NOTICE OF INTENTION TO ADJUST COMMON BOUNDARY
PUBLIC NOTICE IS HEREBY GIVEN OF THE INTENTION OF THE BOARD OF TRUSTEES OF THE SOUTH VALLEY SEWER DISTRICT TO ADJUST A PORTION OF THE EXISTING COMMON BOUNDARY LINE BETWEEN SOUTH VALLEY SEWER DISTRICT AND THE SANDY SUBURBAN IMPROVEMENT DISTRICT BY DELETING CERTAIN TERRITORY FROM THE SOUTH VALLEY SEWER DISTRICT AND ADDING THAT TERRITORY TO THE SANDY SUBURBAN IMPROVEMENT DISTRICT; SETTING A TIME AND PLACE FOR A PUBLIC HEARING THEREON, PROVIDING FOR THE RECEIPT OF WRITTEN PROTESTS TO THE BOUNDARY ADJUSTMENT AND PRESCRIBING OTHER MATTERS RELATING THERETO.
PUBLIC NOTICE IS HEREBY GIVEN to all interested persons that by Resolution, the Board of Trustees of the South Valley Sewer District has expressed its intent to adjust a portion of the common boundary line presently existing between the South Valley Sewer District and the Sandy Suburban Improvement District by deleting certain territory previously located within the South Valley Sewer District and adding that territory to the Sandy Suburban Improvement District due to the fact that such territory cannot practically be served by the existing lines and facilities of the South Valley Sewer District. The affected area to be deleted from the South Valley Sewer District and added to the Sandy Suburban Improvement District is located in Salt Lake County, Utah, and is more particularly described as follows:
LEGAL DESCRIPTION
A PARCEL OF LAND LOCATED IN THE SOUTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 18, TOWNSHIP 3 SOUTH, RANGE 1 EAST, SALT LAKE BASE AND MERIDIAN, IN SALT LAKE COUNTY, UTAH. THE BOUNDARIES OF SAID PARCEL OF LAND ARE DESCRIBED AS FOLLOWS:
BEGINNING AT A POINT 437.90 FEET N.0°23'32"E. ALONG THE SECTION LINE BETWEEN THE EAST QUARTER AND NORTHEAST CORNER OF SAID SECTION 18 AND 250.00 FEET N.89°39'02"W. FROM THE EAST QUARTER CORNER OF SAID SECTION 18, SAID POINT IS IN THE NORTH BOUNDARY LINE OF THAT CERTAIN PROPERTY DEEDED TO DWS L.L.C. RECORDED AS ENTRY NUMBER 8526313, BOOK 8736, PAGE 7125 IN THE OFFICE OF THE SALT LAKE COUNTY RECORDER AND THE BOUNDARY LINE BETWEEN THE "SOUTH VALLEY SEWER DISTRICT" AND "SANDY SUBURBAN IMPROVEMENT DISTRICT" DEFINED BY RESOLUTION RECORDED AS ENTRY NUMBER 1824957, BOOK 1885, PAGE 504 IN THE OFFICE OF THE SALT LAKE COUNTY RECORDER AND RUNNING THENCE ALONG THE SAID SEWER DISTRICT BOUNDARY LINE S.00°23'32"W. 142.80 FEET TO THE SOUTH BOUNDARY LINE OF SAID DWS L.L.C. PARCEL; THENCE N.89°39'02"W. ALONG SAID SOUTH BOUNDARY LINE 55.00 FEET TO A POINT IN THE EAST LINE OF THE "WHITE SANDS SUBDIVISION PLAT A" RECORDED AS ENTRY NUMBER 2359995, BOOK 2918, PAGE 374 IN THE SALT LAKE COUNTY RECORDS; THENCE ALONG THE BOUNDARIES OF SAID PLAT THE FOLLOWING TWO (2) COURSES: (1) N.0°23'32"E. 357.00 FEET, AND (2) S.89°39'02"E. 55.00 FEET TO SAID SEWER DISTRICT BOUNDARY LINE; THENCE S.0°23'32"W. 214.20 FEET ALONG SAID SEWER DISTRICT BOUNDARY LINE TO THE POINT OF BEGINNING.
THE ABOVE DESCRIBED PARCEL OF LAND CONTAINS 19,635 SQUARE FEET OR 0.451 ACRES.
A public hearing on this boundary adjustment will be held on March 27, 2013, at the hour of 7:00 a.m. at the Jordan Basin Water Reclamation Facility offices at 13826 South Jordan Basin Lane, Riverton, Utah. All interested persons will be heard. Persons desiring additional information about the proposed boundary adjustment may call the South Valley Sewer District General Manager at (801) 571-1166. If the adjustment is made as proposed, the affected area will be subject to the rules and regulations of the Sandy Suburban Improvement District and users within the affected territory will be obligated to pay fees, charges and taxes levied by the Sandy Suburban Improvement District for sewer services and/or for paying any bonds or other obligations of that District. It is the intention of the Board of Trustees to complete the proposed adjustment unless at or before the aforesaid public hearing owners of private real property that is located within the affected territory covering at least 50% of the total private land within the affected territory which is equal in assessed value to at least 50% of the assessed value of all private real property within the affected territory file a written protest to the adjustment with the Board of Trustees at the South Valley Sewer District office at the address specified above, or the registered voters residing within the affected territory equal in number at least 50% of the votes cast in the affected territory for governor at the last general regular election file a written protest with the Board at the District office. All protests must be filed at or before the public hearing. At the time and place set in this Notice for the public hearing, or at any subsequent time and place to which the hearing may be adjourned, the Board of Trustees will give full consideration to all protests which have been properly filed and will thereafter adopt a resolution either (i) approving the proposed boundary adjustment; or (ii) determining that it should not be done. Any resolution adjusting the common boundary between the Districts may contain such changes with respect to the affected area to be adjusted as may be considered by the Board to be equitable and necessary, including reducing the boundaries to be adjusted, to assure that the affected property owners are treated in a fair and equitable manner based on the circumstances.
