3. Public Hearing: Dark Sky Ordinance.
Motion by Chair Syme that we leave the Public Meeting and enter a Public Hearing, seconded by Vice-Chair Meyerhoffer. All in favor.
Mr. Morris explained the purpose of the Public Hearing and reviewed the Dark Sky Ordinance. If anyone wants a copy of the Ordinance they can contact him or Marilyn.
Chair Syme asked for public comment.
Aaron Buttars, resident, said he is being flooded out with bright lights from the storage units near his house, as well as from nearby buildings. He asked if these businesses are grand-fathered in.
Scott Slater who assisted in writing this Ordinance expressed his appreciation to the Commission for considering this issue. Light is a serious pollution problem just as much as other types we face. It impacts all of us.
No other public comments were offered.
Motion by Vice-Chair that we close the Public Hearing and open a Public Meeting, seconded by Chair Syme. All in favor.
4. Refer Public Hearing comment to staff to address.
Mr. Morris responded to Mr. Buttars' question and said under the proposed Ordinance that existing businesses are grand-fathered. Mr. Morris also acknowledged Mr. Slater's contribution to the development of this Ordinance.
Chair Syme feels our responsibility as the Planning Commission lies in protecting the residents interests as much as possible, but he is realizing that there will be more and more commercial development within our city in the future. Sierra RV has been broken into several times and we have an obligation to assist them as much as possible also.
Mr. Schofield asked if the Ordinance could be simplified and Mr. Morris said he will meet with Mr. Slater to attempt that.
Motion by Vice-Chair Meyerhoffer, seconded by Mr. Schofield, that we table this Ordinance until staff is able to review this more thoroughly. All in favor.
5. Discussion/action on Phase I of the Stanger Subdivision at 1200 West and 700 South.
This is a minor lot subdivision with three (3) half-acre lots being proposed rather than the original four (4) lots requested. Mr. Morris reviewed the City Engineer's memo dated August 15, 2017, which listed approval requirements.
The Marriott Irrigation Company has made it clear that they want the ditches on 1200 West eliminated. In the future Phases of this development shareholders will have the opportunity to connect to the pressurized water system.
Leon Stanger, developer, said the sewer for the three (3) lots will be on a pressurize grinder sewer system which will drain on the east side of 1200 West. They do have commitment-to-serve letters on the lots from utilities.
Motion by Mr. Hunsaker to approve Phase I, seconded by Chair Syme, subject to all stipulations required by the City Engineer, municipal code, and staff requirements. All in favor, none opposed.
6. Commission and staff follow-up.
Home businesses will no longer be required to be licensed, but they must still comply with all zoning ordinances. Subdivision lots are required to have secondary water.
Commission asked about the status on the illegal mobile home parked on private property on 17th Street. Mr. Brandley said the owner has not expressed any interest in taking care of this issue. He is currently being fined $4000 per day and is now pending a lawsuit.
The former Bauer/Hansen lot on West 17th Street has been cleared off. Mr. Morris said anyone who wants to tour the property can contact Mr. Morris. Top soil has been brought in and Steve Mecham will level that off. Some of the tires have been removed, but there are still many left. Most of the contaminated soils have been removed.
Vice-Chair Meyerhoffer would like overgrown weeds on properties throughout the city cleaned-up.
Chair Syme thanked city staff for all they do.
7. Adjourn.
Meeting adjourned at 7:43 p.m.
