SANTA CLARA CITY COUNCIL WORK MEETING WEDNESDAY, MAY 4, 2016 MINUTES THE CITY COUNCIL FOR THE CITY OF SANTA CLARA, WASHINGTON COUNTY, UTAH, met for a Work Meeting on Wednesday, May 4, 2016 at 5:00 p.m. in the City Council Chambers of the Town Hall at 2603 Santa Clara Drive, Santa Clara, Utah. Notice of the time, place and agenda of the meeting was provided to the Spectrum and to each member of the governing body by emailing a copy of the Notice and Agenda to the Spectrum and also, along with any packet information, to the mayor and each council member, at least two days before the meeting. Present: Mayor Rick Rosenberg Council Members: Jerry Amundsen, Mary Jo (Tode) Hafen and Jarett Waite City Manager: Edward Dickie City Recorder: Chris Shelley Others Present: Brock Jacobsen, Assistant City Manager; Jack Taylor, Public Works Director; Brad Hays, Parks Director; Dan Nelson, Fire Chief; Judith Kapuscinski; Lainee Frei; Brooke Ence; Susannah Nilsson 1. Call to Order: Mayor Rosenberg called the meeting to order at 5:12 p.m. - Councilmen Herb Basso and Ken Sizemore were excused from the meeting. 2. Working Agenda: A. General Business: 1. Rap Tax Art Application Review - Mayor Rosenberg said that this is where the Council will review the applications for the Arts portion of the Rap Tax. Council set 20% of the Rap Tax funds for the Arts. He said that the City has received applications. - Ed Dickie, City Manager, said that they have received 4 applications and the City also received a request earlier in the year, that Council granted, for Tuacahn. Rap Tax this year is estimated to be $13,600 for the City. $5,000 has already been appropriated towards Tuacahn. The City also paid $2,000 for the 24th of July Days of 47 that can also be used out of Rap Tax. That would bring the balance down to $6,600. That is what is available for the current year. One of the applications wouldn't be for this year, Swiss Days. They wouldn't need their's until the next fiscal year. Lainee and Brooke are requesting $5,000 for Swiss Days, mainly for entertainment. As far as putting this in the budget, it's it's own line item now. It's called Rap Tax for the Arts and that's under EDC and we budgeted $14,000 so anything that goes towards it would be paid right out of that account. For Swiss Days, the money wouldn't be comingled with the General Budget at all. They would like to have this ongoing but it can be looked at each year depending on the budget and other applications. - Lainee Frei and Brooke Ence said they feel like the entertainment is one of the few venues in Santa Clara for local artists and people to be able to perform and we want to provide a nice venue with a stage and a tent and nice sound system for people to be able to have a nice performance and share their talents with us. It would be nice to have this extra to be able to continue to draw in quality entertainment. Costs have gone up to be able to keep the tent rental, stage rental, the sound guy and things like that. It's becoming difficult to have the funds in the Swiss Days budget and so this would be a good opportunity apply this towards the entertainment aspect of Swiss Days as it does promote the local artists in this area. - Ed Dickie stated that Lainee and Brooke will be meeting with the County on August 5th to request Rap Tax Art funds from them also to help with Swiss Days. - Lainee Frei and Brooke Ence said that if this were to be ongoing it would provide them with more options. In the future if they were to seek out some sort of entertainment that did cost a little more then maybe they could go beyond what is normally spent for a Friday night concert and it would give them a little more leeway. - Ed Dickie said they are basically asking for $5,000 in this next fiscal years budget so it's not against the $6,600 and it would be up to $5,000. If the entertainment comes in at less than $5,000, there wouldn't be any more paid than what that bill comes in as. The entertainment budget could include the entertainer, some of the staging. The City would like it to be ongoing. This is a City event. We know it is going to be ongoing and we will have to ask for this every year. He said he would rather that they don't have to come back every year if it's not committed as an ongoing, starting 2016-17, then at least every budget we discuss it and decide what we want to do with the Swiss Days. - Tode Hafen asked when in the year they need to know if that is available or not because they obviously need to know for their planning. What is the time frame? - Lainee Frei replied that they have already secured their entertainment. They did that in January. - Tode Hafen asked if they are clear in their minds with sponsors. Do they have the opportunity to collect more. Are they maxed out when it comes to sponsors? - Brock Jacobsen, Assistant City Manager said that the hard thing is that somethings