BICKNELL TOWN COUNCIL MEETING 3 May 2018 6:00 P.M. I. ROLL CALL Chair Person/council member Kerry Stevens called the meeting to order at 6:00 p.m. Council members present were: Brian Brill, Noreen Johnson, Kerry Stevens, and Weston Johnson (a few minutes late). Connie Durfey was present to record the minutes. Scott was present to make his report. Also present were: Paul & Liz Pace, Greg & Ellen Anderson, Shannon Robertson, Steve & LeAnn Albrecht, Maurice Albrecht, Emil Brinkerhoff, and Brad Brinkerhoff. II. APPROVAL OF MINUTES The minutes of 5 April 2018 were reviewed. Brian made the motion to approve them as corrected. Weston seconded, all ayed. III. BUSINESS Appoint Mayor. On 13 April 2018 the town council received a letter of resignation from Mark Moosman as Mayor. Mr. Moosman said he just didn't have the time to do the job properly. On 16 April 2018 a notice of this vacancy was posted in town and on the Public Notice Website that anyone who would like to be considered for the appointment of mayor until the next election should contact Connie Durfey, the town clerk, by noon on Tuesday, 1 May 2018.Two persons submitted their names for consideration, Steve Albrecht and Noreen Johnson. Chair Person Kerry Stevens asked Mr. Albrecht and Ms. Johnson to briefly state why they would like to be mayor. After each on them made their statement, Mr. Stevens asked for a vote by each of the council members. Brian Brill voted for Noreen Johnson, Noreen Johnson voted for Noreen Johnson, Weston Johnson voted for Noreen Johnson, and Kerry Stevens voted for Noreen Johnson. Noreen Johnson was appointed mayor. As Ms. Johnson had previously sworn an Oath of Office it was not necessary to do so again. With the appointment of Ms. Johnson, this leaves a new vacancy on the council. Connie will post a notice of that vacancy on Monday, 7 May 2018. The new council member will be appointed at the next town council meeting in June. Moratorium Short-Term Rentals. As had been discussed in previous council meetings the town needs an ordinance covering all aspects on short-term rentals. There are many different issues and concerns to be addressed and the impact on the community now and in the future. As it may take some time to prepare this ordinance the town council is proposing a moratorium on short-term rentals up to a maximum of six months. There was considerable discussion from the council and interested parties. Emil Brinkerhoff was quite vocal about this restriction. He stated he had put considerable money into one of his houses to make it into a ST rental. This is the first Mr. Brinkerhoff has come before the council with his plans. The council feels this temporary moratorium is in the best interest of the town as a whole. Weston Johnson made the motion to adopt the moratorium. Kerry Stevens seconded, all ayed. The moratorium will take effect immediately upon posting. This will be done tomorrow. Emil Brinkerhoff, Maurice Albrecht, Steve and LeAnn Albrecht, Greg & Ellen Anderson, and Brad Brinkerhoff excused themselves. Paul Pace - culinary water. Mr. Pace asked the council about the new business of Lee Taft's. Apparently Mr. Taft has begun an ice making and distributing business in conjunction with his Taft Travel Plaza just outside of town. The council has seen signs of this also. Noreen contacted the county earlier in this week about said matter. They have not issued Mr. Taft a business license for this enterprise. The council is very concerned about this as there is a water shortage right now and this type of business will put a considerable strain on the water supply. This business was started without the approval of the town for the usage of additional water. Mr. Taft already uses an abundance of water with his car wash. Mayor Johnson will contact David Church, the attorney at the ULCT, and see what the town's legal recourse is. There is a moratorium on new water connections outside the town limits right now because of limited water and storage, so this new business is a major concern. In a previous meeting Mr. Pace wanted to know if he could transfer an existing water connection in town to a property out of town. The town policy does not allow the transfer of culinary water connections. Mr. Pace requested a copy of that. Mr. and Mrs. Pace thanked the council and excused themselves. Brian Brill has another commitment tonight and excused himself. Short - term rental ordinance discussion. Mayor Johnson had a copy of an ordinance dealing with short-term rentals that Torrey Town is considering. She requested each council member study