AGENDA CITY COUNCIL of SALT LAKE CITY Tuesday, September 2, 2014 2:00 p.m. Work Session (A discussion between Council Members. The public is welcome to listen.) 7:00 p.m. Formal Meeting (Includes open public comment period – 2 minute limit.) Council Meeting Rules, Parliamentary Order and Procedure Parking note: The Council offers parking validation to Council meeting attendees who park at the Main Library just east of the City & County Building. See Council staff for the validation ticket. A. WORK SESSION: 2:00 p.m. in Room 326, City & County Building, 451 South State St. Note: Items listed below may be moved and discussed in a different portion of the agenda based on circumstance and availability of speakers. 1. Capital Improvement Program (CIP) ~2:00 p.m. Legislative Sponsor: Not Required – Budget Item The Council will have a follow up discussions on the Mayor’s recommended budget relating to the City’s Capital Improvement Program (CIP) for Fiscal Year 2014-2015. Capital improvements involve the construction, purchase or renovation of buildings, parks, streets or other physical structures. Generally, projects have a useful life of five or more years and cost $50,000 or more. 2. Transportation Items ~3:00 p.m. The Council will be briefed about: a) Transit Master Plan Update Legislative Sponsor: Not Required – Interim Update b) TIGER Grant for Sugar House Streetcar Legislative Sponsor: Erin Mendenhall a proposal to match funding in the event the City is awarded a federal Transportation Investments Generating Economic Recovery (TIGER) grant. The City has applied for the grant to fund extending the Sugar House streetcar “S” Line from McClelland Street to the intersection of 2100 South Street and Highland Drive. The grant also would help fund other transportation improvements including reducing the number of automobile lanes on a four-tenths-mile section of Highland Drive from four lanes to three. Under the proposed resolution, the Council would be asked to appropriate about $3.1 million in the event the City is awarded the federal grant totaling about $10.6 million. (Item G1); c) Downtown Streetcar Alternatives Update Legislative Sponsor: Luke Garrott the progress of a study of Downtown Streetcar options, including information on how streetcars differ from buses. The study, titled the Downtown Streetcar Alternative Analysis, is a step in the ongoing development of a downtown streetcar system and is scheduled to be completed this fall and; d) South Davis Transit Study Legislative Sponsor: James Rogers the findings of a study of transit options to connect Downtown Salt Lake City with South Davis County. The recommended Locally Preferred Alternative includes a Bus Rapid Transit route on 400 West to serve redevelopment, the commuter rail station and Downtown Salt Lake City. The Bus Rapid Transit would run in exclusive lanes adding to travel time benefits. 3. Master Plans ~4:00 p.m. The Council will be briefed about: a) West Salt Lake Legislative Sponsor: Not Required-Petition from Mayor a proposal that would amend the West Salt Lake Master Plan. The plan has been updated to reflect the evolution of transportation, land use, and sustainability in the area south of Interstate 80 from Interstate 215 on the west to Interstate 15 on the east . The updated plan lays out the vision, goals and policies for the area, including: • encouraging reinvestment and redevelopment; • protecting ongoing investment in low-density residential neighborhoods while incorporating high-density development; and • making West Salt Lake a destination for outdoor recreation. Petitioner – Mayor Ralph Becker, Petition No. PLNPCM2010-00656. (Item H1) and; b) 9 Line Corridor Legislative Sponsor: Kyle LaMalfa the final 9 Line Master Plan. This planning document for the 9 Line Corridor, which follows the old Union Pacific rail line on 900 South from 200 West to the Surplus Canal, is an effort to provide a major pedestrian and bicycle link connecting the City's east and west neighborhoods. The 9 Line Master Plan identifies: • ways to utilize the space, including development ideas for vacant parcels along the trail; • plans for the continuation of the trail west to the Surplus Canal; • identifies the necessary connections that need to be made to connect the nearby neighborhoods, amenities and activity nodes. Petitioner – Mayor Ralph Becker, Petition No. PLNPCM2014-0004. (Item H2). The Council is planning to hold a public hearing on both master plans on Oct 7, 2014 at 7:30 p.m. at Parkview Elementary (970 Emery Street Salt Lake City, Utah 84104). 4. Golf Fund Long Term Budget Issues ~5:00 p.m. Legislative Sponsor: Not Required – Budget Item The Council will receive a follow-up briefing about the Golf Fund’s long-term financial issues, and will discuss with the Administration potential options for operating scenarios to help make the Golf Fund financially self-sustaining. 5. Board Appointment Interviews: Parks, Trails, Natural Lands and Urban Forestry Advisory Board Time Certain 6:00 p.m. Legislative Sponsor: Not Required –Board Appointments The Council will interview the following people prior to consideration of their appointments to the Parks, Trails, Natural Lands and Urban Forestry Advisory Board. Board Appointment Interviews: Police Civilian Review Board Time Certain 6:00 p.m. Legislative Sponsor: Not Required –Board Appointments The Council will interview the following people prior to consideration of their appointments to the Police Civilian Review Board. (Item H4) • Dennis Busch • Gregory Bambo 7. Report of the Executive Director Report of the Executive Director, including a review of Council information items and announcements. The Council may give feedback or staff direction on any item related to City Council business. 8. Report of the Chair and Vice Chair Report of the Chair and Vice Chair. 