WASHINGTON COUNTY COMMISSION MEETING MINUTES APRIL 21, 2015 The Regular Meeting of the Board of the Washington County Commission was called to order by Chairman Alan D. Gardner at 4:00 p.m. on April 21, 2015, in the Commission Chambers, Washington County Administration Building, St. George, Utah. Those in attendance were Chairman Alan D. Gardner, Commissioner Zachary Renstrom, County Administrator Dean Cox, Deputy County Attorney Eric Clarke, and Deputy County Clerk Nicholle M. Felshaw. Commissioner Victor Iverson was excused from the meeting, as he was out of town on County business. Motion seconded by Chairman Gardner and carried by unanimous vote, with Commissioners Gardner and Renstrom voting aye. REGULAR AGENDA ITEMS FOR CONSIDERATION: EMERGENCY SERVICES: SHERIFF CORY PULSIPHER Washington County Sheriff Cory Pulsipher reported eleven (11) Search and Rescue (SAR) efforts from March 17, 2015 through April 21, 2015, for a total of 250.5 man hours this report. (See attached report for additional details) Sheriff Pulsipher also discussed the upgrade to the medical services that the Sheriff's Office has through SAR as well as with the full-time employees. Deputy Darrell Cashin explained that it has taken approximately one (1) year to submit paperwork for the Sheriff's Office to become licensed as a medical provider for the State of Utah. This allows SAR to expand its capabilities, allowing significant benefits to the community. The agreement that the Commission approved allowing Dr. Bradley J. Crosby to become the Sheriff's Office Medical Director was a contributing factor in obtaining the license. While attending the State Medical Directors Convention, Dr. Crosby was informed that the Emergency Medical Services (EMS) license obtained by the Sheriff's Office is one (1) out of two (2) models in the Western United States and the State Bureau of EMS is closely following the way that EMS has been integrated within SAR so other SAR's seeking a license will have a guideline to follow. CONSIDERATON OF PURCHASE REQUESTS: MARK BLANCH CONVENTION & TOURISM (3) Convention and Tourism Office, annual contract/TV advertising in So Cal ($225,000.00) Convention and Tourism Office, program ads: Denver CO/CO Avalanche ($18,000.00) Convention and Tourism Office, ads: Denver Nuggets/Broncos & CO Avalanche... ($21,000.00) All purchases are budgeted, bonded, or paid for through grant funds. MOTION: Motion by Commissioner Renstrom to Approve the Purchase Requests. Motion seconded by Chairman Gardner and carried by unanimous vote, with Commissioners Gardner and Renstrom voting aye. CONSIDERATION OF ORDINANCE NO. 2015-1049-O, AN ORDINANCE ADOPTING THE CURRENT INTERNATIONAL BUILDING, MECHANICAL, FUEL GAS, RESIDENTIAL, FIRE, ENERGY CONSERVATION, AND PLUMBING CODES AND THE 2011 NATIONAL ELECTRICAL CODE ALL AS ADOPTED BY THE STATE OF UTAH Deputy Washington County Attorney Eric Clarke explained that every four (4) years the uniform building codes are updated and adopted by the State of Utah. The counties and cities then adopt the State building codes to ensure uniformity of building and construction standards. This amendment to the county code will ensure that the county is always in compliance with the codes adopted by the State of Utah. MOTION: Motion by Commissioner Renstrom to Adopt Ordinance No. 2015-1049-O, an Ordinance Adopting the Current International Building, Mechanical, Fuel Gas, Residential, Fire, Energy Conservation, and Plumbing Codes and the 2011 National Electrical Code All as Adopted by the State of Utah. Motion seconded by Chairman Gardner and carried by unanimous vote, with Commissioners Gardner and Renstrom voting aye. CONSIDERATION OF RESOLUTION NO. R-2015-1903, A RESOLUTION APPROVING THE MASTER AGREEMENT BETWEEN BUREAU OF LAND MANAGEMENT ST. GEORGE FIELD OFFICE AND WASHINGTON COUNTY COMMISSION Washington County Administrator Dean Cox stated that Washington County has a Habitat Conservation Plan (HCP) and is currently in the process of facilitating complex real estate transactions between the Bureau of Land Management ('BLM') and private property owners. The BLM would like to enter a cost sharing agreement with Washington County to fund real estate