MONA CITY COUNCIL MEETING OCTOBER 27, 2015 7:30 PM MEETING WAS CALLED TO ORDER BY MAYOR GREG NEWTON PRESENT: Greg Newton - Mayor Molli R Graham - Council Member Jeffrey Hearty - Council Member Jonathan Jones - Council Member Frank L Riding - Council Member Jeffrey L Smith - Council Member GUEST: Myrna Trautvein - Times News Reporter Michelle Dalton - Secretary/ Treasurer, Everd Squire Director of Finance Lyla Spencer City Recorder, John Fairchild, Darian Christensen, Cody Christensen OPENING PRAYER: Councilmember Jonathan Jones APPROVAL OF OCTOBER 13, 2015 MINUTES: Councilmember Jeffrey Hearty made a motion to approve the minutes of October 27, 2015 as corrected. Councilmember Jonathan Jones made a second to that motion. The vote was unanimous. (1st Motion) DISCUSSION ITEMS: Juab County Sheriff's Department was not present for their update. John Fairchild of DWR presented the council with updated information on the Burraston Ponds Cooperative Agreement. Saying right now this should not be considered an agreement but just information. This agreement will be a three-way between DWR, Mona City and Juab County in order to reopen Burraston Ponds next year. Mona City will be responsible for hiring a part time host from March-September to assume the responsibilities of overseeing campground activities collect fees, limit camping to designated areas, post 'campground full' sign when no more spaces are available and maintain restroom facilities when installed by DWR, (including pumping). They will also notify the county sheriff or local CO when law enforcement is needed to enforce campground rules DWR will seek funding for improvements identified in the plan, cover the cost of garbage pick-up, cover the cost of portable restrooms (until replaced with vault toilets), stock ponds with catchable rainbow trout, collaborate with Nephi City on a community Fishing Program (fishing clinics for kids), and stock pen-reared pheasants during the upland game season (when funds available). Juab County will maintain all improved surfaces on the property (county road system, campground roads, and parking area) and provide law enforcement support. All parties will develop an operations and development plan for Burraston Ponds; provide links to camping information on websites. MONA CITY COUNCIL MEETING OCTOBER 27, 2015 7:30 PM The project monthly cost of current operations; Portable restrooms - 6 units @$90.00 = $540.00, Waste management - 3 dumpsters @95.00= $285 for a total of $825. Annual Cost - 7 months @$825 = $5,775.00. The council will put out some information on the Campground Host Position to see if there is interest in the community for such a position. John Fairchild told the council he has other options that the council may not like; and was hoping they could come to an agreement that evening or soon thereafter. One of the options would be bringing groups in such as the Boys Scouts and church groups. Mayor Newton is concerned about the campground being managed properly, and Councilmember Hearty had liability concerns. In answer to Councilmember Hearty's concern, John Fairchild assured him any agreement would protect all parties. Hearty then asked if they have similar agreements with other cities. John was not sure but he will check and get back with him. 'We do have this winter to work out the details' John said. Mayor Newton said they will discuss this as a council and come to a consensus and let him know. The Cooperative Agreement is attached and will become a permanent part of the minutes for public viewing. DIRECTOR OF FINANCE: Director of Finance Everd Squire presented the council members with the Disbursement Listing for Checking-dated 10/14/2015 to 10/27/2015. Everd asked if there were questions in reference to this report. He also noted checks over $2,000 must have an initial by each council member. There were questions on two checks; Check number 10017 issued to JAY MECHAM, in the amount of $1190, and Check number 10022 issued to ROTATIONAL MOLDING OF UTAH, in the amount of $2,237.50 There were five (5) checks over the allotted amount of $2,000. The report was approved by the council with no further questions or comments; the report is attached and will become a permanent part of the minutes for public viewing. SECRETARY/TREASURERS REPORT: City Secretary/Treasurer Michelle Dalton said there are issues with the ATV's and Go Carts especially on 400 South; according to the report there have been some close accident calls. She asked the council what can be done about it. The people who are interested in the house/home on 200 north the home that is being remolded. The people live in Provo at the present time and are looking to relocate to Mona. Michelle continued by telling the council they own rabbits and have