Mayor Jerry A. Taylor called the meeting to order at 6:00 p.m. in the Escalante City Council Chambers.
Present at said meeting were Mayor Taylor, Council members Marlene Stowe, Greg Allen, Melanie Torgersen, Louise Barnes and City Recorder Stephanie Steed. Council member
Guy Graham and City Attorney Barry Huntington were excused.
Also present were Leslie Venuti, Bob Hartman, Rich White, Lawrence Barnes, Geraldine Liston, Marty Henrie, Garfield County Sheriff Danny Perkins, Janalee Bernardo, Ryan Fisher,

ADOPTION OF THE AGENDA
Mayor Taylor said he would like to discuss scheduled items 7.4 and 7.5 with scheduled
item 7.1. Council member Allen made a motion to adopt the agenda with the changes Discussed. Council member Stowe seconded the motion. Motion carried with Council members Stowe, Allen, Torgersen and Barnes voting aye.
APPROVAL OF MINUTES
MINUTES OF THE MAY 17, 2016 MEETING
Council member Barnes made a motion to approve the minutes of the May 17, 2016 meeting as written. Council member Torgersen seconded the motion. Motion carried

PLANNING AND ZONING UPDATES
JERRY & MONICA TAYLOR, LOUIE & JANALEE BERNARDO - CONDITIONAL USE PERMIT - 155 W. 100 S.
Mayor Taylor stated a conflict of interest because this is his project. Council member Stowe explained the Conditional Use Permit. This Permit meets all the requirements and Planning and Zoning has approved it. Council member Stowe made a motion to approve the Conditional Use Permit for Jerry and Monica Taylor, Louie and Janalee Bernardo at 155 West 100 South. Council member Allen seconded the motion. Motion carried with Council members Barnes, Stowe, Torgersen and Allen voting aye.
HOLE IN THE ROCK INN, LLC - BUSINESS LICENSE - 155 W. 100 S.
Mayor Taylor stated a conflict of interest because he is part owner of this business.
Council member Stowe explained this Business License goes with the Conditional Use Permit for Jerry and Monica Taylor, Louie and Janalee Bernardo at 155 West 100 South. This Business License meets all requirements and Planning and Zoning has approved it. Council member Stowe made a motion to approve the Business License for the Hole In The Rock Inn, LLC. Council member Barnes seconded the motion. Motion carried with Council members Barnes, Stowe, Torgersen and Allen voting aye.

Council member Stowe explained the Conditional Use Permit. This Permit meets all the requirements and Planning and Zoning has approved it. STEPHEN & JENAE WESTHOFF - GRAND STAIRCASE RESORT MASTER PLAN, PHASE ONE, PLANNED UNIT DEVELOPMENT STANDARDS/EXHIBITS - 680 W. MAIN
Council member Stowe explained the Municipal Project Approval Form. This project goes with Mr. and Mrs. Westhoff's Conditional Use Permit at 680 West Main. Council member Stowe said this project meets all requirements and Planning and Zoning has approved it. Council member Stowe made a motion to approve the Municipal Project Approval Form for Mr. and Mrs. Westhoff. Council member Barnes seconded the motion. Motion carried with Council members Stowe, Barnes, Torgersen and Allen voting aye.
GRAND STAIRCASE RESORT - BUSINESS LICENSE - 680 W. MAIN
Council member Stowe explained this Business License goes with the Conditional Use Permit for Mr. and Mrs. Westhoff. This Business License meets all requirements and Planning and Zoning has approved it. Council member Stowe made a motion to approve the Business License for the Grand Staircase Resort. Council member Torgersen seconded the motion. Motion carried with Council members Allen, Stowe, Torgersen and Barnes voting aye.
JAMES & CHARLENE HASENYAGER - CABIN - BAILEY WASH
Council member Stowe explained Mr. and Mrs. Hasenyager's Municipal Project Approval Form. This project meets all requirements and Planning and Zoning has approved it.
Council member Stowe made a motion to approve the Municipal Project Approval Form for Mr. and Mrs. Hasenyager. Council member Torgersen seconded the motion. Motion carried with Council members Stowe, Barnes, Torgersen and Allen voting aye.
CARLY & DAVID GONZALEZ - MANUFACTURED HOME - 260 W. 100 S.
Council member Stowe explained Mr. and Mrs. Gonzalez's Municipal Project Approval Form. Council member Stowe said Planning and Zoning referenced Ordinance 5.8 because this parcel is a nonconforming use of land. Due to the parcel being legally created before the Ordinance became effective it meets all requirements. Council member Stowe said all the setbacks are met and Planning and Zoning has approved it. Council member Stowe made a motion to approve the Municipal Project Approval Form for Mr. and Mrs. Gonzalez. Council member Allen seconded the motion. Motion carried with Council members Stowe, Barnes, Allen and Torgersen voting aye.