the ordinance and come prepared at the next meeting to discuss it. Ms. Robertson asked the council if this new moratorium on short-term rentals would affect the approval she received last month to have her home an Owner Occupied short-term rental. The town assured her she could proceed with her plans as soon as her formal Business License Application was completed. Ms. Robertson thanked the council and excused herself. Preliminary Budget 2018-2019. Connie gave each of the council a copy of the budget worksheet for next year. The figures were discussed, some adjustments made and questions answered. Mayor Johnson was wondering if a raise for council members could be implemented into the budget. An increase could be allowed for in the budget, but there would have to be a Public Hearing first before changes could be made. The town council members and mayor have been paid the same amount ($50 a month, paid quarterly) for many, many years. Mayor Johnson has acquired comparison figures for towns in our valley. Loa Town's council members are paid yearly $2400 (average $200 a month), the mayor is paid yearly $3300 (average $275 a month). Their maintenance person is paid $15.50 per hour, plus benefits. Their clerk is paid $15.79 per hour, plus benefits. Torrey Town pays their council $150 per month, and their mayor $400 per month. Their maintenance person is paid $14.79, plus benefits. They have a Recorder who is paid $700 a month, and a treasurer who is paid $1224. Both Loa and Torrey have more revenue that Bicknell. Lyman's mayor is paid $125 per month, the council members $75 per month, clerk is paid $315 per month. After considerable discussion it was decided to propose new wages for Bicknell Town council and employees as follows: Mayor $125 per month, council members $100 per month, and a 3% cost of living raise for the clerk and maintenance man. A Public Hearing for this proposal will be held in conjunction with the Public Hearing for the Budget at the next town council meeting in June. IV. MAYOR'S REPORT Mayor Johnson asked the council if they would be interested in reinstating a Planning and Zoning Committee for Bicknell. One was set up in November of 2000, then dismantled in April 2004. Members will think about it and also about whom they might be able to get to serve on said committee. Mayor Johnson asked the council if they wanted a large county dumpster brought into town for use by the town citizens. The county will only bring one dumpster for one day, however, it will be emptied each time it is filled that day. The town will have to pay for the dumpster. The council all agreed to see if one is available for Saturday, 9 June 2018 and have it brought in. Notices will be posted in advance informing the citizens when and where in town it will be. V. STAFF REPORTS. Scott's Report. Scott reported the mountain springs are producing 40 gallons a minute. The water tank is down two feet. Scott took a water sample yesterday and has not heard anything so assumes is was okay. The irrigation water is in lines and there were some leaks, but have been fixed. Harward & Rees are done with the main street project. The town is responsible to put down the ground cover fabric and the decorative rocks. Some more rocks may need to be purchased because of the extension of the area around the turn on the east end of main street. The owners have given permission to have the fence along there removed and the trees which are growing up in it, and agreed there is no responsibility for the town to put up a new fence now or in the future. The prisoners are coming tomorrow to help with placing the decorative rocks. The drainage ditch by Ryan Torgerson's needs to be cleaned, along with other ditches in town. Scott has been digging the grave for Phil Torgerson, there are huge rocks in that area so it has been slow. Scott requested a few more flags be purchased to put on the graves of the veterans for Memorial Day. Permission was granted. The cemetery needs to be fertilized. The In The Green company, which has been doing this in the past, has gone out of business. Scott will have to do the fertilizing this year. The cemetery is really dry, do to the lack of moisture this winter, Scott hopes it can be make presentable for Memorial Day. Scott asked the council if he was going to have summer help again this year. The council agreed to this request. Connie will place a notice in the Insider and here in town for applicants. Financial. The following bills were presented for payment approval. Kerry made the motion to pay them, Weston seconded. All ayed.
