PANGUITCH CITY COUNCIL MINUTES OCTOBER 14, 2014 CITY COUNCIL - 6:30 P.M. LIBRARY CONFERENCE ROOM 25 SOUTH 200 EAST PANGUITCH, UTAH 84759 Those present at the City Council meeting were Mayor Eric Houston, City Manager Lori Talbot, City Recorder Donna Osborn, Council Members, Lloyd Brinkerhoff, Rick Miller, Trudi Owens, Tim Smith, Kim Soper, and Attorney Barry Huntington. Others present were Russell Bulkley, Roxanna Simkins, Gaylen Moore, Sheriff Danny Perkins, Mycrae Tebbs, Parker Palmer, Larsen Perkins, Brandon Huntington, Caitlin Brinkerhoff, Dason Houston, Phoebe Harding, Alexis Anderson, Johnny Nunez, Thomas Hailstone, and Slader Matthew. The meeting was called to order at 6:30 p.m. OPENING CEREMONY Lloyd Brinkerhoff conducted the opening ceremony. ADOPTION OF THE AGENDA Lloyd Brinkerhoff moved, seconded by Trudi Owens to adopt the agenda as outlined. The motion passed with all in favor. APPROVAL OF THE MINUTES Trudi Owens moved, seconded by Rick Miller to approve the minutes. The motion passed with all in favor. POLICE REPORT Sheriff Danny Perkins distributed the officer event analysis reports. The final parade for the year will be the Halloween parade. Sheriff Perkins had the opportunity to meet with the deputy director of the Department of the Interior. The jail is not full at this time. Tim Smith inquired about the drug take back program. Sheriff Perkins reported that the sheriff’s department sends the prescription drugs that have been collected to the DEA by Fed-X. The sheriff’s department has a drug collection box at the sheriff’s office. The DEA will collect from the sheriff’s office but will no longer accept drug collections from other sources. Sheriff Perkins stated that anyone can bring their prescription drugs to the sheriff’s office for disposal. DONATION - SUB FOR SANTA AND CHRISTMAS IN THE COUNTRY Trudi Owens moved, seconded by Tim Smith to donate $500.00 to the sub for santa program and $300.00 to Christmas in the Country. The motion passed with all in favor. CROSSING GUARD Mayor Eric Houston requested that the crossing guard position be readdressed since some council members were absent from the previous meeting. Lloyd Brinkerhoff informed the council that he had made a motion to offer the crossing guard to one of the city employees for a $1000.00 incentive. It would cost the city $3000.00 to contract out the crossing guard position. One concern of the employees performing the crossing guard duties is interruption of work flow. The position could be advertised in-house or put out for contract bid. Mayor Eric Houston explained to the council that the crossing guard could be assigned to a city employee who would then work from 7:00 a.m. to 4:00 p.m. He recommended that Troy Pollock take the crossing guard duties. Lloyd Brinkerhoff moved, seconded by Kim Soper to assign Troy Pollock the duties of the crossing guard with the change in his hours to work from 7:00 a.m. to 4:00 p.m. The motion passed with all in favor. CITY COURT AND JUDGE Martin Nay has submitted a verbal resignation as the Panguitch City Justice Court Judge. Mayor Houston informed the council that there are two options to be considered. One is to hire a new judge. The second option is to eliminate the justice court for Panguitch City. Garfield County Judge Russell Bulkley was invited to comment. Judge Bulkley expressed the importance of having a municipal judge to help as a backup when Judge Bulkley is not available. In response to the question of Mark McIff from Richfield providing judge services, it was explained that the assisting judge must reside within the county. The qualifications for the municipal judge is a high school diploma, and the pay scale is set according to the number of cases handled. The municipal judge is appointed by the City Council, and the citizens vote whether to retain the judge every 6 years. Garfield County provides office space, books, and computer programs. The City pays a portion of the justice court secretary’s wage, and the expenses of the yearly training for the judge. Lloyd Brinkerhoff moved, seconded by Trudi Owens to advertise the position for Panguitch City justice court judge. The motion passed with all in favor. CLERK / RECORDER POSITION Tyrissa Howell was the only in-house applicant for the position of Panguitch City Clerk / Recorder. Tim Smith questioned