PANGUITCH CITY COUNCIL MINUTES AUGUST 13, 2013 CITY COUNCIL - 6:30 P.M. LIBRARY CONFERENCE ROOM 25 SOUTH 200 EAST PANGUITCH, UTAH 84759 Those present at the City Council meeting were Mayor Eric Houston, City Manager Lori Talbot, City Recorder Donna Osborn, Council Members, Lloyd Brinkerhoff, Rick Miller, Trudi Owens, Nick Reynolds, Tim Smith and Attorney Barry Huntington. Others present were Art Cooper, Bob Lowe, Joe Orman, and Rowdy Miller. Kelly Holman came at 7:10 p.m. The meeting was called to order at 6:30 p.m. OPENING CEREMONY Donna Osborn conducted the opening ceremony. ADOPTION OF THE AGENDA Lloyd Brinkerhoff moved, seconded by Tim Smith to adopt the agenda as outlined. The motion passed with all in favor. APPROVAL OF THE MINUTES Nick Reynolds moved, seconded by Trudi Owens to approve the minutes. The motion passed with all in favor. UP COMING MEETINGS City Council / Staff Party - August 20, 2013 - 6:30 p.m. - Allen’s Ranch Utah League of Cities and Towns Annual Conference - Sept. 11-13, 2013 - Salt Lake City Mayor Eric Houston recommended that Trudi Owens attend this conference. Tim Smith also expressed interest in attending. Registration is due by August 30, 2013. SENIOR CLASS 4TH OF JULY CELEBRATION - AUBREY TAYLOR Rowdy Miller represented the senior class since Aubrey Taylor has moved. Rowdy Miller reported that the activities on the 4th of July were successful. The kiddie games were very successful, but the lunch was not well attended. The senior class expenditures and expenses were fairly even. Nick Reynolds moved, seconded by Tim Smith to donate $500.00 to the senior class for the 4th of July celebration as we usually do. The motion passed with all in favor. PANGUITCH CITY COUNCIL MINUTES AUGUST 13, 2013 PAGE 2 BUSINESS LICENSE - FAMILY DOLLAR The Family Dollar store opened on August 8, 2013, which was prior to the City Council meeting. Therefore, each council member was contacted for tentative approval of the business license until this meeting could be held. Lloyd Brinkerhoff moved, seconded by Trudi Owens to approve the business license for the Family Dollar Store. The motion passed with all in favor. BOB LOWE - DEMOLITON DERBY Bob Lowe represented the Panguitch Lions Club to request a donation to help with the costs of the demolition derby. The costs of the derby were higher than anticipated. In return for the donation the city would receive advertising as a sponsor through radio, Internet, and flyers. There are 20 cars and 8 trucks entered in the demolition derby. Rick Miller moved, seconded by Nick Reynolds to give $1000.00 to the Lions Club for the demolition derby. The motion passed with all in favor. PUBLIC HEARING - DOG ORDINANCE There were no citizens at the public hearing for the dog ordinance at 7:00 p.m. Kelly Holman arrived at 7:10 p.m. for the public hearing, which had concluded at 7:05 p.m. Mr. Holman was given a copy of the changes to the dog ordinance. Nick Reynolds moved, seconded by Lloyd Brinkerhoff that the Council go into public hearing at 7:00 p.m. The motion passed with all in favor. Mayor Eric Houston explained that the changes to the dog ordinance will increase the fines for dog impound. If a dog is impounded three times, it is to be removed from the owner’s possession. Two police officers will also be trained to perform the duties of dog catcher to assist the City dog catcher. Nick Reynolds moved, seconded by Rick Miller to end the public hearing at 7:05 p.m. The motion passed with all in favor. ADOPT ORDINANCE 2013-7 - AMENDING DOG ORDINANCE Rick Miller moved, seconded by Tim Smith to adopt ordinance 2013-7 amending the dog ordinance. The motion passed with all in favor. SOUTHERN UTAH RECYCLING COALITION - NICKIE HEYING Nickie Heying was unable to be in attendance. Lloyd Brinkerhoff moved, seconded by Rick Miller to table the Southern Utah Recycling coalition presentation. The motion passed with all in favor. PANGUITCH CITY COUNCIL MINUTES AUGUST 13, 2013 PAGE 3 ATV RALLY City Manager Lori Talbot explained that in the past the monies for the ATV rally have come from the City general fund. This year the ATV Rally has separated from the City and has it’s own account. Therefore the ATV rally committee is requesting a donation of $2000.00 from the City. The County has given $2000.00 to the ATV Rally. Tim Smith moved, seconded by Nick Reynolds to donate $2000.00 to the ATV Rally. The motion passed with all in favor. ELECTION - CONTRACT WITH GARFIELD COUNTY City Manager Lori Talbot explained that Garfield County Clerk Camille Moore must run an election this year, and she is willing to include the ballot for Panguitch City elections. She will do all the work of the election; arranging for the printing of the ballots, mailing the ballots, verifying voter signatures, and counting votes. Panguitch City will pay for the printing of the ballots and the mailing of the ballots. Recorder Donna Osborn will assist Camille Moore with the clection. Tim Smith moved, seconded by Rick Miller to inform Camille Moore that the City Council is in favor of contracting with Garfield County for the City election. The motion passed with all in favor. INSIDE THE OUTSIDE - KJAZZ - 30 MINUTE PROGRAM FEATURING GARFIELD COUNTY Mayor Eric Houston recommended that we wait for