MEETING MINUTES
MARCH 15, 2016
The Regular Meeting of the Board of the Washington County Commission was called to order by Chairman Alan D. Gardner at 4:00 p.m. on March 15, 2016, in the Washington County Commission Chambers, 197 East Tabernacle St. George, Utah. Those in attendance were Chairman Alan D. Gardner, Commissioner Victor Iverson, Commissioner Zachary Renstrom, County Administrator Dean Cox, Deputy County Attorney Eric Clarke, and Deputy County Clerk Nicholle M. Felshaw.

CONSENT AGENDA:
The Consent Agenda is a means of expediting routine matters which come before the Commission for approval. The Consent Portion of the agenda is approved by one (1) non-debatable motion. If any Commissioner wishes to remove an item from the Consent Portion of the agenda, then that item becomes the first order of business on the Regular Agenda.

MOTION: Motion by Commissioner Renstrom to Approve the Consent Agenda, with the Exception of the Application for Property Tax Abatement Account Number 692395, Which Shall be Considered on the Regular Agenda. Motion seconded by Commissioner Iverson and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
REGULAR AGENDA ITEMS FOR CONSIDERATION:
CONSIDERATION OF APPLICATION FOR PROPERTY TAX ABATEMENT ACCOUNT NUMBER 692395
MOTION: Motion by Commissioner Renstrom to Table the Application for Property Tax Abatement Account Number 692395 Until Further Information is Received from the Clerk Auditor's Office. Motion seconded by Commissioner Iverson and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
PRESENTATION: WASHINGTON COUNTY LOGO: KEVIN LEWIS
Washington County Sports and Outdoor Recreation Director Kevin Lewis gave a presentation on a new design concept to update and enhance the Washington County logo, which has been utilized for twenty (20) plus years. Mr. Lewis explained that as the County moves forward with branding the proposed logo is more versatile, would be more usable and offer a fresher look. Features in the proposed logo include: the Washington County name appearing more prominently, incorporating the same color and schemes that are in the current logo, and the ability to customize the logo by adding the various department names or facilities in the space provided under the Washington County name.
Chairman Gardner stated that Mr. Lewis did a good job creating the logo and incorporating the messaging of what the County offers.
Having already established individual unique branding logos, Commissioner Renstrom stated that the Habitat Conservation Plan (HCP), the County Library, the Sheriff's Office and the County Attorney's Office have asked to remain exempt from using the proposed logo at this time.

MOTION: Motion by Commissioner Iverson to Adopt and Move Forward with the Proposed Logo as the Official Washington County Logo. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
EMERGENCY SERVICES REPORT: DEPUTY DARRELL CASHIN
Washington County Deputy Darrell Cashin reported on Search and Rescue (SAR) efforts from February 17, 2016 through March 15, 2016, stating that there were eight (8) call outs for a total of 206 man hours.

