Opening: Presiding: Mayor Ron Allred Present from the Town Council: (from Old Town Council: Dallin Mangels, Lane Allred and Jeremy Allred); new Council Ron Allred, Jeremy Allred, Dallin Mangels, Lucy Gold, and Forrest Lewis. Present from the Town Staff: Cathy Lummus, Bethany Sturgeon, Jessica Mangels, Terry Allred and Casey Reynolds Others Present: Various town members, including LaRee Allred, Shauna Lewis, Rosie Lewis, Kathy Allred, LauraBec Allred, Ondi Allred, Marleen Allred, Daniel Aagard, and others Meeting was called to order at 7:30 PM. Invocation was given. Approval of Minutes Minutes from the December 20, 2017 meeting were read by Bethany Sturgeon. Oaths of Office: Town Clerk Catherine Lummus swore into office the new Mayor, Ronald Allred; Councilmembers Forrest Lewis and Lucy Gold. She also swore in members of Town Office: Jessica Mangels, Treasurer, and Bethany Sturgeon, Deputy Town Clerk. Bethany Sturgeon as Deputy Town Clerk then swore in Catherine Lummus, Town Clerk. Old Business 1. Mayor Ron Allred asked if there was any old business to discuss: There was discussion about a new place to hold our Town meetings. The Fire Station is not an option because it is not ADA Compliant. The suggestion of Quality Craft's 'Break Room' being an option was vetoed by Casey Reynolds because they do not want to hand out keys to anyone other than those who already have them. It was pointed out that the break room is not ADA compliant either so it is out of the question for now. Forrest Lewis moved that we table the issue until the break room becomes ADA compliant and then we can discuss it again; Jeremy Allred seconded the motion. All voted in favor. 2. The issue of having our own procedural rules for the Town was discussed. Town Clerk Cathy Lummus suggested that for Rules of Order we could use the ones in the Powers & Duties Handbook. The Council should go over them and suggest opinions on what we will and will not use at our next meeting. New Business 1. Mayor Allred mentioned that there is an issue about the new Planning & Zoning Board and asked when that should be brought up. Deputy Town Clerk Bethany Sturgeon asked if the Mayor would like her to put this on the next month's meeting agenda. Mayor Allred said felt it was something that needed to be discussed tonight because you have at least two members who are now on the Planning & Zoning Committee who are also Town Councilmembers and that is not legal. Town Councilmember Dallin Mangels asked if that is in the state law that it is not allowed. Mayor Allred indicated that at the Newly Elected Officials training, attorney David Church was asked and we were told that Town Councilmembers should not be on the Planning and Zoning Committee. There was a lengthy and lively discussion held about this issue. Councilmember Dallin Mangels indicated that they had questioned David Church about similar issues before because it is very difficult to get people to volunteer to be on the committee. He has also discussed other things where David Church has said that's not ideal, but if you are in a position where you need to do that or that's all you can get then it ca be done. Deputy Town Clerk Bethany Sturgeon again tried to explain the issue to Councilmember Dallin Mangels without success. Councilmember Dallin Mangels indicated that he would call David Church himself if he had to. Councilmember Lucy Gold then indicated that it violates the code of conflict of interest for parties to be on both committees - that's where it would violate what we are trying to do. Town Clerk Cathy Lummus said because citizens disagreeing with decisions from the Planning & Zoning Committee would make an appeal to the Town Council and two people being on both councils would not make for a very just way to have something appealed. Councilmember Lucy Gold said that is why it goes into a conflict of interest - that's what is illegal. Mayor Allred agreed and also indicated he thought he had even read where it does say it is not to be allowed - and that was the reason it gave was that the committee that would be the appellate committee was making the decisions to start with. Councilmember Dallin Mangels said that with two members it is still a minority of both committees, then indicated to Mayor Allred that 'you have a comment in the back.' Casey Reynolds was given the floor and indicated that when the Town was first started and he and Jeff had been appointed to the Planning & Zoning Committee that was the very issue addressed back then with the attorneys and that was their comment 'you should not do it' and with the attorneys understanding that we had so few people to volunteer for positions said that was one of those that should not be done because of that appeal process. You cannot appeal to yourself. Mayor Allred agreed and then indicated that that leaves us in a quandary because we need official resignations and to try to find two new members for the Planning & Zoning Board. He asked 'isn't the Planning & Zoning Board an appointed position?' Discussion was had about this. Mayor Allred said he was thinking of two people right now that would sit on there if we brought their names up tonight. Councilmember Dallin Mangels indicated that so far we would only have one remaining active person and that is Terry Allred. Discussion was had about members of the Planning & Zoning Board. Councilmember Dallin Mangels indicated Terry Allred is still on the committee as is Shawn Allred and Curtis Allred. Discussion was had about how Shawn Allred and Curtis Allred didn't really want to be on the committee - they have not been super active. Mayor Allred asked if he could suggest two new names? I'm thinking of Marvin Allred and Lane Allred. Town Clerk Cathy Lummus said we could discuss the issue but could not appoint them tonight. Mayor Allred indicated he would still like to discuss it some more. Councilmember Dallin Mangels discussed reasons why he is still resistant to this idea. Councilmember Lucy Gold told Councilmember Dallin Mangels that when we