more information on this program and coordinate with Garfield County. Nick Reynolds moved, seconded by Trudi Owens to table this program. The motion passed with all in favor. PATTERSON PROPERTY Attorney Barry Huntington has sent a certified letter to the Pattersons, but he has not had a response. There is a prescribed waiting time allowed for the acceptance of delivery of the certified letter. Attorney Huntington will be notified when the letter is accepted. If there is no response, nuisance charges can be filed. After this process, the City Maintenance crew can be sent in to clean up the property, and the owner’s will be billed. The trailer on the property can be removed if it is a safety hazard or infested with animals. REAGAN SIGN PROPERTY Attorney Barry Huntington has sent a letter to the owners of the Reagan Sign property requesting that it be cleaned up. However, UDOT is in negotiations with Reagan sign over the location of the property line. Mayor Eric Houston recommended that the City Council wait to pursue any action until the outcome of the negotiations are known. COMMISSION TRIP - OCT. 6-10, 2013 The County has requested that Mayor Eric Houston organize a marketing and PANGUITCH CITY COUNCIL MINUTES AUGUST 13, 2013 PAGE 4 advertising fact-finding trip to Wickenburg, Prescott, and Sedona, Arizona for October 6-10, 2013. The County Commission will provide county vehicles, gas and meals for the Council participants who wish to go on this trip. The City will provide costs of the rooms for the Council members. Participants will visit with mayors, chambers of commerce, and others who market and promote tourism in these communities. Council Member Rick Miller also suggested that the trip include Jerome, Arizona, which is in this same area and does a great job with marketing for visitors. Nick Reynolds moved, seconded by Lloyd Brinkerhoff to make this trip available to those Council members who want to go. The motion passed with all in favor. J. P. FINES REPORT Tim Smith moved, seconded by Trudi Owens to accept the J.P. Fines report. The motion passed with all in favor. TRIPLE C ARENA Rick Miller reported that the County Commission has discussed the leaking roof at the Triple C. The County Fair is this weekend, August 14-17, 2013. This year there will be an American Rabbit Breeders Association show on Saturday. There is a full schedule of activities ending with the Demolition Derby Saturday night. PENDING BUSINESS There is some progress on the swimming pool and the park project. The Council was given an agreement on the swimming pool building to review. The School District received the first water bill from the reading on the meter installed at the high school track. The bill is $4,571.00 for the month of July. Superintendent Ben Dalton has discussed this bill with the Mayor and the City Manager. The School District will practice better water conservation, and will have the leaks repaired in the sprinkler system in this area. New concrete parking is being installed at the Panguitch Middle School. DEPARTMENT REPORTS Prairie Dogs: Nick Reynolds reported that prairie dogs have been found at the Elementary School. Lloyd Brinkerhoff informed the council that prairie dog sightings are to be reported to the Sheriff’s office. The DWR will trap and remove the prairie dogs. Attorney Barry Huntington informed the council that Garfield County has passed a resolution preventing establishing prairie dogs on private property. There is to be a ½ mile buffer zone around Panguitch City. The United States Congress has allocated $500,000 for the removal of prairie dogs from private lands in Garfield County. Triple C: Rick Miller reported on the roof at the Triple C. The Roping and Rodeos have gone well. The High School Rodeo had 400 contestants. Damaged ceiling tiles have been replaced in the kitchen. UDOT Main Street Resurfacing: City Manager Lori Talbot reported that this week UDOT will replace the pedestrian ramps and the water valves will be lowered. They will begin milling the asphalt next week. The City will get some of the milled asphalt to use in the parking lot at the Park. PANGUITCH CITY COUNCIL MINUTES AUGUST 13, 2013 PAGE 5 Tour of Utah Cycling Race: Mayor Eric Houston reported that the cost to the City for the Tour of Utah was $3,250 instead of the $5000 allocated by the City. The Tour of Utah was broadcast into 117 million homes throughout the world. It was good exposure for Panguitch and Southern Utah. There were some technical difficulties so the crossing of the Hogsback and other footage between Escalante and Boulder was not available. We may have an opportunity to have the Tour of Utah race return to Panguitch in 2015. Meetings: City Manager Lori Talbot and Mayor Eric Houston will meet with personnel from Senator Lee’s office and Senator Hatch’s office at 11:00 a.m. Wednesday, August 14, 2013. Sunrise Engineering representative will meet with Lori Talbot on Thursday, August 15, 2013. CURRENT BILLS The council reviewed the current bills to be paid. It was clarified that the cell phone bill of Greg Excell is split with Panguitch City, Long Canal Water Company, and Greg Excell. Nick Reynolds moved, seconded by Rick Miller to pay the current bills. The motion passed with all in favor.