9. Closed Session The Council will consider a motion to enter into Closed Session. A closed meeting described under Section 52-4-205 may be held for: a. discussion of the character, professional competence, or physical or mental health of an individual; b. strategy sessions to discuss collective bargaining; c. strategy sessions to discuss pending or reasonably imminent litigation; d. strategy sessions to discuss the purchase, exchange, or lease of real property, including any form of a water right or water shares, if public discussion of the transaction would: (i) disclose the appraisal or estimated value of the property under consideration; or (ii) prevent the public body from completing the transaction on the best possible terms; e. strategy sessions to discuss the sale of real property, including any form of a water right or water shares, if: (i) public discussion of the transaction would: (A) disclose the appraisal or estimated value of the property under consideration; or (B) prevent the public body from completing the transaction on the best possible terms; (ii) the public body previously gave public notice that the property would be offered for sale; and (iii) the terms of the sale are publicly disclosed before the public body approves the sale; f. discussion regarding deployment of security personnel, devices, or systems; and g. investigative proceedings regarding allegations of criminal misconduct. A closed meeting may also be held for attorney-client matters that are privileged pursuant to Utah Code § 78B-1-137 FORMAL MEETING B. OPENING CEREMONY: 7:00 p.m. in Room 315, City & County Building, 451 South State St. Council Member Charlie Luke will conduct the Formal Council Meetings in September. 1. Pledge of Allegiance. 2. The Council will consider adopting a joint resolution with Mayor Ralph Becker supporting September 6-13, 2014 as Eat Local Week in Salt Lake City. 3. The Council will approve the meeting minutes of the: a) K.E.E.P. Yalecrest Organization on Tuesday July 15, 2014, b) Work session on Tuesday July 29 and; c) Formal meeting on Tuesday August 19, 2014. C. PUBLIC HEARINGS: 1. Ordinance: Zoning Text Amendment: Outdoor Dining Amendments Legislative Sponsor: Not Required – Petition from Applicant Accept public comment and consider adopting an ordinance amending Salt Lake City Code relating to outdoor dining regulations (amending section 21A.40.065). The amendments would allow outdoor dining for nonconforming restaurants and other similar uses through the City’s special exception process (Chapter 21A.52-Special Exceptions). Currently, nonconforming restaurants are not allowed to have outdoor dining. Related provisions of Title 21A- Zoning may also be amended as part of this petition. Petitioner – Jude Rubadue, Petition No. PLNPCM2014-00106. (P 14-12) Staff recommendation: Close and consider options. 2. Grant Application Submissions Legislative Sponsor: Not Required – Grants Accept public comment on applications submitted by various City departments for the following grants: a) Paint-Ready Active Transportation Bikeway Projects 2014; $245,000 b) Pioneer Park Outdoor Recreation Program; $499,854 c) Salt Lake City Urban Trails Implementation Plan. This request provides technical assistance from the National Parks Service to facilitate stakeholder and community meeting to develop the Salt Lake City Urban Trails Implementation Plan. Budget neutral. This request provides technical assistance from the National Parks Service. (B 14-8) Staff Recommendation: Close and Refer to Future Consent Agenda. D. POTENTIAL ACTION ITEMS (None) ?E. COMMENTS: 1. Questions to the Mayor from the City Council. 2. Comments to the City Council. (Comments are taken on any item not scheduled for a public hearing, as well as on any other City business. Comments are limited to two minutes.) F. NEW BUSINESS: (None) G. UNFINISHED BUSINESS: 1. Resolution: TIGER Grant Match for the Sugar House Streetcar Extension Legislative Sponsor: Erin Mendenhall Consider adopting a resolution pledging support to contribute the required local match if awarded TIGER Grant funding to extend transit service in the Sugar House Business District. Under the proposed resolution, the Council would be asked to appropriate about $3.1 million to match the federal grant totaling about $7.5 million. Per Council request, the proposal has been changed to specify that the City will make an effort to find additional funding sources, such as private property owners adjacent to the S-Line. (R 14-6) Staff Recommendation: Adopt. 2. Ordinance: Consolidated Fee Schedule Amendments – Zoning Petitions Fee Legislative Sponsor: Not Required – Petition from Mayor Consider adopting a proposal that would amend various provisions of Salt Lake City Code concerning the Consolidated Fee Schedule. The proposal would clarify vague, missing or non-standardized language in code that authorizes fee collection, particularly related to zoning regulations. The proposal also clarifies that fees are not required for petitions from the Mayor, City Council or Planning Commission, or for historic preservation applications, including new local historic and character conservation districts. Petitioner – Mayor Ralph Becker, Petition No. PLNPCM2014-00016. (O 14-20) Staff Recommendation: Adopt. 3. Ordinances: HIVE Pass Related Items a) Consolidated Fees Schedule Amendment - Credit Card Surcharges Legislative Sponsor: Not Required – Budget Item Consider adopting an ordinance amending the Salt Lake City Consolidated Fee Schedule by including the following language to further describe the circumstances in which a credit card surcharge may be imposed: “This fee will be added at the point of sale to all credit card transactions involving impact fees, Justice Court fees or penalties, and any fees that go into the general fund. Hive Pass purchases and parking meter transactions are not subject to surcharge.” (O 11-9) Staff Recommendation: Adopt. b) Confirm Action: Ordinance: Clarifying No Credit Card Surcharge for HIVE Pass Purchases Legislative Sponsor: Not Required – Budget Item Confirm the Council’s action of July 15, 2014 adopting an ordinance amending Section 3.16.060 of the Salt Lake City Code to clarify that no credit card surcharge will be added to HIVE Pass purchases. (O 14-19) Staff Recommendation: Confirm Action. H. CONSENT 1.
