RESOLUTION - Appointment of temporary judges to serve on the Orem Justice Court BACKGROUND: Utah Code Section 78A-7-208 allows the City Council to appoint temporary judges to serve on the Orem Justice Court. The temporary judges may serve when the Orem Justice Court Judge is absent or has a conflict of interest. A temporary justice court judge can be any senior justice court judge, or a justice court judge currently holding office within the judicial district or in an adjacent county. SCHEDULED ITEMS CONTINUED ITEM - SLU Codes in M1 and M2 zones 16. ORDINANCE - Amending Appendix 'A' of the Orem City Code by changing Standard Land Use Codes 4850 (solid waste disposal) and 5193 (scrap and waste materials) from 'Permitted' to 'Not-Permitted' uses in the M1 and M2 zones PRESENTER: Jason Bench REQUEST: The Development Services Department requests the City Council amend Appendix 'A' of the Orem City Code by changing Standard Land Use Codes 4850 (solid waste disposal) and 5193 (scrap and waste materials) from 'Permitted' to 'Not-Permitted' uses in M1 and M2 zones. This request was again continued from the February 13, 2018 City Council meeting to give the Council additional time to study and consider the item. POTENTIALLY AFFECTED AREA: M1 and M2 zones BACKGROUND: Currently, solid-waste disposal (SLU 4850) is permitted in the M1 and M2 zones and scrap and waste materials (SLU 5193) is permitted in the M2 zone. Both these uses by their nature carry with them negative externalities associated with the disposal and transfer of waste. Such externalities include offensive sights and smells, noise, pollution, dust, attraction of fowls and rodents, and traffic generation of heavy vehicles. Such negative externalities have previously not posed as significant of an impact on Orem due to lack of nearby development, a lower intensity of use, or more effective efforts by facility owners to suppress negative impacts. In recent years, the City of Orem and neighboring Vineyard City have both experienced a large amount of commercial, industrial, and residential redevelopment around Geneva Road (adjacent to the industrial areas that permit waste-related uses). Furthermore, the City of Orem is in the process of conducting a Geneva Road Area Master Plan and Brownfield Study, which will identify areas around the current M1, M2, and CM zones that show potential for redevelopment. Due to the changing nature of development in this area, and due to the nuisance that existing solid-waste uses have presented for neighboring properties, Staff believes it is not in the best interest of the City and the general public to allow such uses to remain permitted in the M1 and M2 zones. Waste disposal and recycling are services that are needed in the area. However, such facilities are best located on land where there is a separation from residential, commercial and other industrial uses sufficient to protect such uses from the noise, dust, smell and other negative impacts that waste disposal and recycling uses are likely to create. With the changing nature of development in the City's M1 and M2 zones as well as the properties adjacent to those zones, and the ongoing development of land that has heretofore been vacant and might have previously supplied an adequate buffer for waste disposal and recycling uses, it is no longer reasonable or in the best interest of the City to allow waste disposal and recycling uses in the M1 and M2 zones. Staff therefore recommends that the City Council amend Appendix 'A' of the Orem City Code by changing Standard Land Use Codes 4850 (solid waste disposal) and 5193 (scrap and waste materials) from 'Permitted' to 'Not-permitted'. RECOMMENDATION: The Planning Commission recommends the City Council, by ordinance, amend Appendix 'A' of the Orem City Code by changing SLU Codes 4850 (solid waste disposal) and 5193 (scrap and waste materials) from 'Permitted' to 'Not-Permitted' uses in the M1 and M2 zones. Staff supports the Planning Commission recommendation. 6:00 P.M. PUBLIC HEARING - 2017 Water Conservation Plan 17. RESOLUTION - Adopting the 2017 Water Conservation Plan as required by Utah State Code 73-10-32 PRESENTER: Chris Tschirki and Neal Winterton RECOMMENDATION: The Director of the Department of Public Works recommends the City Council, by resolution, adopt the 2017 Water Conservation Plan. POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: All water conservancy districts and retail water providers are required to update their water conservation plans at least every five years. The 2017 Water Conservation Plan was prepared by staff. Components of the plan include: 1. Description of Orem City and its water system 2. Water challenges and conservation goals 3. Current conservation practices 4. Current water rates 5. Additional conservation measures The main measureable objective is to decrease the overall Gallons Per Capita Per Day (GPCPD) usage. Orem has experienced a steady decrease over time in GPCPD usage. As expected, outdoor watering practices and weather conditions have a large impact on water usage. Through education and citizen participation, the City of Orem can improve water conservation throughout the City. 6:00 P.M. PUBLIC HEARING - Storm Water Master Plan Update 18. RESOLUTION - Adopting the 2018 Storm Water Master Plan (a revision of the 2016 Storm Water Master Plan) PRESENTER: Chris Tschirki RECOMMENDATION: The Director of the Public Works Department recommends the City Council, by resolution, adopt the 2018 Storm Water Master Plan prepared by Bowen, Collins & Associates, Inc. (BCA). POTENTIALLY AFFECTED AREA: Citywide BACKGROUND: The 2016 Storm Water Master Plan was adopted on January 26, 2016 by the City Council. A significant storm water conveyance system known as the West Union Canal Company (WUCC) was identified as an important part of this master plan. In 2017, the canal company notified its shareholders and other interested parties, including the City of Orem, that it was taking the necessary steps to abandon operations of the canal. Since this facility has historically served as a major conveyance system for storm water, City staff quickly determined that this issue needed to be addressed by updating the master plan and pending Impact Facilities Fee Plan (IFFP) immediately. The IFFP was critical in producing the recommended Impact Fee Analysis (IFA) and subsequent Storm Water Impact Fee. In 2017, the WUCC completed a study to evaluate the structural integrity of the canal and potential liabilities. The results of the study showed there was considerable risk of a canal failure, especially where the canal was located on the side of a hill above developed properties. The liability associated with the deteriorating condition of its canal ultimately forced the WUCC to end its historic operations in the canal. The WUCC approached the City to take over the operations and maintenance of the canal, but City staff agreed with the findings of the study and determined it is unwilling to accept the liability that would come with continued use of the canal. The cost to resolve this concern was too great. Yet, the City's responsibility to manage storm water in the area remained. Thus, the recently adopted plan to manage the City's storm water in that area needed to be revised to plan for abandonment of the canal wherever practical. Because the City was starting a process to create impact fees, it was determined it would be best to immediately revise the plan to reflect this major change. The revised plan would identify new projects needed to handle the storm water flows in the most concerning areas and reprioritize the projects identified in the 2016 master plan. Staff worked with BCA, which was the same engineering firm contracted to create the 2016 master plan, to update the plan to accommodate abandonment of the West Union Canal. The primary changes to the plan address the storm water flows associated with the canal abandonment as listed below: - Adding a pipe system to collect storm water in the south-east corner of Orem between State Street, University Parkway and the Provo City boundaries; - Installation of a large pipe to convey storm water south down State Street to the Provo River; - Expanding an existing detention basin at 424 East 2000 South that collects storm water west of State Street and east of 350 East; - Constructing a storm water lift station to pump storm water to a point west of 350 East to gravity flow to other storm water facilities. The estimated costs for the City to abandon the canal are: Collecting storm water in SE Orem $1,014,000 State Street pipe $1,646,000 Improvements to detention basin $1,764,000 TOTAL $4,424,000 No recommendation is being made to change the rate schedule that was approved when the plan was adopted in 2016. Rather, the reprioritized projects will be delayed by approximately three years to address this pressing issue. COMMUNICATION ITEMS 19. There are no Communication Items.
