MONA CITY COUNCIL MEETING AUGUST 11, 2015 7:30 PM MEETING WAS CALLED TO ORDER BY MAYOR GREG NEWTON PRESENT: Greg Newton - Mayor Molli R Graham - Council Member Jeffrey Hearty - Council Member - Absent Jonathan Jones - Council Member Frank L Riding - Council Member Jeffrey L Smith - Council Member GUEST: Myrna Trautvein - Times News Reporter - Michelle Dalton - Secretary/ Treasurer, Everd Squire Director of Finance ,Lynn Ingram-Planning & Zoning, Allen Pay Water Superintendent, Lyla Spencer City Recorder, Katrina Long, Trevor Woods, Jerolyn Smith - USDA Rural Development OPENING PRAYER: Councilmember Jeffrey Smith APPROVAL OF JULY 28, 2015 MINUTES: Councilmember Jeffrey Smith made a motion to accept the minutes of July 28, 2015 as written, Councilmember Jonathan Jones made a second to that motion. The vote was unanimous. (1st Motion) PLANNING AND ZONING: Planning and Zoning Chair Lynn Ingram told the council they had Jeff Kay come in for an Accessory Building Permit for an out building for Jason LeWellya at 722 S 67 W adding, that Jason wants to build a shop out behind his house. Ingram presented the plans that Kay brought in for the council to view, saying the building inspector has looked at them and they have been approved, and signed off. Ingram said they talked with him about the setback to make sure the drip line is 5' from the property line, and he is aware of that issue. Ingram said Planning and Zoning would like to make recommendation for this outbuilding/shop for Jason LeWellya at 722 S, 67 West. Councilmember Jonathan Jones made a motion to accept a building permit for an outbuilding/shop at 722 S 67 West for Jason LeWellya, councilmember Molli Graham made a second to that motion. Jeff Kay will be the contractor. Motion carried. (2nd Motion) Lynn continued by telling the council that Trevor and Nicole Woods came in a month ago for a building permit for Country Living Estates and they have been waiting on the culinary water, and now have the deed. Culinary water will be culinary credits from Carlene Ingram. The water is at the state engineers and they haven't received anything back from the state, and until they receive something back from the state we cannot issue a building permit. Once the trade is made to get the culinary credits, and until that happens we cannot issue a building permit. Lynn Ingram said it is water that is already in the well, and Carlene Ingram wants to get culinary credits all at one time. Councilmember Jones said he will talk with Carlene, find out what her plans are, he thinks it would make more sense for her to keep the water rights and then she will have more flexibility if they get turned over to the city. Ingram said they have the certificate for the irrigation water, it is the culinary they are waiting for. If we can get it before next council meeting we can approve it then said Lynn Ingram. Ingram continued by saying they had some property owners come in; Marlin Park came in and talked about some zoning for multiple family dwellings and asked about doing some lot splits on property they own at 300 E. He will get a concept plan so they will have a better idea of what he is talking about. MONA CITY COUNCIL MEETING AUGUST 11, 2015 7:30 PM MEETING WAS CALLED TO ORDER BY MAYOR GREG NEWTON Janae Kay came in and talked about some survey boundaries on the north side of High Meadows. He said he counseled her that the city cannot get involved with boundary disputes, and they will need to solve the issue between the family. DISCUSSION ITEMS: Juab County Sheriff's Department was on the agenda but not present for their report. Jerolyn Smith Rural Development Specialist representing the USDA, came before the council explaining their program that the Federal Government offers, which can assist those who qualify and that have not connected to the sewer. Jerolyn stressed; this a program that has to be for the very low income residents, and added especially the elderly citizens living on Social Security, they qualify very easily. She said there is some grant money, and connecting to the sewer is an eligible expense. Jerolyn handed out three packets to be used by the city. Applications will be required to contain the following: 1. Application for Rural Housing Assistance (Form 410-4) is completely filled out. This includes complete addresses, phone numbers, household income information and signatures where requested. 2. Complete the Household Financial Statement and Budget Form (1944-3) Complete this in pencil. 3. Copy of most recent Federal Income Tax return, signed. (if applicable) 4. Copy of Deed of Trust or Real Estate Mortgage. 5. Copy of most recent award letter from Social Security and any other source of income. 