BICKNELL TOWN COUNCIL MEETING
5 APRIL 2018
6:00 P.M.
I. ROLL CALL
Mayor Moosman called the council meeting to order at 6:05 p.m. Council members present were: Brian Brill, Kerry Stevens, Noreen Johnson and Weston Johnson (a few minutes late). Connie Durfey was present to record the minutes. Scott was present to make his report. Also present were: Jeff Albrecht, Adus Dorsey, Shannon Robertson, Ryan Torgerson, Josie & Bronson Oyler, and Michele & Joe Perkins.
II. APPROVAL OF MINUTES
The minutes of 8 March 2018 were reviewed. Kerry made the motion to approve them. Brian seconded, all ayed.
III. BUSINESS
Jeff Albrecht/Savage Albrecht Engineering - Culinary Water Tank. Mr. Albrecht asked the council to consider his company as the engineers for a proposed culinary water tank. Ryan Taylor is their inspector. He and Jeff were both involved in the Water Master Plan in 2011-2012 for Bicknell Town water system and the improvements made then. That project was under Sunrise Engineering. Jeff is very familiar with the town's system because of that prior project. It was noted in that plan that Bicknell was short on storage and source, even though the source production was improved during the 2012 project. In that plan they predicted a 1% increase in water usage, which the town has exceeded. Savage Albrecht Engineering would like to look at the whole system and help the town get funding for a new tank. The council will consider Savage Albrecht Engineering and other engineers when the time comes to define a project.
Short-Term Rental Requests.
A. Adus Dorsey was present to represent Otis Schmidt. Mr. Schmidt has a ST rental on main street. He would like to renovate his garage on said property into an apartment, which he may want to use as a separate ST rental in the future. Mr. Schmidt can make the changes on his property if he has the proper permits, but he will not be guaranteed a license for another ST rental. The council is going to make an ordinance restricting the number of ST rentals in town, probably allowing 10% of the residential meters in town to be ST rentals. There are a total of 154 residential meters in town now, so that would allow 15 ST rentals. Currently there are 9 ST rentals approved. Mr. Dorsey thanked the council and excused himself.
B. Shannon Robertson. Ms. Robertson would like to use her basement as an Owner Occupied ST rental. There would be one or two bedrooms in it. It has a separate entrance with room for parking on her lot. She would have specific rules for guests that would comply with all necessary regulations for the town and state. The council agreed to allow Ms. Robertson to make her basement into a rental but she will have to fill out a Business License Application with federal, state and sales tax numbers for the town before she can begin business.
C. Mayor Moosman informed the council that Nancy Noble has bought Sally Robert's property at 45 E Main St. and plans to build one or two more ST rentals there. There was considerable discussion about this. Building regulations were discussed and the requirements for separate water meters for each structure. The council felt that Ms. Noble must get the council's approval before any plans or building can be implemented.
Torrey Town is having issues with their ST rentals too, and is planning on putting restrictions as to numbers allowed also.
Josie & Bronson Oyler, Ryan Torgerson - Easement. The Oylers want to build a house on lot 4 block 31. The town has a 15' easement on the north and west side of the property made with Charlie Torgerson, the previous owner, for run-off water. The Oylers were wondering if the water could be diverted and run along the right side of the property along 3rd east. Because of the topography of the area some major work would have to be done to make this possible, and the water would have to be channeled into the proper drainage line. There was some discussion about putting in a ketch box on the corner. The council felt like that the area should be surveyed before any changes could be considered. The Oylers and Mr. Torgerson thanked the council and excused themselves.
Michele and Joe Perkins - Water damage on property. Michele's family owns the building at 209 E 100 S, which lies on the west side of highway 24. There is an area of grass on the east side of the property next to the highway which the town maintains. While watering this area in the past, the water has hit the side of the building and has caused damage to the siding, which is made of compressed wood or particle board. They have some more siding to replace the damaged part, but are unable to do the work themselves. Brian offered to put on the new siding for them. This takes care of the present problem, but they don't want more trouble with the water in the future and they are trying to sell the property. After some discussion, it was suggested the grass in that area be removed, the irrigation line capped, a retaining wall put in to the edge of their property, and the area covered with decorative rock. This which would match the new improvements along main street. Kerry made a motion to make said changes, Weston seconded, all ayed. The Perkins thanked the council and excused themselves.
Short-term Rental Ordinance Amendment. Mayor Moosman presented a draft for a new ordinance that would limit the number of ST rentals in town. The council looked over the Amendment, but decided there needed to be some more stipulations and clarifications added. Maylor Moosman noted the changes recommended and will revise the ordinance. It will be considered and passed in a future meeting.
Building Permts. There was a lot of discussion about building permits, the proper procedure for approving them, and so forth. Town citizens have approached some of the council members questioning if there is a 'conflict of interest' issue when Mayor Moosman signs the permits for his father's construction company. The council felt they should see the proposed permits before they are approved by the Mayor, so there won't be any question on this matter. Weston made a motion to have the building permits reviewed by the council before final approval and the Mayor signs them, Noreen seconded. All ayed.
IV. MAYOR'S REPORT
Mayor Moosman reported Jones & Demille Engineering have instructed Harward & Rees to resume construction of the main street project on Monday, now that the frost is out of the ground. They will have 30 days to complete the project. If it is not done in that amount of time, fines will be imposed according to their contract. When H&R have finished their part the town will need to install weed fabric and the decorative rocks. Scott is hoping to get the inmates to help with this.
V. STAFF REPORTS.
Scott's Report. Scott reported the mountain springs are producing 42 gallons a minute. The water tank is down one foot. The water sample for last month was okay. The Brinkerhoff Spring pump has not run this month. The water at the swimming pool was disconnected. Scott has read the meters and they have been billed. Scott cleaned the south side of the road along 3rd north between 2nd and 3rd east. Scott reported some of the decorative rocks for main street have been delivered. Scott reported some of the signs in town have been damaged by someone pushing them over. He has fixed some of them. Scott asked the town council if they were going to hire part-time help for him this summer, as they have done in the past. There was a little discussion, but no decision was made at this time. It will have to be decided in the town council meeting in May.
Noreen. Noreen wanted to know if other streets in town, besides the area on 3rd north are going to be cleaned. She was assured the rest of the streets will be looked over and cleaned where needed.
Connie. The council was asked if they had gone over their copy of Loa Town's Right-of-Way Ordinance and what changes they wanted to be made, if any. There was a little discussion about it, but for the more part they were okay with it. A rough draft will be made for their inspection and consideration in a future meeting.
Shannon Robertson and Jeff Albrecht thanked the council and excused themselves.
