1. Call to Order/Pledge of Allegiance.
Chair Syme called the meeting to order at 7:00 PM and the Pledge of Allegiance was recited. Mayor Van Leeuwen expressed his appreciation to members of the Planning Commission, saying that they are the ones who are shaping the face of Marriott-Slaterville City for the future. The decisions they make are very important. He encouraged the newer members to learn from those who have served for a longer period of time. He also recognized the contributions of city staff and said his door is always open.
2. Discussion/action on minutes.
Motion by Vice-Chair Meyerhoffer, seconded by Chair Syme, to approve the minutes dated April 17, 2018, with minor corrections noted. All in favor, none opposed.
3. Discussion/action on Townhouse Estates Phase 3 at 1045 South 1200 West - Third Amendment.
Applicant was not present, but Mr. Morris presented the staff report to the Commission. This property is currently zoned R-4. The developer proposes to complete Phase 3 and Phase 5 of the Townhouse Estates. This development was originally approved in the mid 1980's by Weber County as a PRUD. The City is following the site development standards from the R-4 Zone and ordinance which has since been repealed.
Developer is requesting that one of the new proposed units in Phase 3 face the park, which none of them currently do. Commissioners do not want the units to face the park and expressed the need in keeping with the original site plan that was approved. Mr. Meyerhoffer expressed concerns about fire safety and secondary access.
Motion by Mr. Schofield to table this Phase 3 Amendment with the requirement that the applicant comply in facing the units east as per the original PRUD. Also that applicant comply with all other requirements. Motion seconded by Mr. Neal. Motion passed unanimously.
4. Discussion/action on Townhouse Estates Phase 5 at 1045 South 1200 West.
Staff presented the proposal for Phase 5 of this PRUD. The developer was not present. Vice-Chair Meyerhoffer reiterated concerns over fire safety and secondary access. Staff noted the fire safety turn around shown on the plan. Commissioners expressed interest in having the approval letter from the Fire Marshall before proceeding.
Motion by Mr. Meyerhoffer to table this item until the developer obtains approval from the Fire Marshall, addresses any secondary access, and complies with all other requirements. Motion seconded by Chair Syme. Motion passed unanimously.
5. Discussion/action on CAD 2 Development for a Conditional Use Permit at 1001 South 1200 West.
This property is zoned R-4 with allows for some limited office uses. This zone designation is a holdover zone from Weber County prior to the city incorporating. The R-4 Zone no longer exists. Applicant has used the building as a support annex for IRS. The IRS has now terminated the lease and moved out of the building. Applicant desires to divide the building into two types of office uses. The first is a call center that would occupy 60% of the building. The second use is a veteran's clinic the will occupy the remaining 40% of the building. Both office uses are allowed as a conditional use in the R-4 Zone.
The Applicant, Paul Domgaard, representing CAD2 Development presented a brief history of the former IRS building located at this address. It was pointed out that there will be no changes required to storm water, architecture, landscaping, screening regulations or earth-tone colors because it is an existing building. Applicant also requested to have an ATM machine on site as well.
Applicant was asked if the City can continue to use parking for its events at the Marriott Park. There was no objection from the applicant who said he has enjoyed the relationship with the City and that employees benefit from being able to use the Marriott Park.
Motion by Vice-Chair Meyerhoffer to approve the Conditional Use Permit for the uses proposed, including the installation of an ATM, subject to the requirements in the Staff Report dated May 15, 2018. Motion seconded by Mr. Tobias. Motion passed unanimously.
6. Commission and staff follow-up.
Staff indicated that a lawsuit has been filed in 2nd District Court against Sean Hart who has a trailer parked illegally on his property on 17th Street.
Transients have been camping on our public works property on 17th Street. They have been there for an extended period of time, as well as other areas in the city. They have been removed from the City property.
Water shares and the conservation easement have been completed for Stanger Subdivision.
There have recently been some serious issues with pumps at Spencer Farms/Mill Creek Meadows irrigation pond. Also beaver dams and blockages have been cleared throughout the community.
Penske on 12th Street will soon open.
A lawsuit has been filed on theVitt property. A lawsuit was also filed at the Riverside Industrial Park for a nuisance junk yard.
Commissioners asked about the rock crushing operation at Advanced Paving. Staff noted that this is a contractor fill area and is a continuation from under Weber County that is permitted. It is also the staff's understanding that once the property owner finishes the fill operation the property will be donated to the City.
Commissioners are concerned that the owner of Dave Wadman's old house is creating clutter with junk again. Staff will investigate.
Mr. Schofield noted that Wilma Packer and Dave Stanger's property were under water most of last summer. Staff noted that this was caused by a massive beaver dam which has been removed. Mr. Schofield is also concerned that Leon Stanger has removed the overflow ditch. Staff noted that Mr. Hodson from the Marriott Irrigation Company gave consent, and that the City is working to relocate the overflow to the irrigation pond at Morris Meadows.
Chair Syme is concerned about Conrock with its growing pile of crushed material. Staff will follow-up on this matter. Chair Syme said that the track-out cleaner is still not in place.
7. Adjourn.
Chair Syme expressed his appreciation to staff for all they do, and being no further business the meeting was adjourned at 7:48 P.M.