6. Most recent County tax notice showing the value on your home and ownership. 7. Copy of most recent bank statement or current bank printout for all accounts. 8. 3 bids for the work you would like to have completed from licensed contractors. When all items are completed and collected, please call our office to make an appointment (435-283-8004 X4) or mail the requested information to: USDA Rural Development 5 South Main, Suite 202 Ephraim, UT 84627 Also included in the hand out is an income guideline for the 504 Loans for Sanpete, Millard, and Juab counties. For the complete information packet please refer to the city office. City Recorder Lyla Spencer will confidentially assist those citizens wanting to apply for the loan/grant. Information will be added to the cities website on how to apply for the loan or grant. Jerolyn told the council there are other loans available for home repairs for those families who qualify. MONA CITY COUNCIL MEETING AUGUST 11, 2015 7:30 PM MEETING WAS CALLED TO ORDER BY MAYOR GREG NEWTON SECRETARY REPORT: Michelle said Cody Fowkes came in for a fence permit and is installing a wooden fence along the back of his property, it is 36' high located at 61 S 100 W. It is not a corner lot and has met all the requirements. She said she is not sure what to do now, does she need to call someone. DIRECTOR OF FINANCE: Director of Finance Everd Squire presented the council members with the Disbursement Listing for Checking-dated 7/29/2015 to 8/11/2015. The council reviewed the report, and Everd asked if there were questions on the checks in reference to this report. There were questions on three (3) checks: check number 9827 issued in the amount of $206.00 to Mona Veteran's Memorial, and check number 9859 in the amount of $4,352.14, also issued to Mona Veteran's Memorial, and check #9862 in the amount of $150.00, issued to Zeak Woodland. The questions were sufficiently answered. Everd noted checks over $2,000 must have an initial by each councilmember. There were two (2) checks over the allotted amount of $2,000. The report was approved by the council with no further questions or comments, and is attached and will become a permanent part of the minutes for public viewing. RECORDERS REPORT: City Recorder Lyla Spencer gave an update on the code book encouraging the council by telling them it is now in the final stages, and should be shipped by the end of the third week of August. Per Rob Rawlings at Sterling: 'My goal would be to ship the codes the end of the 3rd week of August. Once shipped, I will also email you an adopting ordinance so that you can officially adopt the code'. Spencer reminded the council of her upcoming annual conference to be held in Logan Utah September 23rd through September 25th, and is hopeful the council will approve the conference fees. Water Master Allen Pay had concerns on the draft form of the Resolution to amend 9-2B for the code book. Allen thinks as the draft is currently written, it will confuse people even more. Mayor Newton wants something in place to cover the city if needed, so there are no questions, and added we can amend the resolution as many times as we want to make it right. Mayor Newton asked Pay to come forward and address and discuss his concerns on the 9-2B draft. Pay said, 'I think all you really need to do is require that there is an outdoor irrigation system that is equivalent to an acre foot of water to cover our one acre foot of our ERC that is dedicated for outdoor use so they're not on the culinary system, they have to have an irrigation system, that's the critical issue.' Pay continued by saying, 'As far as going through and requiring a quarter share, that's nothing to do with us, that's in the 3-Way Agreement with Everd's entity. If they put together an irrigation system, I hope they come up with an irrigation system to cover High Meadows, we don't want to limit them, and if they come up with one acre foot, that's all we can require.' 'Otherwise you're changing your requirements.' He said, 'Culinary is measured in an acre foot, not shares.' There were some changes on the draft as currently drawn up. Pay feels the changes on the draft will simplify it for the people. Resolution 9-2B was rewritten as per draft copy which is attached and will become a permanent part of the minutes for the public to view. Mayor Newton will get it to everyone with the changes attached. . MONA CITY COUNCIL MEETING AUGUST 11, 2015 7:30 PM MEETING WAS CALLED TO ORDER BY MAYOR GREG NEWTON Mayor Newton talked briefly in regard to the Initial Development Plan that is in a Draft form for Burraston Ponds WMA, Operations and Development Plan from the DWR. He told the council