MONA CITY COUNCIL MEETING JUNE 13, 2017 7:30 PM MAYOR GREG NEWTON CALLED THE MEETING TO ORDER AT 7:30 P.M. PRESENT: Gregory A Newton - Mayor Molli Graham- Council Member Jeffrey Hearty - Council Member Jonathan Jones - Council Member Katrina Long - Council Member Jeffrey Smith - Council Member GUEST: Josiah Barns, Noel Lance, Alex Delatorre, Roger J Elsmore, Jim Orten, Dawn Miller, Jeanette Brown, Allan Taylor, (Juab County Sheriff), Douglas Anderson, (Juab County Sheriff) ALSO PRESENT: : Myrna Trautvein - Times News Reporter Michelle Dalton-Secretary/Treasurer Everd Squire -Director of Finance, Lyla Spencer, City Recorder, Lynn Ingram Planning & Zoning OPENING PRAYER: Councilmember Jeffrey Smith BUDGET HEARING: Mayor Greg Newton opened the budget hearing to amend the 2016-2017 budget and adopt the 2017-2018 budget. The floor was then given to Director of Finance Everd Squire to present and review the 2016-2017 budget to be amended by the council. Evered went over the revised budget and the final budget with council members prior to the adoption of each in separate actions. After discussion, Mayor Newton asked for a motion to amend the 2016-2017 budget. Councilmember Jonathan Jones moved to make a motion to amend the 2016-2017 budget as presented. Councilmember Molli Graham made a second on that motion. The vote was in favor of the motion. Motion carried. (1st Motion) Everd then presented the 2017-2018 proposed budget to the council for consideration, review, discussion, and adoption. Minor changes were suggested, Mayor Newton then asked for a motion to adopt the 2017-2018 budget with the suggested changes. Councilmember Jeffrey Hearty moved to make a motion to adopt the 2017-2018 budget with the suggested change, with Councilmember Jeffery Smith making a second on that motion. The vote was in favor of the motion. Motion Carried. (2nd Motion) Everd told the council, 'I have spent a lot of time on the budget and have tried to anticipate what might still come in this fiscal year', and added, 'No budget is cast in stone and that is why we are considering the revised budget for 2017' MONA CITY COUNCIL MEETING JUNE 13, 2017 7:30 PM Tax revenue for the year is expected to be $280,400 which is up from the $275,765 for 2017. Everd told the council, 'I tried to anticipate new money for the city building so that we could pay for new furniture and other items'. The council and Mayor Newton thanked Everd for a job well done. The Operational Budget Report for Mona City 07/01/2016- 07/01/2017, and Mona City State Budget Report 07/01/2017 to 06/30/2018 are attached and will become a permanent part of the June 13 minutes for public viewing. APPROVAL OF MAY 23, 2017 MINUTES: Councilmember Katrina Long moved to make a motion to accept the minutes of May 23, 2017 as corrected, and a second was made by Councilmember Jonathan Jones. The vote was unanimous, all in favor (3rd Motion) PLANNING AND ZONING: Planning and Zoning Chair, Lynn Ingram came before the council with a report on their meeting held June 7, 2017 at 8:00. The meeting went as follows: Discussion and Possible Action items: Jimmy Coray/Roger Ellsmore - Building Permit for 395 South 300 E, Ingram recommended the council issues a building permit to the above individuals, and address on the condition they obtain a certificate for water. Councilmember Molli Graham moved to make a motion to issue a building permit to Jimmy Coray and Roger Ellsmore at 395 South, 300 East with the condition they obtain a water certificate. A second was made by Councilmember Katrina Long Motion carried, vote unanimous. (4th Motion) Patrick Painter asked for a building permit for Lot #28, Mountain View Estates. Ingram made a recommendation to the council to issues that permit to Painter in the Mountain View Estates, Subdivision, Lot #28, Councilmember Jonathan Jones moved to make a motion to issues a building permit to Patrick Painter in the Mountain View Estates Subdivision, Lot #28, and Councilmember Jeffrey Hearty made a second to that motion. All council members were in favor, motion carried. (5th Motion) Patrick Painter also requested a commercial building permit for a storage unit, his plans have been approved, Lynn Ingram made a recommendation to the council to issue that permit to Painter. Councilmember Molli Graham moved to make a motion to issue a commercial building permit for a storage unit; location 778 S 300 E, to Patrick Painter; a second was made by Councilmember Jeffrey Smith. Vote unanimous, motion carried. (6th Motion) Ingram then presented a minor subdivision request from Gordon Jarrett . Ingram said Jarrett has submitted his paper work, has the required frontage needed (88'). The subdivision will consists of two lots located at 100 W 100S. Ingram made a recommendation to the council that they approve the above minor subdivision for Gordon Jarrett on 100 W 100S. Councilmember Katrina Long moved to make a motion to approve the minor subdivision at 100 W & 100S for Gordon Jarrett with Best Homes for two MONA CITY COUNCIL MEETING JUNE 13, 2017 7:30 PM lots. A second was made by Councilmember Jonathan Jones. Vote was unanimous, motion carried. (7th Motion.) Ingram told the council they had a developers from High Meadows