if the position should be opened to the public because the council is spending tax payer’s money, and by hiring in-house, we are limiting our options. Attorney Barry Huntington suggested that since there was only one applicant that the City open the position to the public. City Manager Lori Talbot stated that doing a good job in a lower, part-time position should be recognized by advancement when possible. Tyrissa Howell has done a good job and has shown ability and initiative as part-time librarian. Lori Talbot stated that Tyrissa Howell is a good choice for the position of clerk / recorder. Lloyd Brinkerhoff moved, seconded by Trudi Owens to offer the position of clerk / recorder to Tyrissa Howell. Tim Smith opposed the motion. The motion passed with Rick Miller, Kim Soper, Trudi Owens, and Lloyd Brinkerhoff voting in favor. ANNEXATION Kim Soper updated the council on the progress of the annexation. He reported that we have the majority in property value and acreage needed to proceed with the annexation. His research has shown that there are 77 water connections and 66 sewer connections currently outside the city limits. Kim Soper will put together an annexation packet for the council to include boundaries and locations, etc. The council also requested a report on the tax benefit to the city be included. City Clerk Donna Osborn will help put together a checklist for the procedure and time line for the annexation process. J. P. FINES REPORT Lloyd Brinkerhoff moved, seconded by Tim Smith to accept the J. P. Fines report. The motion passed with all in favor. PENDING BUSINESS There is no new pending business DEPARTMENT REPORTS Triple C: Gaylen Moore, the new Triple C manager, reported that he has been cleaning at the Triple C and working on resolving safety issues including getting bids for repairs and improvements. The ambulance parking inside the arena is still an issue. Gaylen Moore reported that the turning of the ambulance and taking the required path to exit the arena and warm up area took 4 minutes. With the ambulance parked outside the west door with the ambulance attendant 20 feet away inside the arena, it took 1 minute to unlock the ambulance and the compartments. EMT supervisor Tammy Barton wants the ambulance parked inside the arena. Upon investigation, Gaylen Moore found that the Triple C is the only arena in southern Utah that parks the ambulance inside the arena. Gaylen Moore recommended an EMT squad meeting be held on site at the Triple C Arena to discuss the issue. Letter to Forest Service: Kim Soper has drafted a letter to the Forest Service about the city springs. He alerted them to the need for a new fence with a secure gate and eliminating excessive fuels in the forest around the springs. The Mayor will review the letter. Road at 6th South: The Big Fish Restaurant owners would like to have the road at 600 South finished. The City would need to have a 50 foot right-of-way easement from the restaurant. David Owens would like to join water pipes to eliminate dead end pipes in this area before any road work is done. The council would like the road graded and graveled before winter if possible. City Park: City Manager Lori Talbot informed the council that the contractors will not meet their November deadline. Much progress has been made, but the stripes must be painted and allowed 30 days to cure. Airport Lighting: The lighting project at the airport has been put off until spring. Requests from Harshad Desai: Mr. Desai continues to send faxes requesting to meet with city council members. Attorney Barry Huntington advised the council not to meet with Mr. Desai. Water Line: The City does not have equipment to dig under the ditch to replace the water lines on south Center Street. The cost to have a contractor dig the project is $2200.00. There are still leaks in the water pipes, but they are not coming up through the asphalt yet. All of the pipes and the fire hydrant have been ordered. The Council recommended that the project be completed. New Fire Truck: The new fire truck should be here in November. EXECUTIVE SESSION Mayor Eric Houston informed the council that no executive session is needed. CURRENT BILLS The council reviewed the current bills to be paid. Trudi Owens moved, seconded by Tim Smith to pay the current bills. The motion passed with all in favor.