ESCALANTE OUTFITTERS - CABIN - 310 W. MAIN
Council member Stowe explained the Municipal Project Approval Form. This project meets all requirements and Planning and Zoning has approved it. Council member Stowe made a motion to approve the Municipal Project Approval Form for Escalante Outfitters. Council member Allen seconded the motion. Motion carried with Council members Stowe, Barnes, Torgersen and Allen voting aye.
SCHEDULED ITEMS
GARFIELD COUNTY SHERIFF DANNY PERKINS - UPDATE
Sheriff Perkins said the sheriff's office has been very busy. Sheriff Perkins said Deputy Jared Dunton has been in Panguitch all day for a Jury Trial and Deputy Eric Dunton is out on a search right now. Sheriff Perkins said Search and Rescue has been nonstop in the Escalante area. Deputy Jared Dunton said in the last week, he was on the Monument every other day for search and rescue. Sheriff Perkins explained he is almost out of free hours for the Classic Life Guard Helicopter. The next closest helicopter is out of Salt Lake City and takes them three to four hours to get to Escalante. Sheriff Perkins said they are looking for financial help for the Monument searches. Sheriff Perkins said we could not do it without the help of the Search and Rescue Volunteers.
MARTY HENRIE - PEACOCK ORDINANCE
MARTY HENRIE - ORDINANCE CLARIFICATION
Sheriff Perkins said he received a letter from some citizens with concerning issues. Sheriff Perkins said he had Deputies Jared Dunton and Eric Dunton go over the Animal and Nuisance Ordinances and they said they are hard to enforce. Sheriff Perkins said it is hard to manage the dog and fowl issue's in Escalante. Sheriff Perkins said the main tool to enforce the dog issues is having a dog pound. Council member Torgersen said the City needs to look at getting a dog pound. Sheriff Perkins gave the Council a copy of Panguitch City's Ordinances to review (attached). Mayor Taylor asked Sheriff Perkins if there is a limit on the amount of dogs you can have in Panguitch. Sheriff Perkins said yes, you can only have three dogs and they also look at the square feet of your property to how many animals you can have. Sheriff Perkins said it's up to the City, but in order to enforce the problems we need to amend the ordinance. This item was discussed at length.
MARTY HENRIE
Mrs. Henrie said there is some questions on our Ordinances including exotic animals.
Mrs. Henrie asked the Council if they would make a motion to make peacocks illegal in City limits. Council member Barnes said we cannot change an Ordinance without a public hearing. Mrs. Henrie asked how we proceed to do something about the problem. Mayor Taylor recommended this issue be top priority. Mayor Taylor asked the Council to review and discuss what Sheriff Perkins presented. Mayor Taylor said then, if we want, we can give direction to City Attorney Huntington to amend our Ordinance. Mayor Taylor said we need to do something with the animal issue. This item will be put on the next agenda.
EARTHFAX ENGINEERING - DRAINING
Rich White said about two months ago the City got a grant from the USDA to update the Storm Water Master Plan. Mr. White gave a presentation on the drainage plan and the City financial statements (attached). Mr. White explained with the City's liabilities and cash flow we cannot afford a loan. Mr. White explained he will present the financial statements as part of the USDA report showing that the City can only do this project with grant money. Mr. White explained the best way to present the drainage project is to break it up into phases. Mr. White said this will take us years to complete, but he feels this would be the best way to go. Problem areas were discussed and Mr. White will present this report to the USDA and start looking for grants.
Mayor Taylor said if we want to approach CIB for a grant we need to put drainage on our top priority one-year list. This item was discussed at length.
GRAND STAIRCASE RESORT MASTER DEVELOPMENT AGREEMENT
Jared Westhoff explained the Master Development Agreement. Mr. Westhoff said they have made a few minor changes due to suggestions from the Planning and Zoning Commission and requirements from UDOT. Mayor Taylor told Mr. Westhoff he is impressed with all the work they have done on this project. Mayor Taylor said he would like City Attorney Huntington and David Church to review the agreement before moving forward with it. Mayor Taylor said he would also like to give the Council time to review it. This item was discussed at length and will be put on the next agenda.
FIRE DEPARTMENT - SCBA MASKS
Fire Chief Don Porter said he has three new fire fighters and needs to purchase SCBA masks for them. Chief Porter said he would like to purchase four masks if it is in his budget. Fire Chief Porter said the Masks are $318.00 each. Council member Allen made a motion to purchase four SCBA masks, if the funds are in the budget. Council Member Torgersen seconded the motion. Motion carried with Council members Allen, Stowe, Torgersen and Barnes voting aye.
