NOTICE AND AGENDA OF A MEETING OF THE BOARD OF COMMISSIONERS OF THE COUNTY OF IRON STATE OF UTAH ************************** PUBLIC NOTICE IS HEREBY GIVEN that the Board of Commissioners of the County of Iron, State of Utah, will hold a Public Meeting Parowan City Council Chambers at the Parowan City Offices, 35 East 100 North, Parowan Utah (temporary location) on Monday, the 27th Day of March, 2017 at the hour of 9:00 o'clock a.m. AGENDA 9:00 A.M. OPENING, PLEDGE OF ALLEGIANCE, REPORTS, APPROVE MINUTES, APPROVE WARRANTS, REVIEW BOARD APPOINTMENTS, DEPARTMENTAL REPORTS, (Building/Zoning/Planner, Engineer, Road, Landfill.), ETC. 10:00 A.M. PUBLIC APPOINTMENTS 1. BID OPENING AND POSSIBLE AWARD OF CONTRACT FOR ASBESTOS ABATEMENT IN THE IRON COUNTY COURTHOUSE. 2. PUBLIC COMMENTS Three (3) Minute Time Limit per Speaker for Public Comment Participants. Should Not Repeat Others Comments. Only for Items Not on the Agenda. No Items Related to Commission's Role as an Appeal Board. Comments Should Be Directed to the Commission. No Attacks on Other Peoples Character. 3. REVIEW AND POSSIBLE APPROVAL OF AN EDUCATIONAL USE PROPERTY EXEMPTION WHICH WAS FILED BEFORE THE MARCH 1ST DEADLINE, BUT WAS DIRECTED TO THE WRONG COUNTY DEPARTMENT. Presented by Christene Lowder, Chief Deputy Auditor. 6. REVIEW AND POSSIBLE APPROVAL OF APPLICATIONS FOR TAX EXEMPT STATUS PENDING CLARIFICATION THAT WERE DISCUSSED IN THE MARCH 13, 2017 MEETING. Presented by Christene Lowder, Chief Deputy Auditor. RECONVENE AS THE IRON COUNTY COMMISSION CONVENE AS THE GOVERNING BOARD OF THE IRON COUNTY COMMUNITY DEVELOPMENT AND RENEWAL AGENCY (ICCD&RA) 7. DISCUSSION AND POSSIBLE APPROVAL TO USE ICCD&RA FUNDS TO PAY ATTORNEY'S FEES OWED TO SMITH HARTVIGSEN, PLLC. 8. CONSIDERATION FOR ADOPTION OF ICCD&RA RESOLUTION 2017-12 AUTHORIZING THE PREPARATION OF A DRAFT COMMUNITY REINVESTMENT DEVELOPMENT PROJECT AREA PLAN FOR APPALOOSA SOLAR I, AND RELATED MATTERS. 9. CONSIDERATION OF ICCD&RA RESOLUTION 2017-2, APPROVING AN AMENDMENT TO THE THREE PEAKS POWER PROJECT AREA PLAN TO CONFORM ITS LEGAL DESCRIPTION TO THE PROJECT CONFIGURATION AND RELATED MATTERS. 10. CONSIDERATION OF ICCD&RA RESOLUTION 2017-3, APPROVING AMENDMENTS TO THE INTERLOCAL AGREEMENTS FOR THE THREE PEAKS POWER CDA TO REFLECT THE PROJECT AREA PLAN AMENDMENT. 11. CONSIDERATION OF ICCD&RA RESOLUTION 2017-4, APPROVING AN AMENDMENT TO THE PROJECT AREA PLAN FOR THE SUNEDISON PHASE 1 COMMUNITY DEVELOPMENT PROJECT AREA TO REDUCE THE SIZE OF THE PROJECT AREA TO INCLUDE ONLY THE THREE QUICHAPA SOLAR PROJECTS. 12. CONSIDERATION OF ICCD&RA RESOLUTION 2017-6, APPROVING A PARTICIPATION AGREEMENT WITH THE NEW OWNER OF THE QUICHAPA SOLAR PROJECTS. CONVENE AS THE GOVERNING BOARD OF THE IRON COUNTY UNINCORPORATED AREA SERVICES DISTRICT #2 14. CONSIDERATION OF UASD #2 RESOLUTION 2017-1, APPROVING AN AMENDMENT TO THE INTERLOCAL AGREEMENT WITH THE ICCD&RA FOR THE THREE PEAKS POWER CDA TO REFLECT THE AMENDED PROJECT AREA PLAN. 15. CONSIDERATION OF UASD #2 RESOLUTION 2017-2, APPROVING AN INTERLOCAL AGREEMENT WITH THE ICCD&RA FOR THE SUN EDISON, PHASE 1 CDA. RECONVENE AS THE IRON COUNTY COMMISSION 16. CONSIDERATION OF ORDINANCE 2017-1, AMENDING THE THREE PEAKS POWER CDA PLAN AS APPROVED BY THE ICCD&RA. 17. CONSIDERATION OF ORDINANCE 2017-2, AMENDING THE SUN EDISON, PHASE 1 CDA PLAN AS APPROVED BY THE ICCD&RA. 18. CONSIDERATION OF RESOLUTION 2017-5, APPROVING AN AMENDED INTERLOCAL AGREEMENT WITH THE ICCD&RA FOR THE THREE PEAKS POWER CDA. 19. CONSIDERATION OF RESOLUTION 2017-6, APPROVING AN INTERLOCAL AGREEMENT WITH THE ICCD&RA FOR THE SUN EDISON, PHASE 1 CDA. 20. APPROVAL TO TRANSFER SURPLUS VEHICLE 1986 WILLIAMSEN PUP, VIN #1W94E2525GS004183, UNIT #270 FROM THE ROAD DEPARTMENT TO THE ENGINEER DEPARTMENT. 21. REQUEST APPROVAL FOR COUNTY ROAD ONE LANE CLOSURE ON THE SHOOTING RANGE ROAD (THE ONE THAT STARTS JUST NORTH OF THE THREE PEAKS ENTRANCE AND GOES CLEAR AROUND TO IRON SPRINGS) FOR A MOUNTAIN BIKE RACE BEING HELD IN SEPTEMBER 2017. SHERIFF 1. Approval of new hire, Jason Thomas as Patrol Deputy effective 3/27/2017. Backfill of vacant position left by Shawn Coston. B. LANDFILL 1. Approval of new hire Grant Oxenrider as Landfill Technician effective 03/27/2017. C. BUILDING MAINTENANCE 1. Approval of new hire Jeff Mckee as Facilities Maintenance Technician effective April 10, 2017. D. JUSTICE COURT 1. Approval for new hire Hudson Brown as a Justice Court Clerk position. This is a backfill position, effective March 27, 2017. E. BUILDING DEPARTMENT 1. Discussion and possible approval of updated Pay Value and associated Pay Range for the Building Inspector/Zoning Officer position. 2. Discussion and possible approval of wage increase for Terry Palmer in association with the pending approval to update the Pay Value and associated Pay Range of the Building Inspector/Zoning Officer position. C. ASSESSOR 1. Approval of new hire for the newly created/approved position for a part-time temporary data entry clerk that will be working on the scanning of archived information to electronic storage.
