INDIGENT DEFENSE TRUST FUNDS Board Meeting Division of Finance, 2110 State Office Building, Salt Lake City, Utah 84114 Public Meeting Notice and Agenda December 13, 2016 11:30 a.m. To join the meeting by phone, call: 1-877-820-7831 Participant Pass Code: 349946 1. Welcome. 2. Review and approval of the minutes from the meeting held on January 19, 2016, and minutes from the telephonic meeting held on March 22, 2016, and from the meeting held on April 12, 2016. 3. Assignments from the April 12, 2016 meeting. 1) Richard Gale to speak with the LDA for names to replace Denise Porter. (See agenda item 7.) 2) Barbara will send an email to Gary Pendleton and Mary Corporon about funding on the Brandon Perry Smith case now that the death penalty has been removed. (email sent Aug. 5, 2016) (See agenda item 8.) 3) Brody Keisel will talk to Doug Terry about submitting the bill for videoing witnesses in the Logan McFarland case. (See agenda item 9.) 4) John to discuss contracting for appeals with State Purchasing. (See agenda item 10.) 5) Subject to guidance by State Purchasing, advertise in State Bar Journal for people to work as conflict counsel (work on appeals). (See agenda item 11.) 4. Motion and Decisions to be made from the Board meeting held on April 12, 2013. Agenda was inadvertently not posted to the Public Notice Website so no board action was taken. The Board was asked to consider the discussions at the April 12, 2016, meeting and come to the next board meeting to make a decision on the following items. 1) Consider adding language to the standard contract concerning mitigation experts no longer needed when the death penalty is removed. John proposed adding the following language to the standard contract in 3. A. (2). The mitigation investigator fees will not be reimbursed, and are not allowable if the death penalty is not sought, or no longer sought. 2) Consider whether to allow second attorney and mitigation specialist to continue in the Brandon Perry Smith Case. The Board reviewed the contract with Gary Pendleton and Mary Corporon, counsel for Brandon Perry Smith. The contract caps the funding at a lower amount if the death penalty is not sought, but does not remove the second attorney. The Board discussed where contractually there is no language in the contract removing the second chair after the death penalty was removed, and if the case should go forward with both attorneys. 5. Fund Balances as of Sept. 21, 2016. 6. County Assessments for 2017. 7. Discuss appointment of private defense attorney to replace Denise Porter. Neal Hamilton from the LDA to be considered to replace Denise Porter. 8. Funding on the Brandon Perry Smith case, now that the death penalty has been removed. 9. Doug Terry videoing witnesses bill on the Logan McFarland case (Brody). 10. John to discuss contracting for appeals with State Purchasing. 11. Contracting for appeals with State Purchasing. Guidance from State Purchasing on advertising in the State Bar Journal for people to work on appeals. 12. Funding on the Angelo Seth Carrasco case. Remaining balance $6,153.00. 13.