overlap. - Brooke Ence said that last year she didn't understand how the budget works and she thought it was more like money comes in that goes into our budget and it doesn't work that way. She said what they requested is that the budget be changed to better fit. - Brock Jacobsen said the budget increased this year. He said they are accommodating some of the issues and some of the costs have increased. He said they are trying to break even. He said they have set a goal as what they want to do sponsor wise and then with the entertainment we make up the difference. - Brooke Ence said they are always seeking out sponsors. She said they got more then they anticipated last year and most of those sponsors were pleased with the amount of advertising and exposure they got from Swiss Days and that it was a good sponsorship and she feels that most of those sponsors will be interested in doing it again. She thinks it can extend beyond that. - Mayor Rosenberg thanked Lainee and Brooke for their good work. - Susannah Nilsson said that this is under the Historical Society. She said she is the City's representative to the Washington County Historical Society. She has put together a 4-part historical and art program promoting Santa Clara. The Washington County Historical Society has already given her a grant of $1,000 and she is asking the Council to match that grant so that she can get this outreach program done this year. The first thing is already over with. It was done with the County money as well as some money that Brad gave her as well. It was the Birds and Botany down in the arboretum. It was a wonderful success. She said they had trail tours, a red-tail hawk, there were botany tours and their was a brochure. There was a lot of news exposure. The next thing she wants to do is on May 17. It is a Swiss paper-cutting workshop. A man from California who is internationally known paper-cutter will be coming. His name is Randall McGhee. This will be down at Heritage Square. This will involve the Daughters of the Utah Pioneers/Swiss Camp. Their members have committed to attend. She has given an invitation to the Washington County Historical and the Santa Clara Historical. They will be receiving supplies that they can take home to continue this as a hobby to renew some of the historical Swiss hobbies. She said she is working with the Walking Cactus Puppet Guild putting together a Swiss puppet show that will be put on. The 4th event will be a lecture by Paul Taylor who is an expert on the petroglyphs that are out at Anasazi Ridge possibly held at the Library or City Offices. She wants to be able to publicize these and pay the people that are doing these and that is why she is asking for the money. - Judith Kapuscinski stated that she chairs the Kayenta Arts Foundation and she wanted to give a brief summary of what they are requesting. Kayenta Arts Foundation was founded in 2011 as a way to coordinate many of the arts events that Kayenta development was asked to host in their outdoor theater and small room for thought. She said they were incorporated in 2011 and received their 501C3 recognition that same year. She said they started with no endowments and no money just a lot of hard work. She said one of their first goals was construction of an arts center. She said they have a building going up now. She said she would be happy to give the Council a tour of the building. She said their Rap application is seeking $3,000 a year for a minimum of 10 years. They are requesting that money for programming in and out of the center and for possible construction. She said their two festivals bring in an estimated 10,000 people through Santa Clara to Ivins. She said she thinks the existence of the center, The Center for the Arts at Kayenta, makes a full circle. She would like to have the discretion to use the $3,000 where needed. - Mayor Rosenberg asked how far along the construction of the building is. - Judith Kapuscinski said there is a building there and some of the windows are in. She said they are hoping to have a certificate of occupancy this summer but that won't mean it will be open for business. She said they have $861,000 invested in this building. She said they are looking for an additional $600,000 to bring it to completion and then $350,000 to outfit it. She said they have a capital campaign going on right now and part of that capital campaign is to raise another $600,000 for sustainability. She stated that they have a volunteer board of 10 members. She said they have 1 part time person, Kyle Lewis, as their creative director. She said they are also looking to engage a venue manager, someone who can take care of the building and have it rented. It is a arts center but can also be used for visual and performing arts or even weddings, dances, receptions and conferences. They are hoping to be ready for events by early 2017. She said