Subdivision, Brian Hulet come in for a discussion on a subdivision in that area. There are some, irrigation and culinary water issues they are trying to figure out, before that will take place. Ingram said it will be a win- win situation for High Meadows if the water issues can be taken care of. . DELEGATIONS: Josiah Barnes came in to ask the council for help on paint and sanding equipment and supplies to sand and paint the eaves on the pavilion, for an Eagle Project, he would like to have it completed by July 24th. Councilmember Smith suggested the council first look at the eaves and make sure they need to be painted. Juab County Sheriff's report: Doug Anderson and Al Taylor came before the council to report on the Sheriff's department. Councilmembers are pleased with law enforcement coverage in Mona City. Doug Anderson Juab County Deputy Sheriff told the council all of the cities receive protection and all voluntarily pay extra though not as much as Mona City is paying. Eureka would like to do what Mona is doing by paying the extra $10,000 for coverage. Councilmember Katrina Long wondered at what point Mona City would be able to have its own police department. Mayor Newton said you would have to have at least three officers and the city cannot afford that at the present time. Anderson said running a law enforcement office can be expensive Right now he has 11 deputies in his department, at which sometime coverage can run a little thin, due to the size of Juab County. Sheriff Anderson said most shifts in the sheriff office are able to make certain there is an east car and a west car., sometimes three cars are available and that is the ideal.. He continued by saying. 'No officer can work more than 16 hours straight.' They are going to have a training session for members who want to attend, for his search and rescue team. Following that training, those who have completed the training, will be able to serve part time as bailiffs. That will relieve the pressure of deputies. 'One place we could bring in more revenue,' said Anderson. 'If we were able to take in more state prison inmates.' They are outsourcing the dispatch center, Anderson said it will be a good thing. By October, dispatch of deputies will come from Spanish Fork. 'We are forced to do that by state legislature mandate', said Anderson, and added, 'It will cost us $59,000 annually' He said the county should save a little money because they will not have to pay a $3,000 a month phone bill. COUNCIL BUSINESS: Business License Approval: There was one new business license for Express Mobil Oil, 150 N 350 E. Councilmember Jeffrey Hearty moved to make a motion to approve the business MONA CITY COUNCIL MEETING JUNE 13, 2017 7:30 PM license for Express Mobil Oil; a second was made by Councilmember Jeffrey Smith. The vote was unanimous. (8th Motion) One fence permit application was issued and approved for a Box Fence, Councilmember Molli Graham moved to make a motion to approve the Box Fence permit located at 347 W, a second was made by Councilmember Jeffrey Hearty (11th Motion) Resolution #6-13-2017 was presented by Mayor Greg Newton to adopt a Justice Court System and begin the paper work for Mona City. Mayor Newton told the council and those present the new community center was planned with an area for the Justice Court. It usually takes longer to get permission from the state to have such a court. The paperwork is due by the first of July, Newton told the council, 'Usually the court begins the following year but a waiver is often offered for those who are starting a court for the first time.' Judge Sharla Williams has agreed to come to Mona one day a month. The city will be responsible to pay the judge, the court clerk, the city attorney and the bailiff. Mayor Newton, said, 'All the revenues from fines will come to the city.' Mayor Newton asked for motion to adopt a Justice Court System for Mona City. Councilmember Jeffrey Hearty moved to make a motion to adopt a Justice Court System for Mona City, with a second by Councilmember Jonathan Jones. All were in favor motion carried. (9th Motion) Councilmember Molli Graham: Told the council the cemetery is doing well, Backus will come back and finished what needs done when the roads are completed. Councilmember Jones: Announced the Grand Marshall for the upcoming Pioneer Day Parade: Veterans' Committee. The theme for the celebration is 'Building on Our Pioneer Heritage. Councilmember Jeffrey Smith: told the council the ATV Class went very well with 20-30 participants. The class ended at 9:30.p.m. Councilmember Smith said the road repairs are going well, the amount of repairs have doubled this year. Everd Squire wants to have an estimate on the repairs for budget purposes. Someone is willing to purchase the orange truck, he said it needs extensive work. He has wanted to get rid of the orange truck and the old sweeper for some time now. He had a question on repairs at 300 E 600 S, 'the contractor fixed it and now it is bellying out', does the council want a contractor to fix it again, or do you want Jared to fix it while he is out there? Councilmember Smith said he didn't think it was packed well enough when it was originally repaired. Mayor Newton