Deputy County Attorney Eric Clarke clarified that at times the Tourism Office has the opportunity to take advantage of last minute advertising opportunities at discounted rates. However, in order to take advantage of these opportunities, contracts need immediate approval, thus those contracts come before the Commission for ratification.
All purchases are budgeted, bonded, or paid for through grant funds.
MOTION: Motion by Commissioner Iverson to Approve the Purchase Requests and Ratification of Purchase Requests as Presented. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF ADOPTING REVISIONS TO THE WASHINGTON COUNTY POLICIES AND PROCEDURES MANUAL
Washington County Administrator Dean Cox explained two (2) proposed revisions to the
Washington County Policies and Procedures Manual.
The first proposed revision does not affect the county policies and procedures manual, but only applies to the Washington County Road Department. It allows for Road Department Exigent Response Pay at a rate of time and a half when an employee is directed to report to work beyond the normal work schedule due to an immediate critical response.
The second proposed revision updates the Vehicle Policy, stating that a department head may conduct his/her own review without referring it to the Accident Review Board (ARB) for recommendations if it meets the following criteria: there is no personal injury or potential claim of injury; all property damage is confined entirely to property owned by the County; the total of all damage does not exceed $500; and the department head determines that the incident is isolated and does not reflect a pattern of other driving misbehaviors. If the guidelines have been met, the department head can then forward to the ARB a brief summary and supporting documentation of the incident and any corrective actions taken, with a recommendation that no further action be taken.
In addition, it was recommended that defensive driving courses be included as one of the actions that the ARB can recommend in the event that a County employee is in an accident involving a County vehicle or in doing County business.
MOTION: Motion by Commissioner Renstrom to Adopt the Revisions to the Washington County Policies and Procedures Manual as Outlined. Motion seconded by Commissioner Iverson and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION NO. R-2016-2008, A RESOLUTION APPOINTING MEMBER TO THE WASHINGTON COUNTY LIBRARY BOARD
Commissioner Iverson stated that Robert Goulding is willing to serve on the Washington County Library Board and will be a great asset to the Board.
MOTION: Motion by Commissioner Iverson to Adopt Resolution No. R-2016-2008, a Resolution Appointing Robert Goulding to the Washington County Library Board, Replacing Marilyn Richardson. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION NO. R-2016-2009, A RESOLUTION APPROPRIATING FUNDS TO ASSIST THE SHIVWITS BAND OF PAIUTES IN BUILDING A BIKE PATH ALONG OLD HIGHWAY 91
Elisabeth Whitlock, an Engineering Consultant for the Piute Indian Tribe of Utah stated that the Shivwits Tribe received a grant for safety funds through the Tribal Transportation Program. A proposed bike path along Old Highway 91 and a crossing at the convenience store will be constructed with the use of the funds. The Tribe is seeking additional funding from Washington County to allow the construction of a wider trail that will allow it to be more assessable to users. The County has also indicated the possibility of the Road Department assisting with a portion of the labor, such as extending a culvert and relocation of signage.
MOTION: Motion by Commissioner Renstrom to Adopt Resolution No. R-2016-2009, a Resolution Appropriating Funds to Assist the Shivwits Band of Paiutes in Building a Bike Path Along Old Highway 91. Motion seconded by Commissioner Iverson and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION NO. R-2016-2010, A RESOLUTION RATIFYING THE AGREEMENT FOR MUNICIPAL ADVISORY SERVICES BETWEEN THE COUNTY AND ZIONS PUBLIC FINANCE, INC.
Mr. Cox explained that the County engages in complex financial transactions from time to time, such as bonding and refinancing issues. During those transactions it is important for the County to have a competent financial advisor. Zions Bank has been the County's municipal financial advisor for many years and has assisted the County through several bonds. The County would like to continue working with Zions Bank and this agreement renews those services for a period of five (5) years.
MOTION: Motion by Commissioner Iverson to Adopt Resolution No. R-2016-2010, a Resolution Ratifying the Agreement for Municipal Advisory Services between the County and Zions Public Finance, Inc. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.

PUBLIC WORKS OR ROAD BUSINESS
No items were presented today.
COUNTY DEVELOPMENT AND PLANNING BUSINESS
Washington County Community Development Director Scott Messel explained that the Planning Commission met on March 8, 2016 and approved the Conditional Use Permit for the InfoWest facility in New Harmony. In addition, there were two (2) public hearings for proposed zone changes on Old Highway 91 near the Beaver Dam Wash and on the east side of Kolob Terrace Road. The Planning Commission recommended approval on both zone changes and will come before the County Commission at a future meeting for final ordinance approval.
HCP BUSINESS
Habitat Conservation Plan (HCP) Administrator Robert Sandberg explained that the HCP is still involved in applying for Section Six (6) grants. This included applying to the Utah Division of Wildlife Resources (DWR) for the Endangered Species Mitigation Funding (ESMF) and if approved, will support the efforts for a Section Six (6) grant. The HCP has also asked the DWR to apply to the U.S. Fish and Wildlife Service (FWS) for Section Six (6) funding. If both Section Six (6) grants are received, it will assist with the acquisition of the private in-holdings within the Reserve and will also add a parcel of property to Confluence Park.
To move the Long Valley exchange forward, the County has contracted with RCS Appraisal to appraise the Long Valley parcel of property as well as Robert Brennan's parcel in the Reserve. In addition, there have been two reviews on the environmental assessment draft that SWCA Environmental Consultants have written. The Bureau of Land Management (BLM) is comfortable posting it for public review once the latest additions/corrections are made.
