MEETING MINUTES
APRIL 7, 2015
The Regular Meeting of the Board of the Washington County Commission was called to order by Chairman Alan D. Gardner at 4:00 p.m. on April 7, 2015, in the Commission Chambers, Washington County Administration Building, St. George, Utah. Those in attendance were Chairman Alan D. Gardner, Commissioner Victor Iverson, Commissioner Zachary Renstrom, County Administrator Dean Cox, Deputy County Attorney Eric Clarke, and Deputy County Clerk Nicholle M. Felshaw.

Chairman Gardner mentioned that the Invocation is new to the Commission Meetings and anyone interested in participating should contact the Interfaith Council who is coordinating these efforts. Also, a veteran will be invited to each Commission Meeting to lead the Pledge of Allegiance.
CONSENT AGENDA:
The Consent Agenda is a means of expediting routine matters which come before the Commission for approval. The Consent Portion of the agenda is approved by one (1) non-debatable motion. If any Commissioner wishes to remove an item from the Consent Portion of the agenda, then that item becomes the first order of business on the Regular Agenda.

REGULAR AGENDA ITEMS FOR CONSIDERATION:
VOLUNTEER OF THE MONTH: BONNIE HALLMAN
Retired Senior Volunteer Program (RSVP) Coordinator for Five County Association of Governments, Bonnie Hallman recognized Lillian Zielke who has been volunteering at the Dinosaur Discovery Museum for the past fifteen (15) years and was present in 2000 when the first discoveries at the site occurred. Besides volunteering at the Dinosaur Museum, Lillian also volunteers at the Cox Auditorium, Eccles Center, Tuacahn, and the St. George Music Theater.
CONSIDERATION OF RESOLUTION NO. R-2015-1896, A RESOLUTION PROCLAIMING APRIL 7, 2015, AS NATIONAL SERVICE RECOGNITION DAY IN WASHINGTON COUNTY
Chairman Gardner asked Ms. Hallman to read aloud the Resolution Proclaiming April 7, 2015 as National Service Recognition Day in Washington County.
MOTION: Motion by Commissioner Iverson to Adopt Resolution No. R-2015-1896, a Resolution Proclaiming April 7, 2015, as National Service Recognition Day in Washington County. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson, and Renstrom voting aye.
PRESENTATION OF VICTIM RIGHTS: KIMBERLY FRY
Washington County Victim Services Coordinator, Kimberly Fry spoke about victim rights and how the Children's Justice Center provides a safe environment for children to be interviewed that have either been sexually or physically abused. She expressed that the Children's Justice Center served over two hundred and seventy five (275) children last year.
Currently, there is a program available called the Victim's Information Notification Everyday (VINE). This program is an automated service and tracks the custody status of offenders in jail or in prison via the phone or internet. It also allows an individual to be notified by phone or email of the status of an offender.
In light of April being Child Abuse Awareness Month, Ms. Fry handed out pinwheels from the Children's Justice Center which represented Child Abuse Prevention Month.

Chairman Gardner asked County Administrator Dean Cox to read aloud the Resolution Proclaiming April as Child Abuse Prevention Month in Washington County.

Washington County Deputy Attorney Eric Clarke clarified that half of the World Triathlon Corporation 2015 event rights fees is paid with State Funding. The County's half is paid by proceeds from restaurant and hotel room taxes.
All purchases are budgeted, bonded, or paid for through grant funds.
MOTION: Motion by Commissioner Iverson to Approve the Purchase Requests. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF ORDINANCE NO. 2015-1048-O, AN ORDINANCE ADOPTING THE 2006 UTAH WILDLAND URBAN INTERFACE CODE
Utah State Fire Marshal Chief Deputy Ted Black explained that this update to the Wildland Urban Interface Code clarifies the definition of an approved road and gives guidance on small structures.
MOTION: Motion by Commissioner Iverson to Adopt Ordinance No. 2015-1048-O, an Ordinance Adopting the 2006 Utah Wildland Urban Interface Code. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION NO. R-2015-1895, A RESOLUTION APPOINTING/RE-APPOINTING MEMBERS TO THE WASHINGTON COUNTY LIBRARY BOARD OF DIRECTORS
Mr. Clarke stated that this is the legislative body for the library system. It sets policy, meets regularly with the Library Director, and recommends the budget to the County Commission. This Board has term limits and traditionally a Commissioner has been appointed to the Board.
MOTION: Motion by Commissioner Renstrom to Adopt Resolution No. R-2015-1895, a Resolution Appointing Commissioner Zachary Renstrom and Re-Appointing Sidney Atkin to the Washington County Library Board of Directors. Motion seconded by Commissioner Iverson and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION NO. R-2015-1898, A RESOLUTION APPOINTING BOARD MEMBERS TO THE RAP DISBURSEMENT ADVISORY BOARD
Mr. Cox explained that he and Commissioner Iverson considered the applicants to this new county board and recommend the appointments of Gary Sanders, Todd Jones and Douglas Caputo (to be appointed with terms to expire December 31, 2016) and Summer Robertson, Allison Hunt, Clyde Johnston, and Richard Kohler (to be appointed with terms to expire December 31, 2018).
Commissioner Iverson mentioned that the committee is well balanced with a variety of life experience and appreciation for the arts and community.
MOTION: Motion by Commissioner Iverson to Adopt Resolution No. R-2015-1898, a Resolution Appointing Gary Sanders, Todd Jones, Douglas Caputo, Summer Robertson, Allison Hunt, Clyde Johnston, and Richard Kohler to the RAP Disbursement Advisory Board. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION NO. R-2015-1899, A RESOLUTION REAPPOINTING BOARD MEMBERS TO THE WASHINGTON COUNTY PLANNING COMMISSION
Chairman Gardner stated that it has been recommended to re-appoint Joann Balen and Michael Stucki to the Washington County Planning Commission with terms to expire January 31, 2017, and Rick Jones, Kim Ford and Douglas Wilson to be re-appointed with terms to expire January 31, 2018.
MOTION: Motion by Commissioner Renstrom to Adopt Resolution No. R-2015-1899, a Resolution Re-Appointing Joann Balen, Michael Stucki, Rick Jones, Kim Ford, and Douglas Wilson to the Washington County Planning Commission. CONSIDERATION OF RESOLUTION NO. R-2015-1900, A RESOLUTION APPROVING A PUBLIC DEFENDER AGREEMENT BETWEEN JOSEPH FARNSWORTH AND WASHINGTON COUNTY TO PROVIDE PUBLIC DEFENSE SERVICES FOR INDIGENT DEFENDANTS IN THE FIFTH JUDICIAL JUVENILE COURT OF WASHINGTON COUNTY AND THE FIFTH JUDICIAL DISTRICT COURT
Commissioner Renstrom stated that he has worked with Mr. Farnsworth in the past and appreciated his high caliber of work and endorses Joseph Farnsworth as the new Juvenile Public Defender.
MOTION: Motion by Commissioner Renstrom to Adopt Resolution No. R-2015-1900, a Resolution Approving a Public Defender Agreement Between Joseph Farnsworth and Washington County to Provide Public Defense Services for Indigent Defendants in the Fifth Judicial Juvenile Court of Washington County and the Fifth Judicial District Court. Motion seconded by Commissioner Iverson and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION NO. R-2015-1901, A RESOLUTION APPROVING MEDICAL DIRECTOR SERVICES AGREEMENT BETWEEN WASHINGTON COUNTY AND BRADLEY J. CROSBY, M.D., REGARDING MEDICAL DIRECTOR SERVICES FOR THE WASHINGTON COUNTY SHERIFF'S OFFICE EMS PROGRAM
Mr. Cox stated that Washington County routinely conducts Search and Rescue (SAR) operations. There are EMS certified individuals with SAR and the Sheriff's Office who can often provide the critical edge for individuals in need of the County's help. Mr. Crosby is capable of training and assisting volunteers and others in keeping certifications current. In order to qualify as a sanctioned EMS organization, the County has to have a medical director on staff that can approve the protocols and medications that might be dispensed. This contract has been established for a year, has worked.

