This property is zoned A-1 and the applicant was granted approval for the initial construction of Phase I with lots along 700 S. Applicant is now seeking approval of 11 lots in Phase II.
Motion by Vice-Chair Meyerhoffer that we close the Public Meeting and enter a Public Hearing. Motion seconded by Chair Syme. Vote called with all in favor.
Public Comments:
Connie Stark, realtor, said she is in favor of the subdivision.
Ashley Clayton, resident, asked if it would be possible to have a privacy fence installed between the vacant lot and her house, then the canal. She also asked if there are any Covenants, Conditions, and Restrictions (CC&Rs) on the homes that will be built.
Jill Hamblin, resident, said she is concerned about the speed limit (currently 35 mph) which she thinks is too high.
Keith Cook from the firm of Lear and Lear in Salt Lake City said they already have families who will be moving into the subdivision and he is also concerned about the speed limit and feels it should be lowered. He is in favor of the subdivision and feels there is a need for it.
Bob Perry, resident, asked about the size of the lots and where the roads will be. The city has a copy of the plan for those who are interested in seeing it.
Scott Slater, resident, commended the Planning Commission for their efforts to protect the integrity of the City by observing all regulations and ordinances the city requires. He encouraged them to continue to adhere to the city ordinances.
Joe Stanger, resident, asked about sidewalk, curb and gutter. His children catch the bus on 700 South and he is concerned about them walking on 1200 West without a sidewalk. He also asked about the 1200 West widened in the future.
There were no other public comments.
Motion by Vice-Chair Meyerhoffer to close the Public Hearing and return to a Public Meeting. Second by Chair Syme. Vote called with all in favor.
5. Discussion/action on public hearing.
Mr. Morris was asked to respond to the Public Comments:
A privacy fence can be required for lots 4, 5, and 6,under the code, with a vinyl fence or chain link. Vinyl fences are not allowed along irrigation ditches.
Phase 2 will have CC&Rs similar to Phase 1. Mr. Morris has yet to review the draft CC&Rs for Phase 2. Phase 1 was strict and acceptable.
It was pointed out that the speed limit on 700 South has always been 35 mph, but it could be dropped to 30 mph at the City's discretion, but no lower without a traffic study. The commission suggested it be lowered to 30 mph between 1900 West and 1200 West.
The minimum lot size is 15,000 square feet as this is part of the rural residential cluster subdivisio. The remaining 8-10 acres on the opposite side of Mill Creek will be preserved as perpetual open space. Since the homes are in an A-1 zone but on smaller lots, the excess acreage is in the conservation easement.
As far as widening 1200 West, this would occur on the east side of the road until they reach the Ogden Nature Center. From there it may have to be widened on the west side of the road. The city cannot use eminent domain against the federal government who has some interest in the Ogden Nature Center. Curb, gutter, and sidewalk on 1200 West will be addressed in Phase 3.
Leon Stanger, developer, was asked what his time line is for Phase 2. He anticipates Phase 2 will begin this summer and Phase 3 will begin next year.
There are no specifications on uniformity of fences, but any installed are required to comply with city ordinances. Vinyl fences may be up to six (6) feet high in the rear and side yard, and four (4) feet in the front yard.
Motion by Vice-Chair Meyerhoffer to recommend approval of Phase 2 subject to the following stipulations:
- Change speed limits to 30 mph.
- A vinyl privacy fence be installed on the Clayton property.
- Staff to review any changes on the CC&Rs.
- The turn around must be constructed properly.
- Comply with staff and affected entity requirements.
- Compliance with requirements of the City Engineer.
- Development must conform to Municipal Code requirements and Public Works Standards.
- Coordinate the Conservation Easement and Development Agreement to satisfaction of the City Attorney.
- Provide adequate water shares to the Special District.
Motion seconded by Mr. Schofield. Vote passed unanimously to recommend preliminary and final approval for Phase 2 with the recommendation to forward to City Council for their action.
6. Discussion/action on revised ordinance for Dark Sky Regulations.
Chair Syme said he likes the new draft of the ordinance. He has some concerns, specifically Section 7.3 as he feels that all of the lights should be brought into compliance rather than just exterior materials that exceed 25% of the building's exterior area. He also feels we should review this on an as-needed basis rather than making it mandatory for everyone.
Mr. Pitcher is concerned about the standard for commercial versus residential under Section 7.3.
Vice-Chair Meyerhoffer expressed concern about the requirement to remove holiday lights. Mr. Morris was directed to modify that section. Vice-Chair also asked how we will enforce violations listed in Section 8. Staff indicated that our code enforcement is now handled by Mr. Brandley.
Mr. Pitcher does not like this ordinance and feels that it is too restrictive.
Mr. Schofield said he is not in favor of the ordinance because he feels it is too regulative.
Mr. Tobias noted that when he developed the plaza on 1900 West he voluntarily complied with dark sky lighting when asked to do so, and feels that this ordinance is necessary for those who will not comply.
Mr. Morris would like to review this ordinance further and make some modifications before the commission votes on it. Chair Syme would like this to move ahead. Commission consented to allow Mr. Morris to make any changes needed and clarify the ordinance based upon the discussion tonight.
Motion by Chair Syme that we recommend this to the City Council for approval after allowing Mr. Morris to review and make final modifications. If the modifications become major, it will need to be reviewed by the Planning Commission prior to being sent to City Council. Motion seconded by Mr. Tobias. Vote called and passed 4-2, with Mr. Pitcher and Mr. Schofield voting in dissent. Motion passed by the majority.
7. General Plan Update.
Mr. Morris presented a slide show presentation on the General Plan Update, which will occur later this year after a Public Hearing is held.
8. Commission and staff follow-up.
There were no follow-up items.
9. Adjourn.
Chair Syme adjourned the meeting at 8:16 p.m.
