angled just a little bit from original drawing that it would fit on property and not involve any leeway given from the canal company. Property is staked out if interested in looking. Does meet the 30 ft access from front of property to access road, and 75 ft from canal. Septic tank will go off to the south. Garage plans will be in future and would like to pour cement pad for that. Main road easement access has been already approved by DOT. A Building permit was given and will need to be taken to Steve Bench for approval. All necessary contact will need to be made to providing utility companies involved. It was noted that the house will be all electric.
MOTION: Commissioner Eric Page moved to give preliminary approval on the Mangum house as long as they will return to October P & Z Meeting with all the necessary documentation needed from Steve Bench, Health Department, Rocky Mountain Power, etc. before breaking ground. Commissioner Les Fryer seconded the motion. Motion passes unanimously.
Aye Votes: Chairman Whiteford Commissioner Fryer Commissioner Zobrist Commissioner Page
.
6. Deanna Brosnon - would like to construct an Accessory Dwelling Unit
Judah Becker, tiny home contractor, accompanied Ms. Brosnon with added details. Would like to rent out a portion of her back property (zoned as R-35) to construct a tiny home. It would be constructed on tiers, making it moveable. Size would be 20' x 10 '. Home would be financed and owned by whomever lived in it. It would provide extra income for Ms. Brosnon and an increase in property value for the city. Involves a 10-year lease, with owners moving in, not renters. Many tax advantages have been given by the state by allowing this construction. Utilities would be incorporated with current property owner utilities. She would cover all costs of utilities and sewer tank . Current code in permitted uses allows an apartment dwelling within the original family dwelling. Could be attached to the main building as part of the house, but would need to pass public health inspection anytime increased square footage is added. Could not be a separate structure, but could share a roof line by breezeway. A conditional use permit would be allowed.
No motion to approve at this time. Only seeking information and direction. Invited to come back in October with site maps and further information. A permit was given for Steve Bench approval.
.
7. Grace Supan - construction of a single car garage on property.
Map was provided showing tentative garage placement. Would take down an existing shed in back of property on the east side. Driveway goes from north to south alongside of current house. Setback would need to be 15; from side and 10; from back. Does not have required side setback. Inquired about a carport as well, but would rather have a garage. Council looked at zoning book pg 6. - 7.1.10. Side and rear setback is 3 ft. Council suggested that if she is 3 ft from south side and 3 ft from east side, and must be 10 ft from existing house.
Council suggested that she return to next meeting with a better engineered plan and a permit signed.
8. Mr. Flores building a hay barn -
Mr. David Rodriquez represented Mr. Flores as his English interpreter. Mr. Flores lives at 3033 W 10200 N, Deweyville. Would like to build a 9 ft tall hay barn, sloping to 8 ft. at the rear on his property. Hay barn is 83 ft from property line. He would need to build 3 feet from property line. No permit needed. Council approval.
Discussion Items:
8. Rhett Summers building infraction (Bobby Gardner trailer)
It was noted that Rhett first began construction without a building permit, poles were sunk along property line (no easement) and that it could not meet any of the setback requirements. It was then advised that it could be built if not attached to the current living dwelling. not on a permanent foundation, and it did not impact the neighbors property. Chairman Whiteford and Commissioner Zobrist inspected the project today and noted that it was on cinder blocks, not on a permanent foundation and it was not over any boundary lines.
It was recommended by the Planning and Zoning to continue construction.
Public Comments:
Chairman Whiteford presented that Curtis Carver from BRAG (Bear River Association of Governments) is currently reviewing our current P & Z Book and is expected to get back to us sometime in October with his findings. He is looking for any inconsistencies, duplications, and contradictions in our current policies. May Kendrick said there are several new laws that need to be implemented as well. There is no charge for his service. It is part of his role in being the community and economic development director.
MOTION: Commissioner Alan Zobrist moved to adjourn the meeting. Commissioner Les Fryer seconded the motion. Motion passes unanimously.
Aye Votes: Chairman Whiteford Commissioner Fryer Commissioner Zobrist Commissioner Frazier