they believe that the existence of the center will be a boom to the entire area. She also said that they have a youth outreach program going on right now. Especially the street painting festival. They have seminars on chalk art and street painting. They have met with the Washington County School Superintendent about identifying arts related needs in the County school age needs and have received some money from the Beasley Foundation to help support that. The Santa Clara schools have not participated. You can go to www.kayentaartsfoundation.org to see the winning schools and winning adults art on the website. - Jarett Waite asked if there were locals that attended their events. - Judith Kapuscinski said that in the past they have had counts an passed out bracelets to find out where people were from and 38 different states were represented and every city in the Southern Utah area. It does attract a good number of people. - Ed Dickie said that in the drop box there should be the application from the Difoure Center for Council's review. They are not in attendance. They are asking for a $10,000 grant from the Santa Clara City Rap tax program for generating operating expenses. - Mayor Rosenberg asked if they were planning on coming to the meeting. - Ed Dickie said he got the application at the last minute. He hasn't been able to talk to Ernie. He knew of the meeting. Ed said that he let him know he was welcome to come to the meeting. He said they are still working on the building. He said they are 90-99% done. - Mayor Rosenberg said the funding will mainly be used for general operating expenses and transition to the new location in Santa Clara. The building will be set up for performance type of events and part of it was going to be existing retail. - Ed Dickie said that they have 30 or more non-profits underneath them. He told the Council that these are the current applications. There are 3 for this fiscal year and 1 for the fall. He said he was hoping for some direction at this meeting so at the next meeting the Council can approve the funding. He said that Council could ask to take these applications and think about it more and the next meeting it will be more open and Council is going to have to decide then. He told Judith that the City is looking to adopt a resolution probably June 8 that is similar to Ivin's resolution that states funding would be allocated to local activities, entities or something that provides a positive economic something to the City. Whether Council feels like Judith meets those requirements there could be something for her. Council can address that. - Judith Kapuscinski said that there are a couple of ways they can affect the economics. People come through Santa Clara to get to Kayenta Arts Village and Santa Clara has shops and restaurants that can benefit from that traffic. The schools can benefit by participating not just in the street festival but in the youth outreach program. The more traffic that is brought to Ivins the more benefit Santa Clara will see. She said they have received $10,000 from the Washington County Rap funds and they have received a commitment of a minimum of $3,000 a maximum of $10,000 a year from Ivins for the next 10 years. - Ed Dickie said they are budgeting $14,000 but that can always change. He said they are confident they will have at least the $14,000 in next year's budget. - Mayor Rosenberg asked the Council if there was any discussion or if they had any views they wanted to share. - Tode Hafen said they should ponder this a little bit. All of them are worthy causes. - Mayor Rosenberg said that all of the candidates have merit. He said they may not be able to fund all of them 100% but they could all have some. He said he really likes the Historical Society one. It's a pretty good thing. He likes the opportunities that the Kayenta Arts Foundation is offering especially if they can get that educational outreach program going in our schools and they can get involved in it. It's an exciting facility to have here on the west side. - Tode Hafen said she is really interested in seeing the Difoure Center because it is in our community and we could boost them up. She said that she wishes that they had come to the meeting. - Ed Dickie said that he can invite him to come to City Council next week. - Jerry Amundsen said he thinks everything seems to be worthy and a benefit to the community especially if the students are involved. - Jarett Waite said the he has been thinking about long-term commitments and how we want to handle that with both Swiss Days and Kayenta Arts Foundation and we could get to a point where everything is pledged before the year even starts. He said he is a little hesitant to make long term commitments. - Mayor Rosenberg said that this first year the City wouldn't make any long term commitments so there is a year running to see what the revenue were. - Ed