Application #: Opening Statement and Residential Infill update
Summary: The Commission will consider adopting a final draft of a residential infill
ordinance framework for submission to the County Council for its consideration and
approval. Over the past two years, the Commission has received and considered
extensive in input from Township citizens, interest groups and the four Community
Councils through written submissions and lengthy hearings and will not take further
public comment at this meeting.
Concerns Discussed: Gary Sackett noted that there would not be another work
session following the meeting as they had had one earlier this month. Commissioner
Van Frank stated that there had been several prior work meetings on this item and that
they had posted a draft of the proposed ordinance on the website. There were three
errors on the proposal that need to be corrected. They request that upon adoption of the
this working proposal that they ask the County Development Services Department to
pass this on to the District Attorney's office to put this into ordinance form.

Summary: Applicant M.H. Mavaddat is requesting a Conditional Use for a Used Car
Lot. The property is located at 67 East Central Avenue and is currently zoned C-3
(Commercial) Community Council – Millcreek. Planner – VanEkelenburg
Concerns Discussed: Van Ekelenburg, County Planer reviewed the staff report and
stated that the property was zoned properly for use of a Used Automotive Dealership.
The applicant has gone through and installed some improvements for public right of way
with regard to sidewalk and is currently headed toward meeting all the requirements of
staff for their approval. On May 3rd the Community Council held their meeting and it
was approved there. No persons from the Community Council or the public voiced any
comments for or against.

Summary: Eric Birkland - The applicant is requesting preliminary plat approval to
amend Lot 2 of the Birkland Subdivision to adjust the East lot line of Lot 2, Ten (10) feet
to the east. Located at 3781South 2300 East. Zone R-1-8 (Residential) Community
Council: Millcreek; Planner – VanEkelenburg
Concerns Discussed: Van Ekelenburg, County Planner, reviewed the staff report
stating that the applicant was basically looking to add 10' to his side yard of his property
the land adjacent is garden area and the issues were minimal and that the only issues
were that he met preliminary plat requirements and that he gets sewer and water letters
and thing of that nature. The staff is looking for a positive recommendation based on
the applicant complete the preliminary plat approval process and the final plat approval
with the staff after all conditions and requirements are met and the final subdivision plat
prepared in accordance with Salt Lake County standards and specifications and be
prepared by a qualified land surveyor. Commissioner Van Frank wanted to make part
of the public record that the trees on the private driveway make it virtually impossible
for cars or fire truck to pass through and would like the fire department and whoever
needs to follows up on this problem.

Summary: Jeff Christensen is requesting exceptions to street development standards
for property located at 3250 East Millcreek Canyon Road. Specifically, the request is for
an exception from the requirement to install curb, gutter, and sidewalk. Planner:
Hinckley.
Concerns Discussed: County Planner Hinckley reviewed the staff report and stated
that the application had been before the commission on the last meeting and was tabled
to continue due to the request of a drawing to see the impact installation of sidewalk
would have on several mature trees on the front yard of this property. In the staff report
it was stated the Country Traffic Engineerg had recommended the sidewalk be adjusted
to be adjacent to the curb rather than have a park strip and then the sidewalk and in
doing this there would be little impact on the trees. Commissioner Sacket questioned
what happens 10 years from now when a neighbor does something that would trigger a
need to for a sidewalk and there is nothing to prevent a need for a park strip and now
you have an uncoordinated arrangement were you have sidewalk up against a curb
and sidewalk against park strips? Mr Hinckley stated that there is a problem on this
street where most of the residents have lanscaped out to the edge of the asphalt.
Jeff Christensen stated his prefference to do curb and gutter and no sidewalk or have
sidewalk next to the curb and gutter.
Nancy Goss opposed to any sidewalks here as she like the county lane feel there.
Commissioner Van Frank agreed with Ms Goss and does not agree with the piecemeal
effect of putting in the sidewalks.
Commissioner Hanson brought up that this is near school area and that brings up safety
issues. There are a lot of people using this street for walking and bicycling routes.
Commissioner Oakes stated that one sidewalk where there is none other on the street
does not impact the safety issue.
Motion and Conditions: Denied With recommendation instead for rolled gutter and sidewalk next to it.

