Minutes of Elmo Town Council Regular and Public Hearing 01 April 2015 Attending: Casey Lofley, Dallen Skelley, Brent Hadfield, Stoney Jensen, Seth Allred and Delena Fish Citizens Attending: Jerald Schade, Sue and Leo Ferran, Lyman Eckersley, Molly Skelley, Lisa Winn, Jan and Elroy Mortensen. Media attending: Jerry and Alice Mayor Lofley called the meeting to order and welcomed those in attendance. Citizen Concerns: None were mentioned from the audience nor from the council. Mayor Lofley entertained a motion to leave regular meeting and open public hearing. Dallen motioned that the regular meeting be closed and open the public hearing. Brent seconded. Motion carried. Mayor Lofley explained the purpose of the hearing was to take comment on the proposed amendments to Elmo Town Zoning Ordinance. He read the following proposed changes: 02.0524 7. Mobile Homes can not be attached to any existing dwellings or mobile home. 8. Mobile Homes can not be older than 10 years from present. (proposed Amendment - 4-3-2015) 02.0817 Size of Dwellings and Description The ground floor area of any one-family dwelling shall be not less than 550 square feet and 600 square feet for each additional dwelling unit, provided that this requirement shall not apply to mobile homes situated within an approved mobile home park. Outside dimensions of a mobile home shall not be less than 24 feet by 24 feet. (Amended 6-5-2013) 02-0817-A Mobile Homes can not be attached to any existing dwelling or mobile home. Mobile Homes can not be older than 10 years from present. (proposed Amendment - 4-3-2015) He then opened the meeting for public comment. Mr. Eckersley stated that 02-0817's 550 square ft and 600 square ft vs the outside dimensions of 24 ft x 24 ft was inconsistent. Dallen explained that the purpose of the 24 x 24 foot requirement and the square foot were to ensure that all points were covered to eliminate the placement of a single wide mobile home. Mr. Eckersley also expressed his concern that this change was just to target already existing single wide mobile homes. It was also explained that this would not effect residences already in Elmo. It would be from this date forward. Mrs. Sue Ferran asked if the proposed changes would stop her from adding a stick built family room on to her existing single wide trailer. She was told that as long as she obtained a building permit and the addition met current size requirements and was not moving another single wide trailer to accomplish this, it would not be effected. No other comments were received. Brent motioned to close public hearing and move to regular meeting. Stoney seconded. Motion carried. Mayor Lofley opened regular meeting. Horse & Buggy Transition: Molly stated that this would be the last year that she and Lisa will be chairs of the event. They are asking that a new chairman/chairmen be appointed this year. They felt it would make the transition easier. They will be happy to give them advice on what worked for them and how they organized the event. Stoney asked who they recommended. None was mentioned. It was suggested that a notice be posted asking for interested parties. It was also asked if the notice could include a request for help with the event this year. The council agreed that the term would be 4 years. First year would be a transition, with 3 years of event. Decision of Proposed Zoning Amendment: Dallen motioned to accept the proposed amendments to Elmo Town's zoning ordinance. Brent seconded. Motioned carried. Lawn Care Bids: Delena presented the 3 bids received from Lawn Care Providers. Wards Lawn Care, Inc - $1,188.20; Target Pest Conrol - $1290.00; Lawn Tech - 1061.64. These bids were for one treatment. Stoney motioned that the council accept the Lawn Tech bid - 3 treatments. Seth seconded. Motion carried by roll call - all present voting yes. Animal Control/ Licensing Clinic: Stoney reported that he has been unable to obtain a vet to come. He states that the vets have expressed that there isn't enough dogs getting rabies vaccinations to cover their cost. Dallen suggested Stoney contact Charmain Staley. She is a vet and works in Castle Dale one day per week. She might be willing. Delena reported that she had contacted Windy and Windy had indicated that she would try to attend this meeting, however, she has been experiencing some real health problems and is scheduled for surgery next week. In this conversation Windy indicated that she still was interested in being animal control officer. Stoney and Seth both indicated that they had no problem with 2 Animal Control Officers. The council agreed. Stoney motioned that the town employ Deana Daily for a 3 month probation period for 2 hrs per week at $10.00 