Description/Agenda
Public Notice of Noncompliance with Industrial Pretreatment Standards The Federal Clean Water Act established the National Pretreatment Program to control the discharge of toxic and hazardous waste into the sanitary sewer system operated by the Publicly Owned Treatment Works (POTWs). Under a delegation from EPA, Brigham City has been given the responsibility for applying and enforcing the pretreatment standards for industrial users served by the city. Pursuant to the requirements of the National Pretreatment Program, Brigham City must annually publish a list of industrial users within its service area that have either demonstrated a pattern for noncompliance with applicable pretreatment standards or had a significant noncompliance incident over the previous 12 months. Reasons for significant noncompliance include: 1. Chronic Violations: Chronic violations of wastewater discharge limits, defined here as those in which sixty-six percent (66%) or more of wastewater measurements taken during a 6-month period exceed the daily maximum limit or average limit for the same pollutant parameter by any amount; 2. TRC Violations: Technical Review Criteria (TRC) violations, defined here as those in which thirty-three percent (33%) or more of wastewater measurements taken for each pollutant parameter during a 6-month period equals or exceeds the product of the daily maximum limit or the average limit multiplied by the applicable criteria [1.4 for BOD, TSS, fats, oils and grease, and 1.2 for all other pollutants except pH] 3. Discharge Violations: Any other discharge violation that the city believes has caused, alone or in combination with other discharges, interference or pass through (including endangering the health of POTW personnel or the general public); 4. Endangerment: Any discharge of pollutants that has caused imminent endangerment to the public or to the environment, or has resulted in the city's exercise of its emergency authority to halt or prevent such a discharge; 5. Failure to Comply: Failure to meet, within 90 days of the scheduled date, a compliance schedule milestone contained in a wastewater discharge permit or enforcement order for starting construction, completing construction, or attaining final compliance; 6. Failure to Report: Failure to provide within 30 days after the due date, any required reports, including baseline monitoring reports, 90 day compliance reports, periodic self-monitoring reports, and reports on compliance with compliance schedules; 7. Failure to accurately report noncompliance; 8. Other Violations: Any other violation(s) which may include a violation of Best Management Practices, which the city determines will adversely affect the operation or implementation of the local pretreatment program. This notice has been issued to meet the requirement to inform the public. The period covered by this notice is January 1, 2017 to December 31, 2017. During this period the following industries were found to be in significant non-compliance with applicable standards: STORM Products Discharge Violations: Chronic violation of permit standards including biochemical oxygen demand and total suspended solids. Duration of SNC: 1st through 4rd quarter or 2017 Specific questions on any of the listed violator(s) may be directed to: Richard Mickelsen, Brigham City Wastewater Treatment Manager, P.O. Box 1005, Brigham City, UT 84302, 435-723-3146