he has been working with Sara Samuelson to see if the city can make their website capable of doing the regulations. Samuelson said she could probably do that, but the software may be a little expensive. Mayor Newton asked John from the DWR if he would check with parks to see how they do theirs, and possible they would have some software to share. He said that is one concern he had, wondering if it would be feasible. Mayor Newton told the council the best thing they can do is put some homework into it rather than try and decide something that night. Newton would like to see their own ideas put into the draft and they will discuss it with the DWR at the next council meeting on the 25th of August . The DWR came up with three Goals written on the draft: 1. Protect fish and wildlife habitat. 2. Strengthen citizen involvement in the proper stewardship of Burraston Ponds WMA 3. Enhance the wildlife recreation experience at Burraston Ponds. The draft for Burraston Ponds WMA is attached and will become a permanent part of the minutes for public viewing. Mayor asked Michelle if anyone had responded to their RFP, Michelle replied by telling the council no one had called or asked questions. Newton presented the Hold Harmless Agreement for private mowing in the city. The agreement is attached and will become a permanent part of the minutes for public viewing. COUNCIL BUSINESS: Councilmember Molli Graham told the council Charlotte called her and was wondering what she should do with the crosses that are stored in the shed. Mayor Newton said they can be stacked on each other. He will get them out of the way. Council member Graham had a dog complaint where a little girl was hurt. The sheriff's department was called, the party received a citation and a warning, it is all documented and she would like to have it documented on the cities side. Councilmember Jeffrey Smith told the council the cross walks will be repainted for free, the city was not happy with the job that was originally done, they were not done according to the cities specifications. The company that had originally painted the walks called the city and said they would come down and redo the walks free. Councilmember Jonathan Jones told the council there is nothing on the water rights. He has started some discussion with Jay Mecham on the recycling program, he said Randy McKnight from Nephi City is trying to get something going, and the key is to get several communities together so they can make it manageable. He is talking about cardboard and plastic which is filling up the landfill. Councilmember Jeffrey Hearty was not present for a report. Councilmember Frank Riding told the council six have signed up for the ATV class to be held on August the 26. Planning Chair Lynn Ingram told the council the ATV trail on Highway 54 leading to the freeway has been approved. They will be installing the designated signs for the trail. Mayor Newton ended the session by giving a report on the Beehive Drive Auto Show. They awarded the scholarship recipient Tyler Ingram $5,000. They will be awarding two smaller scholarships in the future, one will go to a recipient in the medical field and the other will go to a recipient in the dental field. . MONA CITY COUNCIL MEETING AUGUST 11, 2015 7:30 PM MEETING WAS CALLED TO ORDER BY MAYOR GREG NEWTON The city was awarded $2,000 which was designated for public use; it will go to the Veteran's Memorial. FYI: There were three (3) motions voted upon and passed; a motion to approve the July 28, 2015 minutes, a motion to approve a building permit for Jason LeWellya, and a motion to pay the finances and close this meeting of August 11, 2015. There were no further motions voted upon and passed. PAY FINANCES AND ADJOURNMENT: Councilmember Jonathan Jones made a motion to pay the finances and adjourn and go into executive session. Councilmember Molli Graham made a second to that motion. The vote was unanimous; the city council meeting was adjourned at 8:54 p.m. with no further comments, The council then moved into executive session. The minutes will be added to the city records as written. EXECUTIVE SESSION, IF NECESSARY: An Executive session was called by Mayor Greg Newton and conducted by Mayor Greg Newton at 8:56 p.m. The purpose for the meeting: to hold a strategy session to discuss pending or reasonable imminent litigation. Those in attendance were; Mayor Greg Newton, City Recorder Lyla R Spencer, Councilmember's Molli Graham, Jeffrey Smith, Jonathan Jones, and Frank Riding. Councilmember Jeffrey Hearty was not in attendance. Councilmember Jonathan Jones made a motion to close the executive session with councilmember Molli Graham making a second to the motion.