about 150 of them. She asked the family what they do with the rabbits, their response was they sell them and later on they may be getting rats. Councilmembers wonder what the purpose of raising rats would be. Councilmember Hearty said the big question is what does our city ordinance says about rats and rabbits. RECORDERS REPORT: No Report Presented MONA CITY COUNCIL MEETING OCTOBER 27, 2015 7:30 PM PURCHASING POLICY: Councilmember Jeffrey Hearty presented the Mona City Purchasing Policy to the council and went over the proposed changes which are in highlighted form. Hearty said there is one on the first page of Article 3 A-1, and a larger one on page two, Article 3 B-2 and Article 3 B-5 with a noted typographical correction on B-5. After a brief discussion, Councilmember Jonathan Jones made a motion to approve Mona City's Purchasing Policy with the spelling correction as noted. Councilmember Molli Graham made a second to that motion, all were in favor and the motion carried. (2nd Motion) A copy of the Purchasing Policy is attached and will become a permanent part of the minutes for public viewing. COUNCIL BUSINESS: Councilmember Molli Graham presented the invoice from Country Garbage for the Fall Cleanup and was surprised and pleased at what the bill was for the time spent with the cleanup. People have been great about sorting the items she said. She is looking forward to the Spring Cleanup. Councilmember Jeffrey Smith told the council Charlotte will handle the street sweeper. Councilmember Jonathan Jones said 'When they adjusted council pay I mentioned a charge and I shouldn't have, and I didn't think it through very well.' Councilmember Jones continued by telling the council and those present, 'I was wrong in suggesting that we raise the pay to $35.00 to compensate for not having our water and garbage charges paid by the city.' He realized that he was being unfair to others council members. He was now suggesting that the council raise the monthly pay increase to $50 per council member. The city will add $50 to the $275 they are currently being paid for a total of $325. Councilmember Jones apologized for that. He said he has had a couple of inquiries in regard to the ATV Trail on the north side of the highway. The concerns are in reference to the ATV's on the highway especially at night without lights. They wanted to know if anything has been updated on the trail. The ATV signs have been placed along the highway. Has there been any discussion in regard to the Stevens' pond? The pond is not anywhere near the size it should be. This may be an issue they can resolve with their developer, but the responsibility lies on the Stevens. Nothing on the water rights. He was also wondering if the city is going to get the street sweeper again this year, he said this is something he would like to see done three times a year. Councilmember Smith told him the kids keep kicking rocks on the road with their ATV's and dirt bikes, until we get this under control it is going to be an ongoing problem for the city. It cost money each year to move the rocks off the road, but we have to keep the roads clean. Councilmember Hearty said, 'I think if tickets are being written, and money starts changing hands people will perk their ears.' Councilmember Jeffrey Hearty asked about the letter that he generated for Mayor Greg Newton; addressed to Cody Adams in regard to rocks on the City easement. The proposed letter states: Dear Mr. Adams, After fielding numerous complaints, we respectfully request that you remove the rocks from the City easement located on 550 East 100 North. These rocks have become a nuisance and a hazard to pedestrians and motorists. Please remove these rocks as soon as possible, if they are not removed within 14 days from the date of this letter, the City will MONA CITY COUNCIL MEETING OCTOBER 27, 2015 7:30 PM remove them and send you an invoice for the labor and equipment necessary for removal. If you have any questions, please contact the City Offices during business hours. The draft letter is attached and will become a permanent part of the minutes for public viewing. The city does have easement issues that will require more work, which they will talk about at a later date. Councilmember Frank Riding had nothing to report. Mayor Greg Newton ended the council session with a few important issues to address; he attended a CDBG meeting in Richfield during the week and went over the low/moderate Income Data for HUD income Limits - State of Utah. He brought the council's attention to Juab County's Very Low Income (30%), Low Income (50%) and Moderate Income (80%). The income chart is attached and will become a permanent part of the minutes for public viewing. Newton emphasized that there are two grants available for