ORDINANCE - Amending Chapter 7 of the Orem City Code pertaining to the Electrical Code RECOMMENDATION: The Director of Development Services recommends that the City Council, by ordinance, amend Chapter 7 of the Orem City Code pertaining to the electrical code. BACKGROUND: State law requires that cities adopt specified versions of the national and international codes pertaining to buildings. The proposed amendment reflects the most recent changes in building and safety standards. These changes are necessary in order to ensure the safety and welfare of Orem's citizens is safeguarded to the best of the City's ability. It is recommended Chapter 7 of the Orem City Code be amended to read as follows: 7-1-5, National Electrical Code Adopted. The City hereby approves and adopts the National Electrical Code, 2017 Edition, published by the National Fire Protection Association, as amended by the State Division of Occupational and Professional Licensing, including Annex H, as the Electrical Code for the City of Orem. Fees shall be in the amount established by the City Council in the City's annual budget. The National Electrical Code, 2017 Edition, is on file in the office of the City Recorder and is hereby adopted and made a part hereof as if fully set out in this ordinance. SCHEDULED ITEMS 18. RESOLUTION - Approving the authorization of the Governor's Office of Energy Development (OED) to conduct the Commercial Property Assessed Clean Energy District (C-PACE District) within the City of Orem PRESENTER: Ryan Clark RECOMMENDATION: The Economic Development Division Manager recommends that the City Council, by resolution, authorize the Governor's Office of Energy Development (OED) to conduct the Commercial Property Assessed Clean Energy District (C-PACE District) within the City of Orem and authorize the Mayor to execute the Governing Body Participation Agreement. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: C-PACE, also known as Commercial Property Assessed Clean Energy, provides zero down and up to 100 percent private financing for up to 30 years for commercial building improvements. Improvements can include energy efficiency upgrades, renewable energy systems, water conservation measures, seismic upgrades, hybrid elevators and escalators, electric vehicle infrastructure, and parking automation. Commercial buildings that are eligible include housing, industrial, office, and retail. C-PACE is an attractive option for building owners seeking to upgrade their buildings with new, energy-efficient equipment. For developers planning new buildings, C-PACE provides a major financial incentive to design buildings 'above code,' which leads to significant operational cost savings as well as improved thermal comfort and indoor air quality. In a C-PACE transaction, local banks or specialty private capital firms provide long-term, fixed-rate financing that covers 100 percent of the project cost. The program is administered by the Governor's Office of Energy Development (OED). To allow Orem commercial projects to participate in C-PACE, a resolution authorizing OED to conduct the C-PACE district within the City of Orem and an associated participation agreement is required. The C-PACE district will administer the program at no cost to the City. This includes assigning a lien to the real property associated with a commercial participant. City staff will be responsible for adding C-PACE information to the City website, distributing an informational letter from appropriate City officials to local businesses regarding the program, and conducting one or more business roundtable events. Basically, the City is to assist with marketing the program. The Economic Development Division Manager now recommends that the City Council, by resolution, authorize the Governor's Office of Energy Development to conduct the Commercial Property Assessed Clean Energy District (C-PACE District) within the City of Orem and authorize the Mayor to execute the Governing Body Participating Agreement. 19. RESOLUTION - Approving a fence modification at 220 West Center Street (Wiggy Wash Car Wash) in the C2 zone PRESENTER: Jason Bench REQUEST: Brent Wignall requests the City approve a fence modification at 220 West Center Street in the C2 zone to add an additional fence 10 feet in height and 50 feet in width approximately five feet from the south property line directly in front of the exit doors POTENTIALLY AFFECTED AREA: Orem Park Neighborhood BACKGROUND: As part of the Wiggy Wash site plan approved by the Planning Commission in August 2017, the applicant installed the required seven-foot masonry wall adjacent to the residential properties on the south and west property lines. Following construction of the Wiggy Wash site, several neighbors complained about the noise emanating from the Wiggy Wash property. The excess noise is coming from the blowers installed as part of the car wash. Staff have visited the homes of the