CONSENT ITEMS
14. MOTION - Reschedule the March 20, 2018 City Council meeting to March 27, 2018
RECOMMENDATION: To accommodate the State Caucus Night on March 20, 2018, it is recommended that the City Council reschedule the meeting of March 20, 2018 to March 27, 2018.
15. MOTION - Authorizing the Mayor to execute an agreement outlining the City's participation in the BLU Fund
RECOMMENDATION: Ryan Clark, Orem Economic Development Division Manager, recommends the City Council of the City of Orem consider, by motion, authorizing the Mayor to execute a Credit Agreement outlining the City's participation in the BLU loan program with the Utah Small Business Growth Initiative, LLC acting as the Class A Lender.
POTENTIALLY AFFECTED AREA: Citywide
BACKGROUND: At the October 6, 2017 City Council Meeting, the City Council passed Resolution R-2017-0018 authorizing participation in the Small Business Loan Program administered by the Small Business Loans of Utah (BLU) and found that the appropriation of money to the BLU Fund met the requirements of Utah Code ยง 10-8-2. The City Council postponed the approval of the Credit Agreement until the agreement was finalized. On November 14, 2017, the City Council unanimously passed a motion authorizing the Mayor to sign the Credit Agreement as amended. Since that time, the participating entities have proposed, reviewed and agreed to additional amendments. The most significant amendment agreed to is the substitution of Utah Small Business Growth Initiative, LLC (USBGI) as the Class A lender. USBGI replaces Zions as the party obligated under the Credit Agreement to provide the 7 to 1 matching funds that will be available to applicants seeking loans from the BLU program. The Credit Agreement (as amended) is now ready for the Mayor's signature.
The Economic Development Division Manager now recommends that the City Council, by motion, authorize the Mayor to execute the Credit Agreement.
SCHEDULED ITEMS
6:00 P.M. PUBLIC HEARING - Walker Monument Sign Zone Amendment
16. ORDINANCE - Amending Section 14-1-4 of the Orem City Code by changing the sign zone of Walker Monuments located at 737 North 1200 West from Sign Zone E to Sign Zone F
PRESENTER: Jason Bench
REQUEST: The applicant, Chase Dalton with Graphik Display & Sign, requests the City change the sign zone for property located generally at 737 North 1200 West from Sign Zone E to Sign Zone F.
POTENTIALLY AFFECTED AREA: Geneva Heights Neighborhood
BACKGROUND: The subject property is located adjacent to I-15 on the southeast side of the I-15 interchange at 800 North. Walker Monument was built in 1981 and the owner has decided it is time for a new pole sign along I-15. The property is currently located in Sign Zone E which allows signs to be constructed twenty-five feet (25') above the deck of the freeway. The applicant feels that the allowable height does not offer sufficient visibility for his site.
When the previous pole sign was designed and approved, the grade of I-15 was significantly lower than it is today. Walker Monument is now at a lower elevation than I-15 and the existing pole sign now projects only 10-15 feet above the grade of I-15. The applicant believes that a sign that is 50 feet above the deck of I-15 is necessary to restore visibility to southbound I-15 traffic and to prevent the neighboring Prestige Lighting sign from blocking the view of the sign from north-bound traffic.
The applicant conducted a study using balloons to demonstrate the visibility of a potential sign at 50 feet above the deck of the freeway. The applicant believes that locating a sign 50 feet above the freeway deck would provide adequate visibility to allow south-bound traffic to identify his business in time to exit the freeway.
The Planning Commission considered the request at its meeting on January 17, 2018 and voted 4-1 to recommend denial of the request.
A neighborhood meeting for the proposed rezone was held on November 17, 2017. One (1) person was in attendance and had no problems with the rezone
RECOMMENDATION: The Planning Commission recommends the City Council, deny the request to amend Section 14-1-4 of the Orem City Code by changing the sign zone of Walker Monuments located at 737 North 1200 West from Sign Zone E to Sign Zone F.
6:00 P.M. PUBLIC HEARING - Purchasing Policies & Procedures Amendment
17. ORDINANCE - Amending Article 2-7 of the City Code regarding purchasing policies and procedures by making adjustments for inflation, allowing for new technologies and purchasing methods, clarifying and adding requirements, and making other technical changes
PRESENTER: Richard Manning and Brandon Nelson
REQUEST: The City Attorney requests that the public hearing to discuss amending the current code regarding purchasing policies and procedures be continued to the City Council meeting to be held on Tuesday, February 13, 2018, at 6:00 p.m.
6:00 P.M. PUBLIC HEARING - Budget Amendment FY 2017-2018
18. ORDINANCE - Amending the Current Fiscal Year 2017-2018 Budget
PRESENTER: Richard Manning and Brandon Nelson
RECOMMENDATION: The City Manager recommends the City Council hold a public hearing to discuss amending the current Fiscal Year 2017-2018 Budget and, by ordinance, amend Fiscal Year 2017-2018 Budget.
POTENTIALLY AFFECTED AREA: Citywide
BACKGROUND: The Fiscal Year 2017-2018 City of Orem budget has many adjustments that occur throughout the fiscal year. These adjustments include grants and donations received from Federal, State, and other governmental or private entities/organizations; adding additional project funds due to interest earnings on the Siemens energy savings improvement lease escrow account unspent funds; and various other smaller technical corrections or minor budget adjustments that need to be made.