FIRE DEPARTMENT - FIRE CODE RENEWAL
Fire Chief Porter said we need to renew our fire code. The renewal is $1,450.00 for one year, $2,610.00 for two years and $3,915.00 for three years. City Recorder Steed said she is not sure we have the money in the budget for this year and asked when we need to pay for it. Fire Chief Porter said we have been expired since last November. Mayor Taylor asked City Recorder Steed to pull the budget. After reviewing the budget, City Recorder Steed said we have the funds
for a one-year renewal. Council member Barnes made a motion to purchase a one-year
fire code renewal. Council member Stowe seconded the motion. Motion carried with Council members Barnes, Torgersen, Allen and Stowe voting aye.
FIRE DEPARTMENT - SUBURBAN TIRES
Fire Chief Porter said new tires for the suburban will be $900.00. Mayor Taylor said we will
find the funds to purchase the tires. Council member Torgersen made a motion to purchase new tires for the Suburban up to $900.00. Council member Allen seconded the motion. Motion carried with Council members Allen, Stowe, Barnes and Torgersen voting aye.
ROAD SHED BAY DOORS
Council member Barnes said the road shed needs new bay doors. Council member Barnes has two bids for the doors (attached). Council member Barnes made a motion to accept the bid for $ 8,860.00 for the new bay doors. Council member Stowe seconded the motion. Motion carried with Council members Allen, Barnes, Torgersen and Stowe voting aye.
RED SAFETY PAINT FOR CURBS
Council member Barnes said we need to repaint the curbs in town. Council member Barnes explained UDOT use to provide the red safety paint, but they don't anymore. Council member Barnes said she would like to purchase ten gallons of paint. Council member Torgersen said she has scouts coming on June 23 that are looking for a service project. Council member Barnes said this could be a project for them. Council member Stowe made a motion to purchases ten gallons of red safety paint for the curbs up to $200.00. Council member Torgersen seconded the motion. Motion carried with Council members Barnes, Allen, Stowe and Torgersen voting aye.
ASPHALT PATCH
Council member Barnes said she needs three pallets of asphalt patch for the roads. Council member Barnes said she will be asking for hot mix next budget year to get the roads ready for the chip seal. Council member Barnes made a motion to purchase asphalt patch up to $1000.00. Council member Stowe seconded the motion. Motion carried with Council member Torgersen, Stowe, Barnes and Allen voting aye.
LAND USE TRAINING
City Recorder Steed explained this is a training with the Utah League of Cities and Towns.
City Recorder Steed said she and Council member Stowe would like to attend the training. Council member Allen made a motion to send City Recorder Steed and Council member Stowe to the Land Use Training. Council member Torgersen seconded the motion. Motion carried with Council member Stowe, Allen, Torgersen and Barnes voting aye.

COUNCIL REPORTS
MAYOR JERRY A. TAYLOR
Mayor Taylor said we had a Tour of Utah meeting today. Mayor Taylor said we are excited for the Tour of Utah to come to Escalante and they are excited to come. Mayor Taylor said there will be a party in the park and invited everyone. Mayor Taylor said we need lots of volunteers for the Tour of Utah, August 2, 2016.
COUNCIL MEMBER GREG ALLEN
Council member Allen said the drainage situation is the most pressing issue we have. Council member Allen said the City is working on the drainage problems and Rich White with Earthfax Engineering is committed to helping us.
COUNCIL MEMBER MELANI TORGERSEN
Council member Torgersen said she is working on getting a cover for the playground.
COUNCIL MEMBER GUY GRAHAM
Council member Graham was not present at said meeting.
COUNCIL MEMBER MARLENE STOWE
Council member Stowe thanked Turn About Ranch for planting the trees and plants around the Clinic.
COUNCIL MEMBER LOUISE BARNES
Council member Barnes thanked all the volunteers who helped with planting the flowers on Main Street.
Council member Barnes said Senator Hatch was at the Clinic last week. Council member Barnes said Senator Hatch hugged and listened to everyone. Council member Barnes said Senator Hatch is a kind man and very generous with himself.
UNPAID BILLS
Council member Stowe made a motion to pay the unpaid bills. Council member Allen seconded the motion. Motion carried with Council members Allen, Barnes, Torgersen and Stowe voting aye.
EXECUTIVE SESSION
The executive session was not needed at this time.
Council member Stowe made a motion to adjourn the meeting at 7:59 p.m.