neighbors directly south of and adjacent to Wiggy Wash and have determined that the noise coming from the Wiggy Wash property needs to be reduced. The applicant proposes to install an additional wall on the south property line to reduce the noise to a level that is consistent with sound levels typically found with normal conversations (between 60-70 decibels). The request is made pursuant to Orem City Code Section 22-14-19(F) which permits the City Council to approve a fence modification. The proposed sound wall is directly south of the car wash exits. The proposed wall will be 50 feet wide and 10 feet tall. However, no detailed sound study was provided to show if the proposed wall will reduce the noise coming from the site to acceptable levels. Without some type of verification, staff is not able to determine if the proposed wall will provide the desired noise reduction RECOMMENDATION: Staff recommends the City Council consider a fence modification to allow the new fence proposed by the applicant. However, without additional information from a sound professional, it cannot be determined if the proposed wall will accomplish the goal of reducing the noise for properties directly south of the development. 6:00 P.M. PUBLIC HEARING - Strawberry Fields Development 20. ORDINANCE - Amending Section 22-5-3(A) and the zoning map of Orem City by rezoning the property at 676 East Timpanogos Parkway from PD-6 (Tech Park) to the PRD zone (Planned Residential Development) PRESENTER: Jason Bench REQUEST: The applicant requests the City amend Section 22-5-3(A) and the zoning map of the City of Orem by rezoning the property at 676 East Timpanogos Parkway from PD-6 (Tech Park) to the PRD zone (Planned Residential Development) and amending Appendix KK by adding the Strawberry Fields concept plan. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: On February 27, 2018, the City Council approved an application to change the General Plan Designation of the property at 676 East and 759 East Timpanogos Parkway from Professional Office to Low Density Residential. Due to differences in the two sites, requests to rezone the two parcels are now being submitted separately. The applicant has applied to rezone the parcel at 676 East Timpanogos Parkway from PD-6 to PRD. If the request is granted, he plans to build single-family homes and one twin-home similar in style to those he has built in other locations around the City. RECOMMENDATION: The Planning Commission recommended that the City Council, by ordinance, amend Section 22-5-3(A) and the zoning map of the City of Orem by rezoning the property at 676 East Timpanogos Parkway from PD-6 (Tech Park) to the PRD zone (Planned Residential Development) and amending Appendix KK by adding the Strawberry Fields concept plan. Staff supports the recommendation of the Planning Commission. 6:00 P.M. PUBLIC HEARING - Rezone from Medium Density Residential to Regional Commercial - Randy's Mechanical 21. ORDINANCE - Amending the Orem General Plan Map by changing the General Plan land use designation at approximately 540 North 1200 West from Medium Density Residential to Regional Commercial PRESENTER: Jason Bench REQUEST: The applicant requests the City Council amend the Orem General Plan by changing the General Plan land use designation at approximately 540 North 1200 West from Medium Density Residential to Regional Commercial POTENTIALLY AFFECTED AREA: Geneva Heights Neighborhood BACKGROUND: Randy's Mechanical is a locally owned business that has been in business for over 40 years. The applicant and owner would like to expand his business on the subject property, but in order to do so the property would need to be rezoned. Currently there is one house on the property that has been used as a business along with a small parking lot. The applicant would like to tear down the house to expand the parking lot and add a new two-story office building. Part of the office space would be used for his business and the rest he would rent out as office space. RECOMMENDATION: The Planning Commission recommends the City Council deny the proposed amendment to the Orem General Plan. 6:00 P.M. PUBLIC HEARING - SLU Code 7418 - Recreational Axe Throwing 22. ORDINANCE - Amending Appendix A of the Orem City Code to add Standard Land Use Code 7418 (Recreational Axe Throwing - Indoor Only) and to make SLU 7418 a permitted use in the C2 and HS zones PRESENTER: Jason Bench REQUEST: The applicant requests the City amend Appendix A of the Orem City Code by enacting Standard Land Use Code 7418 (Recreational Axe Throwing - Indoor Only) as a permitted use in the C2 and HS zones. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: Axe throwing is a sport in which the competitor throws an axe at a target, attempting to hit a bull's eye. It is like darts, archery, and bowling. Originally a competition in Lumberjack competitions, it has become a wide-spread activity for the average person. So far, axe throwing has not been a permitted use anywhere in Orem. Social Axe, a company that owns axe-throwing centers in Ogden and Salt Lake City, has proposed an amendment to the Orem City Code to allow recreational axe throwing in the City. The proposed amendment is outlined below: APPENDIX A. LAND USES BY ZONE RECOMMENDATION: The Planning Commission recommends the City Council, by ordinance, amend Appendix A of the Orem City Code by enacting Standard Land Use Code 7418 (Recreational Axe Throwing - Indoor Only) as a permitted use in the C2 and HS zones. Staff supports the recommendation of the Planning Commission. 6:00 P.M. PUBLIC HEARING - City Center District Zone 23. ORDINANCE - Enacting Article 22-24 (State Street District Zones), enacting Section 22-24-1 (City Center District Zone), and amending Sections 22-2-1 (Definitions); 22-11-1 ((PD Zone) Purpose and Applicability); 22-8-8 (Zone Development Standards); 14-3-3 (Specific Regulations by Sign Type); 14-4-4 (Modification of Requirements); 22-5-3(A) and the Zoning Map of Orem City by changing the zoning of properties located within approximately 1/2 mile radius from 56 N. State Street from the C2, PD-1, PD-30, R6, C3, and R8 zones to the City Center District (CCD) Zone PRESENTER: Jason Bench REQUEST: The Department of Development Services requests the City Council enact Article 22-24 (State Street District Zones) and amend Sections 22-2-1 (Definitions); 22-11-1 (PD Zone) (Purpose and Applicability); 22-8-8 (Zone Development Standards); 14-3-3 (Specific Regulations by Sign Type); 14-4-4 (Modification of Requirements); 22-5-3(A) and the Zoning Map of the City of Orem by changing the zoning of properties located within approximately a 1/2 mile radius of 56 N. State Street from the C2, PD-1, PD-30, R6, C3, and R8 zones to the CCD-C (Core), CCD-E (Edge), CCD-Civ (Civic), CCD-Res-A (Residential) and CCD-Res-B (Residential) zones. POTENTIALLY AFFECTED AREA: Citywide; Orem Park, Sharon Park, and Suncrest Neighborhoods BACKGROUND: One of the goals outlined in the State Street Corridor Master Plan is to 'develop districts that will have unique, yet complementary characters' (p.12). This plan identifies five distinct districts that require tailored zoning ordinances to guide their future development. The 'City Center District' was chosen as the first district area to be studied and rezoned as part of this effort. In preparing the City Center District ordinance, the City enlisted the assistance of the consulting firm CRSA to provide analysis regarding potential standards to be adopted for the State Street Districts. The proposed Article 22-24 'State Street District Zones' establishes the framework for five future State Street Districts, though only the first (the 'City Center District') is established at this time (Section 22-24-1). A few other necessary and related sections (such as the 'Signs' and 'Definitions' sections) of the Orem City Code also require amendment to supplement the establishment of the new zones for the City Center District. Executive Summary The goal of the proposed ordinance amendments is to establish Orem's first 'downtown' district with standards that will make the area a unique, identifiable, and lively place. The proposed new standards will allow mixed-use developments as a permitted use within the City Center District, which will relieve some development pressure on other areas of the City. Concurrent with the proposed City Center District zones, Staff are proposing an ordinance amendment that would prohibit the creation of new high-density residential PD zones in existing residential zones. The goal of this amendment is to preserve Orem's single-family residential neighborhoods and to confine future higher density housing to the State Street Districts which is in accordance with the State Street Corridor Master Plan. The primary objectives accomplished by the City Center District ordinance are as follows: - Establish the framework for all five State Street District zones. - Establish the City Center District (CCD) Zones. - Establish five separate zones within the City Center District with specific development standards tied to each. - Establish detailed development standards for building height, setbacks, lot area, building frontage requirements, architectural requirements, materials, entrances, windows, awnings, balconies, drive-thru structures, screening, lighting, and open space. - Provide standards for parking lots, parking structures, shared parking agreements, and bicycle parking. - Establish development bonuses to be awarded to developers that provide public amenities. - Establish and apply a new Sign Zone H that will apply to most of the City Center District. Sign Zone H prohibits pole signs, but allows more monument signs, wall signs, and blade signs in their place. Public Outreach The City and its consultant, CRSA, have been engaging with the public and with as many stakeholders as possible