Dickie said that would be his recommendation too. Swiss Days is our event and we can see what we might want to throw at Swiss Days. This would be in the fall of each year. - Mayor Rosenberg said the thing that he feels pretty strongly about the Rap Tax, that in his mind, the Rap tax wasn't an economic driver. It is to provide resources and opportunities for the arts to expand. It becomes an opportunity to see the arts expand. - Tode Hafen said that is her feeling and she hates to see it all obligated because you don't know what is going to come up. - Ed Dickie said that by the next meeting he is going to need some numbers. He said that $1,000 will go to Susannah and that will leave $5,600. - Mayor Rosenberg said that right now he would like to split it and give Kayenta and the Difoure Center half each as a first year contribution and the Council will look at it again next year and not yet do an annual commitment. - Ed Dickie said the resolution has an opt out type thing if you are in to the commitment you can opt out depending on the situation. He said he would personally recommend that the City not do an ongoing unless it's a known. - Tode Hafen said she would like to see what Ernie has to say (the Difoure Center). 2. Fiscal Year 2016-17 Budget Update - Brock Jacobsen said the Council should have their budget books in their box. - Ed Dickie said that this is just a follow-up from the budget retreat. The public hearing will be set for June 8. That's when we will adopt the final tentative budget. There are some changes from the budget retreat. $75,000 was put in for streets. He believes $50,000 needs to go into the streets each year. He said they need to put a $20,000 match in for the Truman slide. It will come out of the contingency and admin. fund. He reviewed the General Fund budget highlights. Everything in highlights is in the budget. (See attached FY 2016-17 General Fund Budget Highlights.) The budget is balanced with 18.24% ($780,516) fund balance. - Jarett Waite asked about the 18.24%, is that the money that we're not going to use that will be sitting. - Ed Dickie said yes that is the fund balance that will carry over. That percentage is up to the Council. - Brock Jacobsen said that 25% is the maximum. A financially healthy city is somewhere around 11% range. - Ed Dickie said that this is the Council's budget and it's what they recommend. He said that he would like to see it get up to 25% and if it is healthy every year the rest goes. - Brock Jacobsen said at the budget retreat they need to develop a policy of where that percentage should be. - Mayor Rosenberg said he would like to get it up there as close as they can and let it hover there. - Ed Dickie stated the General Fund has a balanced with 18.24%, and an increase of $277, 635. We are getting a couple of big ticket items. We have come a long way and we feel really good about the budget. Next year is the time that the Council needs to decide on a range for an employee increase. Every three years that will come to Council. We are concerned about the storm fund. We will be okay. Maybe we should refinance that for 5 or 10 years. If we have to we can help it out with the General Fund. - Tode Hafen said the interest is so low that it probably shouldn't be refinanced. - Brock Jacobsen said they got it through State Bank and it's a matter of working with them to see what they have now. Most likely it's higher. - Ed Dickie said they are looking at some things and that might change in the next few days. He will let the Council know. He said that he didn't put aside the $25,000 for public transportation. He did talk to someone at SunTran. He can follow up with them to see if they will send some more information. He got the feeling from Council that they didn't want that in there. Maybe once our commercial is built out, it can come up again. - Brock Jacobsen went into more detail on the budget. The budget goes up $277,000. He went over the projects the City has going for the next year. (See the attached FY 2016-17 General Fund Budget Highlights.) He stated that the money from the binnies (recycle) will go to Veteran's Memorial and there has been some donations for the memorial. $48,000 has been budgeted for the memorial. - Brad Hays, Parks Director, stated that the design for the memorial is being donated and also we expect the amount of money coming in for the memorial to go up significantly once we advertise the sale of the bricks for the veterans. - Tode Hafen said that Veteran's Memorial has been on the agenda and talked about for a long time and there's been significant effort to try and get that done. - Ed Dickie said that the property across the street from City Offices is going to be grassed and made ready for Swiss Days. We want to have a long term nice plan done. One of the ideas that came up was to let the residents come up with some ideas of what they