Crosby, M.D., Regarding Medical Director Services for the Washington County Sheriff's Office EMS Program. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION APPROVING AN AGREEMENT BETWEEN THE BUREAU OF LAND MANAGEMENT (BLM), ROBERT BRENNAN AND WASHINGTON COUNTY, TO INITIATE A LAND EXCHANGE FOR PROPERTY IN RED CLIFFS DESERT RESERVE AND LONG VALLEY
Habitat Conservation Plan Administrator Robert Sandberg explained that this resolution and the succeeding resolution deal with the county's facilitation of the federal government acquiring private property inside the Red Cliffs Desert Reserve. The County has been working with the Bureau of Land Management (BLM) in facilitating a land exchange. The process with the BLM is lengthy, and the BLM is not ready for the Commission to take any action on either resolution at this time.
MOTION: Motion by Commissioner Iverson to Table Resolution Approving an Agreement Between the Bureau of Land Management (BLM), Robert Brennan and Washington County, to Initiate a Land Exchange for Property in Red Cliffs Desert Reserve and Long Valley. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
CONSIDERATION OF RESOLUTION APPROVING A REAL PROPERTY DONATION AGREEMENT BETWEEN ROBERT BRENNAN AND WASHINGTON COUNTY

MOTION: Motion by Commissioner Iverson to Table Resolution Approving a Real Property Donation Agreement Between Robert Brennan and Washington County. Motion seconded by Commissioner Renstrom and carried by unanimous vote, with Commissioners Gardner, Iverson and Renstrom voting aye.
COMMISSIONERS' REPORT
Commissioner Renstrom mentioned that the Commissioners met with the BLM, Forest Service and other firefighters to discuss wildland fires. Caution should be taken to allow defensible space around cabins. Their main concern is with California being so dry that many resources in Washington County could be pulled to other areas.
PUBLIC WORKS OR ROAD BUSINESS
No items were presented today.
COUNTY DEVELOPMENT AND PLANNING BUSINESS
Washington County Community Development Director Scott Messel reviewed the following items that were discussed in the monthly Land Use Staff Meeting:
1. JUNIPER RIDGE PHASE I. Review of proposed six (6) lot subdivision located in Dammeron Valley. Located north of Dammeron Valley Farms Drive on Homestead Drive. Lot sizes range just over one hundred thousand (100,000) square feet per lot and will need to go through the zone change process with the land currently zoned OSC-20 (Open Space Conservation 20 acre minimum lot size).
2. ANNEXATION. Individuals are looking to annex three point six (3.6) acres of what is known as the Gubler property off of Dixie Drive into St. George City.
HCP BUSINESS
Mr. Sandberg mentioned that the County is actively engaged in fulfilling its obligation under the Habitat Conservation Plan (HCP) to try to facilitate land exchanges and/or purchases.
An official letter from the Fish and Wildlife Service was received acknowledging receipt of the County's application to renew the incidental take permit #TE036719 of the Desert Tortoise and the associated Washington County Habitat Conservation Plan. The letter states that the application was received and is under review. The County can continue to operate under the existing permit even if the Fish and Wildlife Service does not act on the renewal prior to the permit's expiration. Mr. Sandberg stated that the current permit will expire in March 2016.
There being nothing further to come before the Commission, the meeting was adjourned at 4:44 p.m.