were talking to David Church we tried to find a way to keep you there . . . Mayor Allred said yes, we were hoping to do that but he said nope, it absolutely won't work. Mayor Allred addressed the audience and asked if Marvin Allred and Lane Allred were asked in this meeting to be members would they be willing to take it? More discussion about who else might be willing to serve was had. Lane Allred indicated he would be willing to serve. Marvin Allred and Daniel Aagard said they would consider it. 2. Mayor Allred asked about progress on the new well. Casey Reynolds and Terry Allred shared much information about it. Discussion was had last meeting about us waiting for them to get the casings and screens in. They were able to do that and they started testing and developing; they got all the developing done. Then they started pumping - we were hoping they could pump 600 gallons and when they got going we realized it could produce more so we asked them to do so. Today they started out at 1,400 gallons and are now getting 2,100 gallons per minutes. Casey indicated that they settled in at 2,000 gallons a minute for 24 hours. It has to hold steady for 6 hours at one level for the state's approval. Once it is steady for 6 hours the state will approve us to use 2/3rd of that water. They will finish pumping tomorrow (1/18/18) around 4:30 p.m. Some discussion about this matter. Casey indicated to the Council that he had already spent some money (didn't know how much yet, but approximately $5,000). Water system capacity as built right now the water coming in to that system is approximately 700 gallons per minute (that is the maximum we can put into our system as it is designed). The new well design structure they have can handle up to 1,700 gallons so it will double the amount we can pump. Looking down the road, do we want it to pump more? If so, then we will have to make improvements in the pumphouse - from 12' transmission lines to 14' or 16'. More discussion about the pumphouse needing updating. Casey and Terry are going to be talking to the engineers tomorrow (January 18th) and will obtain more information at that time. 3. Mayor Allred indicated that Sheriff Doug Anderson was in attendance at the meeting and asked him if he had something he would like to say. Sheriff Anderson stated that he simply came to welcome and congratulate Ronald Allred as the new Mayor and the new Councilmembers; he offered his continued service; said that he would like the Town to know we have his full support and if he can be of service to us in any way please reach out to him; and he is also open to suggestions about how he might help us in the future. 4. Casey Reynolds then gave a report of a water appropriation study he had prepared for the past 7 years as we have not had a rate increase since 2010. Town Clerk Cathy Lummus asked if maintenance costs were included in the graph; Casey indicated they were. Cathy also asked about depreciation costs being included and Casey said they were not. Cathy indicated that that needs to be taken into account. Casey said the water department is supposed to run in the black, but we have not done so for the last 7 years. Casey indicated that our new well contract specifies that we have to run in the black. Discussion was had on how we might bring in more revenue for the water department: such as asking for a rate increase, charging more for meter hookups, charging impact fees, etc. Casey indicated many people have complained because people in nearby towns do not charge as much for water rates as we do - but the big difference is that Rocky Ridge has to pump 100% of our water and other towns do not. People are comparing apples to oranges. Casey and Terry are working on a recommendation for the Council. 5. Casey Reynolds also discussed Zimmerman's work on the test well. Part of that contract was that there would be a 30 foot grout seal and we paid the contract when they were done. Casey didn't realize this hadn't been completed, but we paid $2,200 for a grout seal that they never did. We are paying this other drill rig to abandon the well (by the way which right now is going to cost us $56,000 to abandon the well because of the things that happened prior). The grout seal would have saved us a lot of money and that is part of what is costing us because they did not do what they were supposed to. There really isn't a whole lot we can do except maybe go after them for the $2,200 charge. There was mention of some issues in the last meeting minutes about penalties, etc., and some discussion was had about that. Mayor Allred asked Jeremy Allred if they would talk to Zimmermans about the $2,200 charge being refunded. Terry Allred indicated that we have documentation from the new people that the grouting was not done. 6. Mayor Allred then asked about each of the different departments and was told most Department Chairmen do not come to the meetings unless we are handing out money or they need something. There was then discussion about which Councilmembers would be over each of the different departments now that we have a new Council. Some discussion was had on where each department is and who each new Councilmembers will be over which department. Water Department: Jeremy Allred; EMS & Public Safety: Lucy Gold; Roads: Dallin Mangels; Park and Recreation: Ron Allred; Planning and Zoning: Forrest Lewis. These Councilmembers are simply liasons between the Department Chairs and the Town Council. Mayor Allred requested that Town Clerk Cathy Lummus get together with him to discuss who each of the Department Chairs are. Discussion was had about Kent Allred wanting to continue to be on the Fire District Board. It was decided that Kent Allred would be the best choice for the position and Mayor Allred asked Town Clerk Cathy Lummus to give Kent notice of the Council's decision. 