per hr. Seth seconded. Motion carried by roll call - all present voting yes. Elmo Town Representative for Tourism Council: Delena reported that she had received an email from the Tourism Council requesting Elmo Town attend their branding meeting. They would like 10-12 people to form a committee from Elmo and determine what Elmo would like for a brand. ElRoy and Jan Mortensen said they would be willing to attend. Stoney also stated that he would try to attend the meeting. Sidewalk project 2015: Delena didn't provide the correct priority list, however, Seth motioned that the town proceed with 5 lengths of sidewalk or $50,000 to be taken from the B & C Road Funds, per the priority list. Stoney seconded. Motioned carried by roll call. All present voting yes. Dirt from excavation: Delena stated she had received a call from Johansen and Tuttle, inquiring if the town wanted to keep the dirt removed from excavation for the curb/gutter project. The council agreed that there were several areas that could use the dirt to fill low areas. They needed to complete the fill at Larry Fish residence and James Winn. Dallen also stated that Joe Oveson has a wash that they are filling and can always take concrete and dirt. Brent stated that he would pass this information on to CVSSD. Tractor/Mower follow up: Dallen stated he had been in contact with Hobby Tractor. They stated that the tractor/mower were no longer under warrants, however, they are willing to look at the tractor and mower, however, the equipment would need to be taken to their facility. They also requested that someone here look at the tractor to see if the squeal is just a belt. Casey said that he would look at the tractor. Stoney said that he would be going to Salt Lake the 3rd week in April and will take the mower and tractor is needed. Budget 2016: Delena stated that the budget for 2016 is due around the middle of June. She asked the council if they wanted the Budget Public Hearing to be in May or June. They council decided to have the hearing in May. They council reviewed the information on the past year budget provided and asked that Delena prepare a tentative budget the same as 2015 for discussion during the public hearing. Business License - Rusty Nail Boutique/Fixin Things: Delena stated that Jessica Moosman requested a business license for a hair salon and craft boutique. Casey stated that he would like a business license to fix cell phones. Stoney motioned to grant business licenses to both businesses. Dallen seconded. Motion carried. Follow Up on Dumpster Location: Dallen stated that he felt the town should stop putting a bandage on the dumpster issue and proceed forward with a permanent facility. The town has two pieces of property. One is the old water tank property and the other is the piece east of the cemetery. The cemetery piece needs to be clean up. The council agreed. The discussed a 50 x 200 ft pull in and out area. They also discussed fencing to ensure the trash is contained. The also discussed a RV dump. Funding for this might be obtained from the CIB. Stoney stated that he speak with Blake at Nielson Construction to see what they would charge to grade the spot while they are here doing the curb and gutter project. Board Member Concerns/Reports: Dallen stated that he feels the council should proceed with the proposed remodel of the playground area by the pavilion. The sand area is a weed trap. The council should sod and install a sprinkler system as budget will allow. He also has concerns with the continuing dog problem. Brent stated that he attended the watershed meeting. He reported that the curb and gutters in Elmo are about completed. They town needs to determine other projects for the CVSSD. He stated that the CVSSD can do drainage as well as roads. He asked the council to think about next projects and asked this be placed on next agenda. Review of Past Due Water Bills / Tanner Rental: Delena reported that Tanner Rental had a significant water leak. They are requesting a reduction in the amount due - now that the leak has been fixed. The bill was $114.70. Stoney motioned that the bill be reduced by 1/2. Dallen seconded. Motion carried. Delena expressed concern on the Robert O'Neel connection. It is showing a leak again. She stated that she had called Mrs. O'Neel, however, not sure either of them understand the problem. Council suggested sending a certified letter. Delena's Items: Delena presented to the council a sheet showing the budget vs actual for 2015 as well as a report showing deposits and checks for March 2015. Stoney motioned to accept the March 4, 2015 minutes and the April Bills with the inclusion of a bill from LN Curtis for $1438.27, Seth seconded.