the city (Rural Development and the CDBG) to help those who are not connected to the sewer. He would like the city to apply for the CDBG again for the 2016 grant year. Mayor Newton said the CDBG application needs to be submitted by January 29, 2016. He encouraged the council to think about it until the next council meeting. Mayor Newton said if there is any way we can assist the low income people to connect to the sewer the city should look into it and apply for this grant. The council is trying to figure a way to get the information out to the residents of the city. First the city needs to hold a public hearing announcing the grant, give the dollar amount of the grant, and the purpose for the grant. A hearing will be scheduled the 27 of November for the CDBG grant. Mayor Newton will be attending a CIB meeting in Moab on November 5 at 8:00 A.M. in the morning. Newton said there is a water dilemma with a customer, in the amount of a water bill totaling $807 and suspects it may be a water meter reading glitch which should eventually correct itself. They are looking into it in a serious manner to make sure it is corrected. Mayor said he received a call from Kevin Stanley trying to get with different members of the Irrigation Company to go over the information the city gave them in regard to a CIB application which needs to be submitted by January 2016. He has asked the council if there is a possibility of doing another CIB application on that project, or do you want to hold off for awhile, and asked the council to ponder this issue until the next meeting. The last item Mayor Newton addressed to the council was in regard to the Boy's Home west of the city. He gave each councilmember a copy of the minutes of July 8, 2014 where Maddi Liebing from the Journey Blazing New Trails boy's home came before the council to protest and try to negotiate a bill which had accumulated in the amount of $2,000 because of a known water leak. Councilmember Jeffrey Hearty told Liebing at that July 8, 2014 meeting that the city take the average of the water bill for April, May and June of the previous year (2013) and charge that average. This in essence would be less than the $2,000 they were charged. Mayor Newton said he remembers it as written in the minutes of July 8, 2014. The issue for the Boy's Home said they are not using the culinary water from the city and they do not want to pay the $19.00 base fee, they are using the well at the home. Mayor Newton said if they are not using the culinary water they should not be billed for it. But his concern is; If the boy's home is connected to the well and to the culinary system at the same time, a cross connection could occur that could contaminate the culinary system. MONA CITY COUNCIL MEETING OCTOBER 27, 2015 7:30 PM Secretary Michelle Dalton asked if the boy's home would be reimbursed the $19 monthly fee since July 8, 2014, if they are not using the water. Councilmember Molli Graham had a concern as well; her concern was whether or not a home inside the city limits could be on well water. She wondered if the city had a requirement if a residence or business was within so many feet of the culinary line they had to connect. Councilmember Jones said, 'Depending on how many people they are serving at the boy's ranch, well water may not be permitted use.' Councilmember Jones said the council will have to do some research to find out exactly what their ordinance spelled out for the use of well water inside a city. He also said there may be health and safety issues for using well water at a facility that is used to house a larger group of people than would be at a residence. FYI: There were three (3) motions voted upon and passed; a motion to approve the minutes of October 13, 2015, a motion to approve the Mona City Purchasing Policy, and a motion to pay the finances and adjourn this meeting of October 27, 2015. There were no further motions voted upon and passed. PAY FINANCES AND ADJOURNMENT: Councilmember Jeffrey Hearty made a motion to pay the finance, adjourn and move into executive session. Councilmember Jonathan Jones made a second to that motion. The vote was unanimous; the meeting was adjourned at 9:13 p.m. with no further comments. (3rd Motion) EXECUTIVE SESSION, IF NECESSARY: An Executive session was called at 9:23 p.m by Councilmember Molli Graham and conducted by Mayor Greg Newton. The purpose for the session was to hold a strategy session to discuss pending imminent litigation Those in attendance were; Mayor Greg Newton, City Recorder Lyla R Spencer, Councilmember's Molli Graham, Jeffrey Smith, Jonathan Jones, Jeffrey Hearty, and Frank Riding. Councilmember Molli Graham made a motion to close the executive session; Councilmember Jeffrey Hearty made a second to that motion.