7. Mayor Allred then opened the meeting up to become a Public Hearing for comments concerning the approval of and adoption of the Rocky Ridge Town Municipal Code. Town Clerk Cathy Lummus indicated that the Council had been working on this over the past few years. She indicated that she had requested by text that the Councilmembers review this before the December meeting for adoption purposes. Discussion was had about this being tabled again until next meeting. Deputy Town Clerk Bethany Sturgeon indicated that there is a large amount of work to arrange a 'Public Hearing' which Town Clerk Cathy Lummus has now spent many hours on for the last two monthly meetings. Town Clerk Cathy Lummus indicated that we could make changes to the codes even at this meeting and still adopt them; and that there really is a need to have ongoing changes made to them on a monthly or regular basis as well. There was again lengthy and lively discussion about this issue. Councilmember Dallin Mangels still felt there were things that needed to be addressed (such as Section 13.06 and all of its subchapters being deleted from the ordinances). Deputy Town Clerk Bethany Sturgeon reminded Councilmember Dallin Mangels that this issue had been tabled at the last meeting because Dallin wanted to go over all of the ordinances and compare them to his monthly meeting notes which he had at home over the next month and Mayor Kent Allred had allowed him to do that and the subject to be tabled for the January meeting. Mayor Kent Allred said Town Clerk Cathy Lummus would know better than himself if we would have to have another Public Hearing. Councilmember Dallin Mangels indicated he had had a few minutes skimming it, but had not had an opportunity to sit down and compare it to the notes that he had. Councilmember Forrest Lewis had many questions and concerns about Section 11. After much discussion and going over various items Forrest had about Section 11, and several people talking at the same time, Mayor Allred suggested we Adopt the Municipal Code as it is, but that Section 13.06 and all of its subparagraphs are to be deleted from it and that we table Section 11. The Planning & Zoning Section was never intended to be included in this portion of the adoption process. Mayor Allred moved that we Adopt the Municipal Code with Section 13.06 and all subparagraphs being deleted and all of Section 11 being tabled and reviewed later; Dallin Mangels seconded the motion. All voted in favor. Mayor Allred asked for any public comment - small discussion was had. Mayor Allred asked if Deputy Town Clerk Bethany Sturgeon needed a roll call on that - with an affirmative answer. Roll Call: Lucy Gold, Yes; Jeremy Allred, Yes; Dallin Mangels, Yes; and Forrest Lewis, Yes. Mayor Allred said okay that carried. Deputy Town Clerk asked what about the Mayor's vote; Mayor Allred voted Yes. 8. Mayor Allred then began discussion about the appropriation of the money donated to The Town by Quality Craft. Casey Reynolds indicated that Quality Craft had given the money to the Town and had suggested that it might go to help with the new well. There was discussion about us still needing more money for the chip sealing of the roads. It was determined that we had sufficient resources for the new well and that the money would be better applied to the road department for surface treatment. Councilmember Dallin Mangels moved to approve that allocation and Councilmember Jeremy Allred seconded. All voted in favor. 9. Town Clerk Cathy Lummus said we will need to amend our budget because of this donation. Casey Reynolds said it is a donation and it has been agreed upon where it is to be allocated. Cathy further indicated that we don't have to amend the budget for revenues, but we will have to amend it for expenditures. We can amend the budget when we need to - Terry will not need the money for the roads until springtime. 10. Discussion was had about removing truss requirements from our policy. After much discussion it was decided to leave the truss policy as it is now. 11. Mayor Allred then began discussion about our list of projects we need to submit to Six County. Discussion was had about what we have done in the past and what we need to submit to them when they come to talk with us on January 25th. Town Clerk Cathy Lummus is trying to get that date rescheduled because it is the one day Mayor Allred cannot make the meeting. There was discussion about what we had listed in the past (which Six County would have a copy of) and that we should just go ahead and keep those items on the list and prioritize them to fit what Six County is appropriating money for this year. Our needs as remembered were: a town building; an equipment shed, and 300 South. Many people talking at once; Deputy Clerk mentioned she was having a difficult time taking minutes. Casey says what CIB has typically loaned for are public safety things, fire engines, ambulances, things like that; a lot of water projects, he didn't know about roads, they've done a lot for county building structures for small towns. Terry Allred commented on CIB grants and loans look at the mineral enriched areas, those natural resources making impacts upon the public and the municipalities. More discussion had about what the CIB board wants to assist with. It was decided to make our list and match it to their priority list for the year. 12. Mayor Allred indicated that he had had some citizens approach him about a 'noticing sign' to be put up next to the 'Rocky Ridge Town' sign that people could see when coming into Town that would remind them of public events. Discussion was had over liabilities for the Town and Councilmember Lucy Gold indicated that there would be a large possibility of the sign quickly becoming neglected. Councilmember Dallin Mangels suggested that he would not oppose a private entity taking on the responsibility to put up a sign. Mayor Allred indicated he would go back to the people who had asked about it and follow-up to see if they would be interested in doing this as a private entity. It was suggested that they be extremely committed to doing it and not letting it become neglected. Adjournment: Councilmember Dallin Mangels moved to adjourn the meeting.