wanted to do on the upper part. Where the house is. Maybe a water feature or a splash pad, something simple. Or do we just put rocks and a waterfall. It would be good to get some ideas from the residents. We could rent the house. - Mayor Rosenberg said it could be subdivided and sold. - Ed Dickie said the back piece could become commercial. - Jarett Waite said that if the house is torn down, whatever we do on there is making it a couple of hundred thousand dollars more expensive than it would have been then if the City just bought raw land somewhere because we are throwing away the value of the house. - Jerry Amundsen said that at one time we talked about using some of the space for parking. - Ed Dickie said the upper part could be turned into parking. The bottom part is going to be sodded and ready for Swiss Days. Whatever happens on the upper part will have to be decided. He said the City is looking at property down by the Divoure Center and possibly making that public parking. - Jack Taylor stated that Herb Basso brought up paving a driveway between the property by his place. The Council needs to decide whether they should make this a City road or just lease the property to the property owners and let them take it over or sell it to them. There has never been a street sign on there. Right now there are two property owners. The Ence property could have a connection from the backside of it but they've got frontage on the next street over on Vernon. It's really not wide enough for a road. - Mayor Rosenberg said that Herb Basso feels like it is a road and he wants the City to pave it. Council needs to decide if that's a road the City wants. - Jack Taylor said it's about $6,000 to fix the storm drain and put asphalt. Whatever the Council wants to do. It's like a flag lot. He feels it should just be turned over to property owners. Mel and Herb have a prescriptive easement on it because they have been using it. - Jarett Waite says that sounds good to him. - Mayor Rosenberg said that landslide continues that way, will that be an access you want to use. Is that an irrigation right of way? - Jack Taylor said they cut most of that off because we went up Vernon Street and ran that pipe all the way up the street. He said give it to them and leave the City a right of way. - Ed Dickie said the Council is going to set a public hearing next Wednesday, May 11 and then the budget will be to Council June 8. 1. Staff Reports: Fire Chief Dan Nelson -Things have been steady. The crews have been keeping busy on projects. The seasonals are currently in Central and making good progress, good acreage. They are training with the Razor, it's up and running. The stokes basket is put in it and he will send pictures for the Council to see. The Council can go for a ride in it if they want. They are training on loading and off loading patients. This week they are doing gps training so they are bringing the South Hills Search and Rescue with their gps. They also did some training with the Hummer, driving skills and confidence course. The Council is welcome to come and drive that too. - Jarett Waite asked what kind of outreach program is being done with smoke detectors. Dan said they don't do much outreach with smoke detectors. He said they have talked with the American Red Cross to do some of that. They have smoke detectors that don't meet code requirements so they have talked about people who don't have smoke detectors that the Red Cross will install them for people. He said they did do a Facebook post from the National Fire Protection Association. If your smoke detector is older than 10 years, you need to replace it. - 80 plus kindergarten students did come through the Fire Station. They were from Santa Clara Elementary and earlier in the year students came through from Arrowhead Elementary. They watch a video, get to experience the hose, get plastic hats and crayons, and try on the fire coat and hat, and they go through the Fire Marshall's trailer. Some preschools also come. Brad Hays - Last City Council Meeting they brought the conceptual plan for the park in South Hills. That's part of the RP&P package that they are putting together. He said he is writing the narrative and the management plan for it and he would like to go forward with that plan independent of the change for the General Plan because there's other entities out there that want to apply for the RP&P and if he can get the City's in the order first, there is a better chance of getting it back sooner. There's the shooting range the County wants to put in and there's also something Virgin wants to put in. He met with the manager and real estate expert for BLM and that's what they are saying. If we want it to happen in a reasonable amount of time we probably better get it in soon. He said that tomorrow at the TRC they are bringing in the South Hills Plan to review it to bring it to Planning