throughout the process. The City has held six public meetings to solicit public feedback, including a stakeholder meeting, open houses, a design charrette, and a luncheon. Staff have also posted a question about the City Center District on the Orem Forum, which had another 97 visitors. The ideas generated from these meetings and online discussions have shaped the standards established in the proposed ordinance. In particular, building height, density, and the boundaries of each of the City Center zones were established by group discussions with the public. The City also mailed a total of 3,688 postcards on May 21st, 2018 to announce the public meetings for this ordinance. The City also hand-delivered invitations to all 100+ businesses within the City Center District to attend the brown-bag luncheon held on June 5th, 2018 (which had roughly 30 participants). RECOMMENDATION: The Planning Commission recommended the City Council enact, by ordinance, Article 22-24 and Section 22-24-1, and amend, by ordinance, Sections 22-2-1; 22-11-1; 22-8-8; 14-3-3; 14-4-4; 22-5-3(A) and the Zoning Map of the City of Orem and to change the zoning of properties located within approximately a 1/2 mile radius from 56 N. State Street from the C2, PD-1, PD-30, R6, C3, and R8 zones to the CCD-C (Core), CCD-E (Edge), CCD-Civ (Civic), CCD-Res-A (Residential) and CCD-Res-B (Residential) zones. Staff supports the Planning Commission recommendation. 24. RESOLUTION - Calling a special election on November 6, 2018 for the vote on the PD-48 Zone Referendum PRESENTER: Greg Stephens REQUEST: The City Manager recommends that the City Council consider calling a special election for November 6, 2018 for the vote on the PD-48 Zone Referendum. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: On February 13, 2018, the City Council passed Ordinance No. O-2018-0005 to rezone 9.58 acres at approximately 1000 South 400 West from the R8 residential zone to the PD-48 student housing zone. A group of referendum petition sponsors filed an application for a referendum and they obtained sufficient signatures to put the PD-48 Zone Referendum on the ballot. Utah law provides that unless the City Council calls a special election, municipal referenda that have qualified for the ballot will appear on the next regular municipal election ballot. The next regular municipal election is on November 5, 2019. The City Council has received requests to call a special election for the PD-48 Zone Referendum so that this issue could be resolved by Orem voters before November 5, 2019. Utah law provides that the City Council may only schedule special elections to be held on the fourth Tuesday in June or the first Tuesday after the first Monday in November. Several federal, state and county elective offices are already scheduled to be on the ballot for the November 6, 2018 election. The proposed resolution would place the PD-48 Zone Referendum on the ballot for the November 6, 2018 election. RECOMMENDATION: If the City Council desires to call a special election, the City Manager recommends that the City Council, by resolution, call a special election on November 6, 2018 for the vote on the PD-48 Zone Referendum. 6:30 P.M. PUBLIC HEARING - FY 2017-2018 Budget Amendment 25. ORDINANCE - Amending the Current Fiscal Year 2017-2018 Budget PRESENTER: Richard Manning and Brandon Nelson RECOMMENDATION: The City Manager recommends the City Council hold a public hearing to discuss amending the current Fiscal Year 2017-2018 Budget and, by ordinance, amend Fiscal Year 2017-2018 Budget. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: The Fiscal Year 2017-2018 City of Orem budget has many adjustments that occur throughout the fiscal year. These adjustments include grants received from Federal, State, other governmental or private entities/organizations; appropriating reserves in the General Fund and transferring them to the Capital Projects Fund in order to meet state legal compliance requirements regarding maximum General Fund fund balance as well as providing various project funding; adding additional project funds due to interest earnings on the Siemens energy savings improvement lease escrow account unspent funds; and additional funds received for the Well #10 construction project. An adjustment due to an error during printing of the Fiscal Year 2017-2018 City of Orem adopted budget is necessary for certain Recreation fees. The adjustments are as follows: Orem Senior Friendship Center Activities Saturday Night Dance Admission - Listed at $6.00/person but should be $8.00/person. Outdoor Programs Baseball - Group 2b - Field Participation Fee listed as $5/participant but should be $6/participant. Soccer - Group 2 & Group 3 - Listed as $4/participant but should be $4/participant/season. Soccer - Group 4 - Yearly Rental (I) listed as $1,700 but should be $2,550 and Yearly Rental (II) listed as $2,500 but should be $3,750 COMMUNICATION ITEMS 26.
