PUBLIC HEARING - Residential Parking Permit Area 16. RESOLUTION - Creating a Residential Parking Permit Area on Cherry Drive from 650 South to 800 South PRESENTER: Assistant Chief Ned Jackson 4 RECOMMENDATION: The Chief of Police recommends that the City Council, by resolution create a residential parking permit area on Cherry Drive between 650 South and 800 South. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: The City of Orem is responsible for protecting the health, safety, and general welfare of the City. With the ongoing enrollment of students and the expansion of Utah Valley University, there has been an increase in the number of nonresidents who are using Cherry Hill between 650 and 800 South during the university's business hours. A majority of the homeowners who own dwellings along Cherry Hill between 650 South and 800 South filed a petition with the Orem Police Department asking the City Council to consider creating a residential parking permit area to address the parking issue along Cherry Drive. The Orem Police Department has conducted a traffic study in the area and finds that nonresidents inundate the area during the university's business hours and recommends that the City Council pass a resolution creating a residential parking permit area along Cherry Hill on both the east and west sides of the street between 650 South and 800 South. The parking restrictions will be in place from 7:00 a.m. to 5:00 p.m. Monday through Friday excluding federal and Utah state holidays. These are the same restrictions that are already in place along the west side of Cherry Drive between 650 and 700 South. If the City Council creates the residential parking permit area as proposed, any homeowner within the residential parking permit area will be permitted to park any cars registered to his/her dwelling in the residential parking permit area, and each dwelling within the residential parking permit area will be given two (2) visitor/guest permits. The homeowner who owns the dwelling located at 719 South Cherry Drive, Orem, Utah has specifically requested that his dwelling be excluded from the residential parking permit area. The Orem Police Department has indicated that it is be able to post adequate signage to demonstrate this exception. 6:00 P.M. PUBLIC HEARING - SLU Code 5511 in the CM zone 17. ORDINANCE - Amending a portion of Appendix A of the Orem City Code pertaining to Standard Land Use (SLU) Code 5511 (Motor Vehicle (New & Used) Sales) in the CM Zone PRESENTER: Jason Bench REQUEST: The applicant requests the City amend a portion of Appendix A of the Orem City Code pertaining to Standard Land Use (SLU) Code 5511 (Motor Vehicle (New & Used) Sales) in the CM Zone. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: The CM zone is established to provide areas where planned manufacturing parks may be developed. The zone is designed to provide for such uses on 5 well-landscaped sites such that they can be located in proximity to residential uses. Currently SLU Code 5111 'Automobiles, motor vehicles, & other automotive equipment' and SLU Code 5183 'Transportation equipment, other machinery equipment, & supplies' (Wholesale Uses) are both permitted in the CM zone, however, SLU Code 5511 'Motor Vehicle (New & Used)' (Retail Sales) is not. The applicant requests the City amend Appendix A to make SLU Code 5511 a permitted use in the CM zone. Staff supports the change to Appendix A because the use will not create high traffic, dangerous conditions, or a nuisance to surrounding businesses and homes. However, due to concern about outdoor display and storage, staff has added a note that outside display is not permitted outside normal business hours. The applicant has agreed to this language. RECOMMENDATION: The Planning Commission recommends the City Council, by ordinance, amend a portion of Appendix A of the Orem City Code to make Standard Land Use (SLU) Code 5511 (Motor Vehicle (New & Used) Sales) a permitted use in the CM Zone. Staff supports the recommendation of the Planning Commission. 6:00 P.M. PUBLIC HEARING - Amendments to PD-19 and Appendix M 18. ORDINANCE - Amending Section 22-11-31(B)(2)(c) of the Orem City Code pertaining to basements in the PD-19 zone and amending Appendix M pertaining to the layout of buildings in the PD-19 zone PRESENTER: Jason Bench REQUEST: The applicant requests the City Council amend Section 22-11-31(B)(2)(c) pertaining to basements in the PD-19 zone and Appendix M pertaining to the layout of buildings in the PD-19 zone. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: The South Rim PRD (PD-19) was originally approved in 2002 to allow up to 9 units per acre in a townhouse style development. Phase II was added to the South Rim project and approved by the City Council in August 2015. The PD-19 ordinance currently provides that basements are only allowed in areas accessible to sewer by gravity. The developer of Phase II would like to include basements in the townhouse units in Phase II, but the area in Phase II is not accessible to sewer by gravity. Thus, under the current ordinance, basements would not be allowed in Phase II. The developer has requested an amendment to the PD-19 zone that would allow basements in Phase II, but would prohibit plumbing fixtures in these basements. The applicant also requests an amendment to Appendix M to modify the layout of the units in Phase II from two three-plex buildings to one six-plex. Revised elevations for Phase II are also proposed. 6 The proposed amendment is outlined below: RECOMMENDATION: The Planning Commission recommends the City Council, by ordinance, amend Section 22-11-31(B)(2)(c) pertaining to basements in the PD-19 zone and amend Appendix M of the Orem City Code pertaining to building layout in Phase II of the PD-19 zone. 19. RESOLUTION - Support the funding and implementation of Advanced Metering Infrastructure (AMI) throughout the City as outlined in the Public Works Department's Water SMART Grant Application PRESENTER: Chris Tschirki RECOMMENDATION: The Public Works Director recommends that the Orem City Council express support of the funding and implementation of advanced metering infrastructure (AMI) throughout the City as outlined in the Public Works Department's WaterSMART grant application. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: The Water Master Plan was adopted by the City Council in 2016. A significant part of the master plan included the deployment of AMI technology throughout the City over a five-year period. The funding for this project will begin in the Fiscal Year 2019 Budget. Since the project is anticipated to cost approximately $6.5 million, the City is pursuing other funding options that would offset these expenses. 22-11-31(B)(2)(c). PD-19 Zone, South Rim PRD, 1755 South 750 East. B. Development Standards. 1. PRD Ordinance. The development standards and requirements set forth in Article 22-7 of the Orem City Code shall apply to the PD-19 zone except as expressly modified below. 2. a. Preliminary Development Plan. Development in the PD-19 zone shall substantially conform to the Preliminary Development Plan included as Appendix M of the Orem City Code. b. Setbacks. Setbacks in the PD-19 zone shall be as shown in the Preliminary Development Plan included as Appendix M of the Orem City Code. c. Heights. The maximum height for all primary structures shall be thirty feet (30') with no restriction as to second story square footage or basement square footage. However, basements are only allowed in areas accessible to sewer by gravity. Basement areas not accessible to sewer by gravity will be constructed as 'dry basements' without plumbing fixtures. d. Accessory Apartments. Accessory apartments are not permitted within the PD-19 Zone. e. Access. If development within the PD-19 zone includes more than sixteen (16) units, at least two (2) vehicular accesses shall be provided, with one of those accesses coming off of 1700 South Street. f. Type of Units Allowed. Only townhouses or single-family detached dwellings are permitted in the PD-19 zone. g. Exterior Finishing Materials. In addition to the materials permitted under Section 22-7- 12(Q), cementatious fiber board siding may be used as a finishing material. 7 One way to offset these costs is to obtain a grant. Under the direction of the U.S. Department of Interior, the Bureau of Reclamation (BoR) manages the federal WaterSMART grant program. The City has been working with its federal lobbyist to apply for a grant that would fund a portion of this project. In accordance with this application, the City Council is required to express support of the WaterSMART grant application and, if awarded funds, work with the BoR to meet the established deadlines for entering into a grant or cooperative agreement. Additionally, the City Council is committing to contribute the funding specified in the funding plan of the WaterSMART application. COMMUNICATION ITEMS 20. Monthly Financial Summary - March 2018 CITY MANAGER INFORMATION ITEMS 21. This is an opportunity for the City Manager to provide information to the City Council. These items are for information and do not require action by the City Council. ADJOURNMENT
