BICKNELL TOWN COUNCIL MEETING 8 March 2018 6:00 P.M. I. ROLL CALL Mayor Moosman called the council meeting to order at 6:00 p.m. Council members present were: Noreen Johnson, Brian Brill, Kerry Stevens and Weston Johnson. Connie Durfey was present to record the minutes. Scott was present to make his report. Also present were: Laura Henderson and Michael Blackburn. Present from Jones & Demille Engineering were Lyndon Briant, Darin Robinson and Kendrick Thomas. II. APPROVAL OF MINUTES The minutes of 1 February 2018 were reviewed. Noreen made the motion to approve them. Brian seconded, all ayed. III. MAYOR'S REPORT Mayor Moosman has a building permit from Steve Albrecht for a set of garages to be built on his property. On the plan the building was set in 5' from the north property line and 5' from the west property line. This would be on the corner of 3rd N and 2nd E. Because of lack of visibility at that intersection the council will require Mr. Albrecht to move the building 20' to the east. Mayor Moosman said letters have not been sent to Kirk Jackson or Paul Pace denying them water connections as non-residents yet. He will take with an attorney for proper legal terms. The denial for water connections is temporary, until a new tank can be built and/or new sources developed. Mayor Moosman said a letter was sent to the Wayne County Commissioners last month about the waste of water at the swimming pool, stating non-compliance with the town culinary water ordinance. They were told the water would be disconnected and they had until this meeting to voice their objections. The county Clerk, Ryan Torgerson, told Scott the Commissioners were going to just have the water disconnected. Scott was told to disconnect the water. IV. BUSINESS Jones & Demille Engineering - Culinary Water. Jones & Demille Engineering have been the engineers for the main street project and have been working with contractors Harward & Rees. The walls have been erected, but the work on the side walks is on hold until the temperatures get warmer. When they have finished their work the town will have to buy and install the decorative rock. While working on the main street project Mayor Moosman mentioned to Lyndon Friant that the town is wanting to pursue installing another water tank. Mr. Friant brought Darin Robinson and Kendrick Thomas to discuss the matter with the council. Mr. Robinson said the funding would need to be approached through the Division of Water 1st, CIB 2nd, and Rural Development 3rd. Forth the Division of Water and CIB follow the same criteria for funding. The Rural Development is more involved because it is funded under the federal government. RD would need an environmental Document, Preliminary Engineer Report, and Funding Application. There is a cost to preparing these reports, but a grant is possible for this cost if the applicant qualifies. Mr. Robinson said they would need an average usage of culinary water per connection to begin with and goals set for the project. The council said they would think about what they had been told and make a decision later. Mr. Friant, Mr. Robinson, and Mr. Thomas thanked the council and told them to get in touch with them after they have made their decision. They excused themselves. The council may want to go with a different engineering company that has worked for the town and already knows the town's system. Michael Blackburn. Mr. Blackburn would like to turn his basement house on 2nd N and Center Street into a short-term rental. As of right now the council has an ordinance stating that all short-term rentals must be located on main street, unless the council gives special permission to allow one elsewhere in town. The town wants to control and limit the number of short-term rentals in town to protect the quality of life of the residents and value of property in the town. The currant ordinance does not state how many rentals would be allowed in town. The council talked about setting a percentage of the rentals allowed compared to the number of one family dwellings in town. The percentage would have to be determined after the number of one family dwellings was counted. There are eight short-term rentals in town now. Laura Henderson suggested property owners located next to proposed new rentals be contacted to see how they feel about one in their neighborhood. After more discussion, Noreen made a motion to give Mr. Blackburn permission to use his basement dwelling as a short-term rental on a probationary basis for one year. Weston seconded, all ayed. Mr. Blackburn thanked the council and excused himself. V. STAFF REPORTS. Scott's Report. Scott reported the mountain springs are producing 44 gallons a minute. The tank is down a little. The Brinkerhoff Spring's production is down, it use to produce 250 gallons and minute, but right now it is only producing about 150 gallons a minute. Scott fixed two culinary water line leaks in town, one was by Scott Anderson's building and the other was by Jan Ellett's corral. Scott dug a grave for Phyllis Larsen Heaton today, she will be buried Saturday. Last week Scott spent three days in St. George to a water conference with RWA to recertify as water operator for Bicknell. Dustin Snedeger had to make a trench across the street next to the house he is building. He will be responsible to fix it and re-oil it. For now he is just trying to keep it filled with dirt. Connie. Connie has a copy of Loa Town's Right-of-Way Ordinance. She will send a copy to each council member along with the minutes of this meeting. She requested each member go over it and make any comments or changes on it. Then the information could be compiled and made into any ordinance for Bicknell. Financial. The following bills were presented for payment approval. Kerry made the motion to pay them, Weston seconded. All ayed.