Summary: Joseph Turner is requesting exceptions to street development standards for
property located at 4194 South Marquis Way. Specifically, the request is for an
exception from the requirement to install sidewalk. Planner: Craig Hinckley.
Concerns Discussed: County Planner Hinckley, SLCo Staff reviewed the staff report;
there were 2 recommendations for denial from SLCo Development Services Engineer
and from the Traffic Engineer as it did not meet the criteria established in the ordinance.
The terrain is flat and there seems no topographical reason for not putting in the
sidewalk, there seems also no drainage problems to having a sidewalk.
Mr Turner, the applicant discussed the point that there is not other sidewalk in 3/4 of a
mile of his property. He feels that adding the sidewalk would not conform to the esthetic
of the neighborhood. He does not agree with the piecemeal way of adding sidewalks
would be effective in any near term plan. He would suggest that adding the sidewalks
to the street as a whole would be more effective.
Kathy Swift also spoke with respect to not liking the piecemeal effect of adding sidewalks.
Commissioner Van Frank had a question regarding 4 other houses that have been
recently re-built. Planner Hinckley responded that he did not know but that perhaps they
had put in a bond for it.

Summary: Applicant Michael Velasquez is requesting a Zoning Map Amendment to a property located at 803 East Rowley Dr. (4345 S.). The current zone is R-1-8 (Residential/8000 Sq. Ft. Area Min.); and the proposed zone is R-1-5 (Residential/5000 sq. Ft. Area Min.) The property is approximately 0.37 acres in size (16,117 Sq. Ft.). Concerns Discussed: Planner Van Ekelenburg, SLCo Staff reviewed the staff report this
is to rezone 3 subject parcels that are not lots of record to allow to lots of record to build
two lots for single family homes built. They want to keep the home currently to allow a flag
lot for the other parcel. The new lots are in harmony with the principles stated in the
Countywide Planning Goals and Policies. Community Council has given a positive
recommendation and the staff have also posed a positive recommendation.
Commissioner Van Frank brought up the question as to whether there was enough
sufficient space. Spencer Sanders stated that in their morning meeting they had
discussed that they could not do a flag lot under a R-1-8 but probably could under a R-1-
5. Commissioner Sackett asked if there was a possibility to keep the lot with the current
house a R-1-8 and create a R-1-5 for the back property to keep from spot zoning. It was
decided that this could not be done. The applicant discussed that he was just looking to put
a house on that back property any way that it would be allowed him. Commissioner Hanson
stated that there was already a mix of zones in the immediate area.

Summary: Matt Monroe, representing the Salt Lake Council of the Boy Scouts of
America, is requesting conditional use approval for improvements to springs which
supply water to the Camp Tracy Boy Scout Camp in Millcreek Canyon. The site is
located at approximately 5861 East Millcreek Canyon Road (above the Church Fork
Picnic Area) in an FR-20 Zone (FCOZ). Mount Olympus Community Council. Planner:
Craig Hinckley.
Concerns Discussed: Planner Hinckley reviewed the staff report stated the property is
approximately 40 acres discussed that this project was to do some renovation to two spring
that provides water to the camp. He show with maps as to where the trail went through
where the picnic areas are located and where the springs were to his best guess as he had
not been up there. He also stated the some work had already been started and that there is
currently the reclamation and re-vegetation of the site and fencing on the site. Mr Hinckley
also stated that under our FCOZ chapter and also under our Landscape Ordinance that the
landscape re-vegetation plans be done by a professional landscape architect. The was a
letter handed out from the Forest Service as to their concern about erosion of their trail and
re-vegetation. There was much talk of the damaged done from equipment, trenching, and
re-grading on the slope. It was stated that there had been some miscommunication as to
why permits had not been pulled in advance and that the person responsible is not longer
with the Boy Scout Council. The council stated that it now too late to mitigate the issues
of putting back trees in areas where they have already been stripped. It was suggested that
they work closely with Forest Service and the County to prevent further damage.
Commissioner Van Frank stated that she wants to hear back from the Mt Olympus
Community Council, a landscape architect, US Dept. of Agriculture, Dept of Drinking Water;
she wants to hear from whoever has the authority to say that Homeland Security says that
you cannot put trees back there. She wants the area put back to as close as possible to the
original way it was before and if it can't she wants to know why. Commissioner Sackett
wants to also know the dates that actions were placed on this.

Concerns Discussed: Planner Sanders reviewed the staff report and stated that this
application was a request for a new use in one of the two building that the applicant owns.
The Massage Therapist had moved from a couple of doors down that was approved but
needed it approved for this new location. Staff has requested that they have asked for an
accurate site plan and list of all the businesses in the building to verify that they have all got
current and valid licenses for the site.

and the approval for the Message Therapy and Karate in the main larger building. There was
one phone call received from a nearby resident that had concerns of noise from the outdoor
dining, if there were music and she also had concerns for the Message Therapy.
