Description/Agenda
BICKNELL TOWN COUNCIL MEETING 2 AUGUST 2018 7:00 P.M. I. ROLL CALL Mayor Noreen Johnson called the meeting to order at 7:00 p.m. Council members present were: Kerry Stevens, Weston Johnson, Brian Brill, and Brigg Blackburn. Connie Durfey was present to record the minutes. Scott was present to make his report. Greg Andersen was present. Ellen Anderson came in later for just a few minutes. II. APPROVAL OF MINUTES The minutes of 5 July 2018 were reviewed. Brian made the motion to approve them as corrected. Weston seconded, all ayed. III. BUSINESS Short-term Rental Ordinance Draft. Mr. Anderson had a copy of the draft for the Short-term rental Ordinance. He gave a copy to each of the members. He said the attorney told the Planning/Zoning Commission to keep the ordinance simple and draw hard lines. The council skimmed the ordinance and discussed a few points. The surveys sent to the public were 2 to 1 in favor of limiting the number of short-term rentals in town. Of those, 90% wanted them to be limited to main street. The easiest way to do this is to have a zoning map and zone main street for the rentals. The attorney suggested the number of rentals should be a flat number, instead of a percentage. Greg asked the council what number they wanted to limit the short term rentals to. After much discussion is was decided to limit them to twelve. The council will individually go over the draft of the ordinance to see if there are any points they want to change. The draft of the ordinance will be sent to the attorney at ULCT to make sure everything is legal and to get his input. When all that is done, the Planning/Zoning Commission will have a public hearing for the ordinance. Then the ordinance will be sent to the town for approval. Work Meeting With Jeff Albrecht. Mayor Johnson reported Jeff Albrecht wants to meet with all the council and have a meeting to discuss the culinary water issues. This would be just a work meeting, not a public meeting. It was decided to have this meeting on August 23rd at 7:00 p.m. in the town hall. Mr. Albrecht will be informed of the set date and time. Grant Application for a Generator. Mayor Johnson is working on an application for a generator through the county special service district. She said the cost of said generator will be approximately $23000. The county prefers applicants have some matching funds for such a grant, usually 20%. After much discussion the council instructed the mayor to plead poverty, but offer them $3000 with a maximum of $5000. for the matching funds. The application has to be in on Tuesday, August 7th. Fire District Update. Last month Commissioner Dennis Blackburn was in attendance at our council meeting. He said from then on the county Special Service District #3, the Fire District, will pay all the bills for the fire stations in the county. He was supposed to contact Garkane Energy to have the power transferred from Bicknell Town into the District's name. However, it has not been done yet. Connie forwarded the power bill along with the water bill to the Fire District. She will check with Garkane Energy in a week or two and see if the power account has been transferred to the Fire District. If not, Dennis Blackburn will be contacted and reminded to have that done. Building Permit - Seminary. Connie received a message from Kevin Moore, of Moore Electric Company, stating he had a building permit application for an electrical upgrade at the seminary building in Bicknell. They are changing their oil furnace to an electric heat pump. He sent an email of the application and said he would put the original in the mail. Eric Torgerson, the inspector, has talked with Mr. Moore, but the application has not been received yet with the proper signatures. The council approved the upgrade. Land Use Training. Mayor Johnson told the council there will be an online Land Use Training presented by the ULCT on Saturday, August 25th here in Bicknell from 9:00 am to 1:00 pm. The cost for the training is $10. Mayor Johnson and Weston Johnson have both signed up for it. Other council members were encouraged to do so too, if they are able to. IV. MAYOR REPORT. Dog licenses. Mayor Johnson had a call from someone asking why the town requires dog licenses and what the money goes for. The town gave their dog kennel to Color Country Animal Shelter in Torrey with the agreement that any stray and/or dangerous dogs can be transported from Bicknell to them. When someone purchases a license they have to show proof of a rabies vaccination, this assures the safety of the community against rabies. Use of Fire Hydrants. Mayor Johnson asked the council if they wanted to adopt a resolution to fine persons using the fire hydrants in town without permission from the town. In the past there have been various persons that have received permission from the town to use a fire hydrant to obtain culinary water for a specific purpose. However, some have used the hydrants without permission. The council agreed a fine should be set. A resolution will be drafted to deal with this issue and presented at the next town council meeting. Planning/Zoning Commission compensation. Mayor Johnson asked the council how they feel about compensating the commission for their work. Loa Town gives their commission a set fee of $30 per meeting. After some discussion is was decided to compensate the commission $25 for each meeting, with a maximum of $50 per month. A resolution will be drafted to state this compensation rate and presented at the next town council meeting for approval. Playground at the Town Park. Mayor Johnson has had numerous persons complain about the lack of saw dust under the playground equipment at the park. They felt it was dangerous and someone could get seriously hurt. The council has discussed the need for the sawdust in past meetings and agreed it needed to be purchased. Mayor Johnson contacted the Wayne School District to see where they got their sawdust from. They got it through Thompson Logging. With permission from council members, Mayor Johnson made arrangements to have a semi-truck load of sawdust dumped at the park. Scott and Rowdy leveled it out. Mayor at Town Hall. Mayor Johnson said she would like to make herself available to the public at the town hall for a couple hours each week. She will be there on Tuesdays, from 11:00 am to 1:00 pm, beginning in September. Citizens will be informed of her intentions on the water bill at the end of August. V. MEMBERS/STAFF REPORTS Scott's Report. Scott reported the mountain springs are producing 24 gallons a minute. At this rate, the springs produced about 1,036,800 gallons of water for July. The Brinkerhoff Spring supplied 550,000 gallons in July. The chlorinator at the Brinkerhoff Spring broke, but Scott fixed it. He'll need to order some more liquid chlorine for it. Besides the regular water test done each month, Scott will need to test for Lead & copper, and nitrates. Scott and Jeff Albrecht met and looked for water at Hemlock up Sunglow. Milton Taft has filed on some of the water there. Scott reported he had dug a grave for Joe Mangum. He also dug a small spot for the ashes of Garth Brinkerhoff. The ashes were put in the plot of his father, Frank Brinkerhoff'. Scott installed the new door for the rest room at the town park, he also fixed the toilet in that stall. Scott and Rowdy have finished placing the decorative rock on the north side of main street, the south side still needs to be done. A bearing on the irrigation pump went out last night, Scott worked during the night to replace it, it's working fine now.. He needs to have another bearing ordered to have one on hand. The Posse House and the Post Office used a lot more water than usual this last month. Scott checked for any leaks, but there weren't any, so he doesn't know where the water went. He'll see what happens this month. Scott replaced the battery in the street mower. Scott says the lawn mower needs a new deck. It is not in the budget for that this year, so Scott will have to put in a new bearing and fix it as best he can for now. Weston. Weston reported the quarterly chlorine report has been done. Brian. Brian just wondered if the Sulsers have a septic tank on their property, because he could see a line going out into the field. Yes, they do have a septic tank, the line he saw was running into it. Connie. Connie reported that Michael Blackburn had sent in his business license application and money for the short-term rental he was approved for before the moratorium. He put in the address of the house he owns on 4th south. Originally he wanted to put it on 2nd north and center. He will be reminded he was approved for just one rental, so if he intends to use the property on 4th south that's where it will stay, the license is non transferrable. Financial. The following bills were presented for payment approval on 2 August 2018. Weston made the motion to pay them. Brian seconded, all ayed.
