These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by Ogden City Corporation.
REQUEST FOR THE RELEASE OF FUNDS
On or about June 16, 2014, Ogden City Corporation will submit a request to the U.S. Department of Housing and Urban Development for the release of Community Development Block Grant funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake a project known as the Ogden Business Exchange, consisting of the development of a business/light industrial park in the West Ogden neighborhood.
FINDING OF NO SIGNIFICANT IMPACT
Ogden City Corporation has determined that the project will have no significant impact on the human environment. An Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA), therefore, is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Ogden City Corporation, 2549 Washington Blvd., Suite 420, Ogden, Utah 84401 and may be examined or copied weekdays 9:00 A.M. to 4:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Ogden City Corporation at the address noted above. All comments received by June 15, 2014 will be considered by Ogden City Corporation prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
Ogden City Corporation certifies to the U.S. Department of Housing and Urban Development that Mark L. Johnson in his capacity as Chief Administrative Officer, acting as the Certifying Officer for Ogden City Corporation, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The U.S. Department of Housing and Urban Development’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows Ogden City Corporation to use Program funds.
OBJECTIONS TO THE RELEASE OF FUNDS
The U.S. Department of Housing and Urban Development will accept objections to its release of funds and Ogden City Corporation’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of Ogden City Corporation; (b) Ogden City Corporation has omitted a step or failed to make a decision or finding required by U.S. Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by the U.S. Department of Housing and Urban Development; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures of 24 CFR Part 58 and shall be addressed to the U.S. Department of Housing and Urban Development, Region VIII Office, 8ADE, 1670 Broadway Street, Colorado 80202-4801. Potential objectors should contact the U.S. Department of Housing and Urban Development to verify the actual last day of the objection period.
