Notice of a Finding of No Significant Impact
The USDA, Rural Utilities Service has received an application for financial assistance from Garland City, Utah. The proposal consists of construction of a wastewater treatment facility (WWTF) and wastewater collection system rehabilitation. The proposed WWTF would be located on the east bank of the Malad River along the north side of 12000 North at approximately 5420 West in Box Elder County. Collection system improvements are proposed primarily in public municipal streets with some pipe and manhole improvements in or near private property.
As required by the National Environmental Policy Act and agency regulations, the Rural Utilities Service prepared an Environmental Assessment (EA) of the proposal, which assessed the potential environmental effects of the proposal and the effect that the proposal may have on historic properties. The EA was published on April 1, 2015 for a 30-day public comment period. Four (4) individuals provided comments; comments that were not relevant to the EA were forwarded to the City. Two (2) general comments reoccurred, which were directly relevant to the EA. One included concerns regarding the proposed location of the WWTF relative to existing residential properties, and the second included concerns regarding the WWTF odor potential. Responses to these general comments were incorporated into the final EA as an addendum to the report. In general, the responses were as follows: 1) of the locations evaluated, the proposed location has the best combination of low-environmental impacts while being technically and economically feasible, and (2) the proposed WWTF will use an aerobic treatment process designed to assimilate organics into carbon dioxide, water, and energy. Aerobic biology by nature does not generate noxious odors, and the proposed facility will include multiple engineering controls and operational procedures to safeguard against odor potential from improper operations.
Based upon consideration of the City's proposal, responses from federal and state environmental regulatory and natural resources agencies, a finding of no adverse effect to historic properties concurred-in by the Utah State Historic Preservation Office, and input from the public, the Rural Utilities Service has determined that the proposal will not have a significant impact on the human environment and thus will not require the preparation of an Environmental Impact Statement. The basis of this determination is that the applicant will meet all applicable regulatory and permit requirements for protection of human health and the environment as described in the EA.
In order to avoid or minimize any adverse environmental impacts, the Rural Utilities Service will require the City to incorporate the following mitigation measures into the proposal's design: the WWTF must be constructed outside of the 100- and 500-year floodplains, a Utah Stream Alteration Permit must be obtained from the Utah Department of Environmental Quality prior to any modifications to the Malad River banks, a Nationwide Permit No. 12 from the U.S. Army Corps of Engineers must be obtained prior to construction to mitigate temporary impacts to wetlands, a UPDES discharge permit must be obtained from the Utah Department of Environmental Quality prior to construction of the WWTF, construction activities must be monitored and halted, and the Rural Utilities Service notified upon the discovery of any historical or archaeological artifacts, no vegetation clearing will occur during the typical migratory bird nesting/ brooding period between April 1 through August 30 unless cleared by a qualified wildlife biologist, and the City must submit a fugitive dust plan to the Utah Division of Air Quality and receive approval prior to any construction activities.