specialist position for the BLM. Under the agreement Washington County will pay up to fifteen thousand dollars ($15,000) a year for three years towards the position. The BLM will contribute the remaining cost. MOTION: Motion by Commissioner Renstrom to Adopt Resolution No. R-2015-1903, a Resolution Approving the Master Agreement Between Bureau of Land Management St. George Field Office and Washington County Commission. Motion seconded by Chairman Gardner and carried by unanimous vote, with Commissioners Gardner and Renstrom voting aye. CONSIDERATION OF RESOLUTION NO. R-2015-1904, A RESOLUTION APPROVING THE EXECUTION OF AN AGREEMENT BETWEEN CRSA, INC. AND WASHINGTON COUNTY TO PERFORM ARCHITECTURAL SERVICES FOR A PROGRAM AND FEASIBILITY STUDY CONSIDERING THE CONSTRUCTION OF A NEW COUNTY ADMINISTRATION BUILDING Mr. Clarke stated that terms are still being negotiated and asked the Commission to table the Resolution. MOTION: Motion by Commissioner Renstrom to Table Resolution No. R-2015-1904, a Resolution Approving the Execution of an Agreement Between CRSA, Inc. and Washington County to Perform Architectural Services for a Program and Feasibility Study Considering the Construction of a New County Administration Building. Motion seconded by Chairman Gardner and carried by unanimous vote, with Commissioners Gardner and Renstrom voting aye COMMISSIONERS' REPORT Commissioner Renstrom stated that a meeting was held with several leaders in the community along with Site Select concerning Economic Development. There will be an on-going discussion regarding Washington County's role in economic development in the county. PUBLIC WORKS OR ROAD BUSINESS Public Works Director Ron Whitehead stated that due to individuals getting stuck on Kolob Road, a sign will be placed stating that the road is closed, until such time that the snow melts. The Natural Resources Conservation Service (NRCS) flood repair projects are nearing completion. Mr. Whitehead also mentioned that the Washington County Flood Control Authority sent an application to the Utah Board of Water Resources asking for assistance to rehabilitate the Warner Draw, Stucki and Gypsum Wash Debris Basin Dam's. A letter was received stating that if the Utah Board of Water Resources votes to fund the project, a project feasibility report will be sent along with a summary letter explaining the steps in receiving state money for engineering, construction, and other expenses. Mr. Whitehead continued stating that estimates have been received from a branch within NRCS explaining that it will take approximately six and a half million dollars ($6.5 million) to complete the work, with the Flood Control District being responsible for a thirty five percent (35%) match. NRCS has received funding for their portion of the projects. To help pay for the thirty five percent (35%) match, Washington County Flood Control Authority has applied to the Utah Board of Water Resources. This year the legislature appropriated monies for the Utah Board of Water Resources to help off-set costs to the Flood Control District. COUNTY DEVELOPMENT AND PLANNING BUSINESS: SCOTT MESSEL Washington County Community Development Director Scott Messel reviewed the following item that was approved from the April 14, 2015, Planning Commission Meeting: CONDITIONAL USE. Request for a wireless telecommunication site for AWI Networks on a portion of Parcel 7126-1-NW, which is located at approximately 1089 East Baker Dam Road. Zoned OST-20 (Open Space Transition 20 acre minimum lot size requirement). The applicant is Monte Holm/AWI Networks. HCP BUSINESS Habitat Conservation Plan Administrator Robert Sandberg stated that anytime the State proposes to acquire private property, it is required that the State coordinate with the County as well as obtain approval from the Governor. Recently, notification was received from the State that the Governor approved the acquisition of eleven point four (11.4) acres in the Middleton area that is currently owned by the Virgin River Land Preservation Association. Approval will also be necessary from the Fish and Wildlife Service due to the acquisition being funded through Section Six (6) of the Endangered Species Act.
