MEETING MINUTES
FEBRUARY 18, 2014
The Regular Meeting of the Board of the Washington County Commission was called to order by Chairman James J. Eardley at 4:00 p.m. on February 18, 2014, in the Commission Chambers, Washington County Administration Building, St. George, Utah. Those in attendance were Chairman James J. Eardley, Commissioner Dennis Drake, Commissioner Alan Gardner, Administrator Dean J. Cox, Deputy County Attorney Eric Clarke, and Deputy County Clerk Christine S. Hall.
Commissioner Drake led the Pledge of Allegiance.

CONSENT AGENDA:
The Consent Agenda is a means of expediting routine matters which come before the Commission for approval. The Consent Portion of the agenda is approved by one (1) non-debatable motion. If any Commissioner wishes to remove an item from the Consent Portion of the agenda, then that item becomes the first order of business on the Regular Agenda.

REGULAR AGENDA ITEMS FOR CONSIDERATION:
EMERGENCY SERVICES REPORT / DEPUTY DARRELL CASHIN
Undersheriff Bart Bailey presented Deputy Darrell Cashin, who is the Sheriff’s Deputy who oversees Search and Rescue operations.
Deputy Cashin reported on five (5) search and rescue events from 1-21-14 through 2-18-14:
• 1/23/14, stranded motorist on Kolob Reservoir, fifteen (15) man hours;
• 1/25/14, man suffered cardiac arrest while hiking in Snow Canyon State Park, twelve (12) man hours;
• 2/2/14, lost hikers on Red Mountain, sixty-four (64) man hours;
• 2/8/14, injured hiker in Snow Canyon State Park, nine (9) man hours;
• 2/14/14, stranded motorist on West Mountain, two (2) man hours
INTRODUCTION OF BOY SCOUTS
Commissioner Eardley recognized the attendance of several Boy Scouts who were completing their Citizenship in the Community merit badge requirements.