suggested waiting until it is completely settled. Councilmember Jeffery Hearty told the council they didn't make it on the CIB list for their General Planning time, so that will have to wait until next time. He is going to have a meeting next week with the MPA student from BYU to discuss the general plan. Mayor Newton told Councilmember Hearty he needs to make a request to the County Commission to get on the 6 County agenda for this year to add Mona City to the Capital Improvements list. Councilmember Katrina Long presented Ordinance 2017-3 Boards and Commissions Title 2, Chapter 1 for review, approval and adoption. MONA CITY COUNCIL MEETING JUNE 13, 2017 7:30 PM After council review, Mayor Newton asked for a motion to adopt Ordinance 2017-3 Boards and Commissions, Title 2, Chapter 1 as presented. Councilmember Jeffrey Hearty moved to make a motion to adopt Title 2 Chapter 1 of Boards and Commissions, Ordinance 2017-3. A second was made by Councilmember Jeffrey Smith. The vote was unanimous in favor of the motion. (10th Motion) A copy of the ordinance is attached for public viewing. Councilmembers did not pass revisions of the Nuisances ordinance Title 4, instead they decided to table it for two weeks until the next council meeting. During that time the council will be able to review the code in depth. Councilmember Graham said, 'She would like to read through it more.' She also thought it would be wise to have Mona City attorney Kasey Wright review the code. Title 5 Public Safety will be reviewed at the next council meeting. Mayor Newton ended the council session with a small update on the new building saying it should be completed within 3 weeks, flooring is one of the last steps. Juab School District sent a letter to the mayor and Mona City Council with a check enclosed in the amount of $9,545.50 representing Juab School District's contribution to the sidewalk construction along the Mona Elementary property. The letter in its entirety is attached and will become a permanent part of the June 13 council minutes for public viewing. The security lights and electricity are now installed in the Snack Shack. DIRECTOR OF FINANCES: Director of Finances Everd Squire presented The Mona City Disbursement Listing for checking dated 5/24/2017 to 6/13/2017; he asked if there were questions on the disbursement. There were questions on the following checks; EZ Open check #1950, in the amount of $260.00, Hanson Wright Attorneys check #1951 in the amount of $1,000.00, STOTZ Equipment, check #1962 in the amount of $2,777.12, UDOT Comptroller, Check #1964. Questions were answered sufficiently on the above checks. There were seven (7) checks over the allotted amount of $2,000. The report has been initialed by each council member and attached to the minutes for public viewing. SECRETARY REPORT: Secretary Michelle Dalton handed out free tickets for those wanting to attend the Garden Brothers Circus in Mt. Pleasant Wednesday June 28, at the Contoy Arena. Performances are 4:30 & 7:30 PM. She gave some bid quotes from Shepherds Carpets, and Valley Furniture. for carpet that will be installed in the community center. Reminder: utility shut-offs will be Thursday, she sent two letters in reference to fire hazards. RECORDERS REPORT: Update on municipal candidates as follows: Two candidates for mayor: Jonathan Jones and William Mills. For councilmember: Frank Riding, Jeffrey Smith and Michele Stringer. MONA CITY COUNCIL MEETING JUNE 13, 2017 7:30 PM Spencer will be updating the SAM's (System Awards Management) for 2017-2018, due in August. FYI: There were twelve (12) motions voted upon and passed, a motion to approve the May 23, 2017 minutes, a motion to amend the 2016-2017 budget, a motion to adopt the 2017-2018 budget, a motion to approve a building permit for Jimmy Coray /Roger Ellsmore, a motion to approve a building permit for Patrick Painter, a motion to approve a commercial building permit for Patrick Painter, a motion to approve a minor subdivision for Gordon Jarrett, a motion to adopt a Justice Court System, a motion to adopt Title 2, Chapter 1 Ordinance #2017-3 Boards and Commissions, a motion to approve a business licenses for Express Mobil Oil, a motion to approve a fence permit, and a motion to adjourn this meeting of June 13, 2017 and go into executive session. PAY FINANCES ADJOURNMENT: Councilmember Molli Graham moved to make a motion to pay the finances and adjourn and go into an executive session, a second was made by Councilmember Jeffrey Hearty, all were in favor, the vote was unanimous. (12th Motion) The city council meeting was adjourned at 10:40 p.m., with no further comments, The council then went into executive session at 10:43 p.m. EXECUTIVE SESSION, IF NECESSARY: An executive session was called by Director of Finance Evered Squire at 10:43, and conducted by Mayor Greg Newton. The purpose for the session was to discuss personnel issues. Those present were Mayor Greg Newton, City Recorder Lyla R Spencer, Director of Finance Everd Squire, Councilmember's Molli Graham, Jeffrey Smith, Jonathan Jones, Jeffrey Hearty, and Katrina Long. Councilmember Molli Graham moved to make a motion to adjourn the executive session with a second by Councilmember Jonathan Jones.