Commission and then bring it to Council. We are talking about looking at the entire South Hills area and not just the park area and bringing that forward to the Council so that we don't have to keep revisiting it. He said he found out some information about the High School race, the Utah race was going to be held in the South Hills this year but they could still hold it in Green Valley because the construction hasn't moved forward. He hasn't talked to MICA to find out if it is coming to Santa Clara for sure. He asked Council if they want it to come here. Should he push to have it come or wait another year? The State Director is whom he would talk to. We need to let people know ahead of time if it is coming. It is the first week in November. Ed Dickie said to get the word out on the newsletter. Brad said some of the residents might be a little resistant to it. The majority of the traffic will be only one day. Mayor Rosenberg told Brad to get his General Plan in motion. - Gubler expansion: the pickle ball courts are done, volleyball courts are done, soccer court is done, irrigation and curbs are in, landscaping is done. We are waiting for the contractor to put in a sidewalk for us. They will hopefully pour it tomorrow. Once that is done then Dustin and his crew can come in. Then the parks people can come in and do the landscaping. The park should be done by the tournament except maybe the landscaping. Brick fascia will go on the front of the maintenance building and there will be a block wall along the front and trees will be planted on one side. Jack Taylor - Guys are working on the substation. We've got the panels that go in the control building. We are just about completed with that project. Years ago Santa Clara put in a 12 inch line from Tuacahn Parkway through St. George by the ballparks and comes through some of the subdivisions and comes in at Lava Cove. Over the years, St. George has used that line. He said they came to him and said they don't want to use that line anymore and it has some problems. It probably needs to be replaced. They want Santa Clara to replace it or turn it off but there needs to be pressure down in Lava Cove. They want to purchase another line and take it over and maintain it. He suggested that St. George take of that 12 inch line and provide us water and maybe Santa Clara would be interested in selling them that other line. The Mayor may have to get involved in the meetings. They may have to meet with SunRise and Scott. He had SunRise put together a cost of what the line is worth. If it were brand new it would be worth about $140,000. Because of it's age it decreases to about $112,000 and then decreased due to Santa Clara's capacity that we are taking off the pipe would put it down to about $83,000. Mayor Rosenberg said to let him know if he needs to meet with them. - They have started the slurry seal and it looks really good. The village was half way done today. Lava Cove is taken care of. He has inspected it. - Highway 91 is on track. They will pave on May 10. They should have the bids on the lighting and the landscaping by Friday. There was a rough estimate on the lighting and it came to $315,000 for Ivins and us. We would be responsible for 6.7% of that. Ed Dickie - City Council Meeting will be cancelled for May 25 and there may be a Special Meeting on May 18. Neither Brock nor Ed would be able to be at that meeting on the 18th. Right now there isn't anything for the agenda. May 11 City Council meeting is fairly large. There are 8 or 9 items and there are also some presentations: the BLM presentation, Underground Railroad/Sex Trafficking Presentation, and the Southwest Water Pipeline. Kent Frei will also be there and there will be the CIB discussion about going for the CIB funds to pay for the match for the FEMA grant. We don't know if Herb Basso will be back. The public hearing about the budget also needs to be set on the 11th. Brad Hays said he could move the fee schedule to another meeting. The presenter's have already been rescheduled before. Maybe a call in could be done for Herb. Mayor Rosenberg asked Ed to take Kent Frei's item off the agenda and move it to May 18 and start the meeting on May 11 at 4:00 p.m. Ed said he will talk to the presenters and see if any of them would want to come at 4:00. - Ed said that he had another thought about the Swiss Days, instead of worrying about it, maybe we just should worry about it when we get the invoices in for the entertainment and bring that to a Council Meeting and see if Council wants to put any of the Rap Tax toward them. That way an amount isn't committed for each year. Mayor Rosenberg asked when the 2016-17 Rap application is going to be done. That will be at the end of the year. - The ice machine in the kitchen needs to be fixed. Ed will remind Corey. Tode Hafen said to also remind Corey that the podium needs to be repaired.