CONSIDERATION OF RESOLUTION NO. R-2014-1781, A RESOLUTION APPOINTING/RE-APPOINTING BOARD MEMBERS TO THE PINE VALLEY SPECIAL SERVICE DISTRICT
Spencer Beckstrom has resigned his position on this Board, and Dall Winn’s term of appointment has expired. The vacancy was duly advertised and all applications were reviewed.
MOTION: Motion by Commissioner Gardner to Adopt Resolution No. R-2014-1781, a Resolution Appointing Herman Nordbruch and Re-Appointing Dall Winn to the Pine Valley Special Service District Administrative Control Board. Motion seconded by Commissioner Drake and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
CONSIDERATION OF RESOLUTION NO. R-2014-1782, A RESOLUTION APPROVING THE 2014 COOPERATIVE AGREEMENT BETWEEN WASHINGTON COUNTY AND THE UTAH DIVISION OF WILDLIFE RESOURCES
Habitat Conservation Plan (HCP) Administrator Robert Sandberg explained that this Cooperative Agreement covers the adoption and monitoring of tortoises within the Red Cliffs Desert Reserve, and the fencing of certain portions of the Reserve for the protection of the tortoise population. It also includes the systematic clearances that are done by the HCP and various Scopes of Work.
MOTION: Motion by Commissioner Gardner to Adopt Resolution No. R-2014-1781, a Resolution Approving the 2014 Cooperative Agreement between Washington County and the Utah Division of Wildlife Resources. Motion seconded by Commissioner Drake and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
CONSIDERATION OF RESOLUTION NO. R-2014-1783, A RESOLUTION APPROVING AN AGREEMENT BETWEEN WASHINGTON COUNTY AND THE UNITED STATES DEPARTMENT OF AGRICULTURE FOR THE PROVISION OF SURPLUS COMPUTER EQUIPMENT AND INTERNET ACCESS TO THE USDA
MOTION: Motion by Commissioner Drake to Table Resolution No. R-2014-1783, A Resolution Approving An Agreement Between Washington County And The United States Department Of Agriculture For The Provision Of Surplus Computer Equipment And Internet Access To The USDA Motion seconded by Commissioner and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
CONSIDERATION OF RESOLUTION NO. R-2014-1784, A RESOLUTION APPROVING THE EXECUTION OF AN AGREEMENT AND QUIT-CLAIM DEED REGARDING THE TRANSFER OF OWNERSHIP OF A PARTIAL SUBDIVISION LOT FROM WASHINGTON COUNTY TO COREY LARSON
Deputy County Attorney Eric Clarke explained that historically, the County used to sell slivers of land to recoup property taxes owed by property owners. In this particular case, the parcel is ten (10) feet wide and sits next to Mr. Larson’s land. Mr. Larson has offered to pay all back taxes to make the County whole in exchange for acquiring this piece of land.
MOTION: Motion by Commissioner Drake to Adopt Resolution No. R-2014-1784, a Resolution Approving the Execution of an Agreement and Quit-Claim Deed Regarding the Transfer of Ownership of a Partial Subdivision Lot From Washington County to Corey Larson. Motion seconded by Commissioner Gardner and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
CONSIDERATION OF RESOLUTION NO. R-2014-1785, A RESOLUTION APPOINTING A BOARD MEMBER TO THE PINE VALLEY LOCAL DISTRICT
MOTION: Motion by Commissioner Gardner to Adopt Resolution No. R-2014-1785, a Resolution Appointing Ford Northington to the Pine Valley Local District Administrative Control Board. Motion seconded by Commissioner Drake and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
CONSIDERATION OF RESOLUTION NO. R-2014-1786, A RESOLUTION APPROVING MEDICAL DIRECTOR SERVICES AGREEMENT BETWEEN WASHINGTON COUNTY AND BRADLEY J. CROSBY, M.D., REGARDING MEDICAL DIRECTOR SERVICES FOR THE WASHINGTON COUNTY SHERIFF'S OFFICE EMS PROGRAM
Undersheriff Bailey said that many Sheriff’s deputies are paramedics at various levels of certification, and many Search and Rescue volunteers have some medical expertise. Bringing a Medical Director in allows the Sheriff’s Office to fully train, certify, and support these deputies and volunteers. This is the first year of the program to get it off the ground. The Medical Doctor will review the protocols that are in place in the field and ensure that they are in compliance with all state regulations.
MOTION: Motion by Commissioner Gardner to Adopt Resolution No. R-2014-1786, a Resolution Approving a Medical Director Services Agreement between Washington County and Bradley J. Crosby, M.D., Regarding Medical Director Services For The Washington County Sheriff's Office EMS Program. Motion seconded by Commissioner Drake and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
CONSIDERATION OF RESOLUTION NO. R-2014-1787, A RESOLUTION APPROVING TWO CONTRACTS FOR THE PROVISION OF BARBER SERVICES AT THE PURGATORY CORRECTIONAL FACILITY
The approximately four hundred fifty (450) inmates at Purgatory Correctional Facility require haircuts on a routine basis, and state law dictates that barber services are provided to them. The inmates pay for their own barber services, except for the indigent inmates, who are provided a prescribed number of haircuts per year, paid for by the facility.
MOTION: Motion by Commissioner Drake to Adopt Resolution No. R-2014-1787, a Resolution Approving Two Contracts, with Jackie Bailey and Josh Jensen, For the Provision of Barber Services At The Purgatory Correctional Facility. Motion seconded by Commissioner Gardner and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
CONSIDERATION OF RESOLUTION NO. R-2014-1788, A RESOLUTION APPROVING AN AGREEMENT BETWEEN TDS BAJA BROADBAND LLC AND WASHINGTON COUNTY GRANTING A NONEXCLUSIVE CABLE TELEVISION AND TELECOMMUNICATIONS FRANCHISE TO THE UNINCORPORATED AREAS OF WASHINGTON COUNTY
Mr. Clarke asked to remove the phrase “and telecommunications” from the wording of this Resolution. He added that under federal rules and regulations, any cable company needs to have a franchise.
Mr. William Shaw, with TDS Baja Broadband, LLC, said that in 2006 Baja purchased the cable system from Charter Communications. He asked for a renewal of the nonexclusive cable television franchise, which expires in April of this year.
Commissioner Drake said that TDS Baja has provided a great service to the Community Education Channel operating out of Dixie State University.
MOTION: Motion by Commissioner Gardner to Adopt Resolution No. R-2014-1788, A Resolution Approving An Agreement Between TDS Baja Broadband LLC And Washington County Granting A Nonexclusive Cable Television Franchise To The Unincorporated Areas Of Washington County. Motion seconded by Commissioner Drake and carried by unanimous vote, with Commissioners Eardley, Gardner, and Drake voting aye.
COMMISSIONERS' REPORT
No report was presented today.
PUBLIC WORKS OR ROAD BUSINESS
Public Works Director Ron Whitehead reported on various road projects within the County:
• The NRCS projects on River Road and at the Water Conservancy District site are complete;
• Current work sites for rock placement and other mitigation are Grandpa’s Pond, LaVerkin Creek, and Confluence Park, but they should be finished up this week. There will still be County vehicles in those areas, so the public should be warned to be careful;
• The frontage road along the Southern Parkway (the Washington Dam Road connection to the Peacock Farm Road) is currently under construction;
• Old Highway 91 is still getting more traffic than normal because areas of the Virgin Gorge are under construction;
• Mr. Whitehead has not been able to secure a traffic counter for the Old Highway 91 to get an idea of increased traffic.
COUNTY DEVELOPMENT AND PLANNING BUSINESS: SCOTT MESSEL / REVIEW OF PLANNING COMMISSION ITEMS OF FEBRUARY 11, 2014:
Conditional Use for Special Events: Review of Special Event for Wizards Rhino Rally (motocross) to be held on February 22, 2014, generally located south of Hurricane near Sand Hollow and accessed from Warner Valley Road, Wizards Motocross Club/Jay Quayle, applicants.
Conditional Use for Special Events: Review of Special Events for Tour del Sol Bike Ride to be held March 29-30, 2014. The Tour de St. George Spring and Fall Bike Ride to be held April 12 and October 25, 2014, countywide; Spin Geeks/Margaret Gibson, applicants.
Conditional Use for Special Events: Review of Special Event for the 2014 Ironman 70.3 to be held May 3, 2014 countywide; U. S. Triathlon of Colorado/Jeffrey Gardner, applicants.
Conditional Use for Special Events: Review of Special Event for the Redrock Relay Dixie to be held on March 8, 2014, countywide, Redrock Relay/Zack Collings, applicants.

County Planner Scott Messel said that the Planning Commission unanimously approved all of the above Conditional Use Permits.
