13. ORDINANCE - Amending Section 22-19-1(A) and Appendix A of the Orem City Code by Creating Standard Land Use Code 5934 Secondhand Precious Metal Dealer, and Designating Such Use as Permitted in the C2 and C3 Zones
REQUEST: The applicants request the City Council, by ordinance, create Standard Land Use Code 5934, Secondhand Precious Metal Dealer, and designate such use as “permitted” in the C2 and C3 zones.

POTENTIALLY AFFECTED AREA: Citywide
BACKGROUND: Check City would like to purchase gold, silver and other precious metals from customers at their business located in the C3 zone. Currently, secondhand merchants are only allowed in the C2 (Commercial) and HS (Highway Services) zones and are not permitted in the C3 zone. The applicant requests the City create a specific land use code for precious metal dealers and to make such use permitted in the C3 zone. Creating a land use code specific to precious metal dealers limits the types of secondhand merchants that could locate in the C3 zone.
Staff also recommends that Secondhand Precious Metal Dealers be made a permitted use in the C2 zone. Secondhand Merchants are already permitted in the C2 zone and so this would not result in any practical change.
Advantages:
• A secondhand precious metal dealer use would be compatible with other uses within the C2 and C3 zones
• Creating a specific land use code for secondhand precious metal dealers and allowing such use in the C3 zone would not open the door to allow other types of secondhand merchants in the C3 zone
Disadvantage:
• None determined

14. ORDINANCE - Amending Section 22-5-3(A) of the Orem City Code and the Zoning Map of Orem, Utah, for 0.41 acres Located Generally at 616 North 1060 West from R7.5 to R6
RECOMMENDATION: The Planning Commission recommends the City Council, by ordinance, amend Section 22-5-3(A) of the Orem City Code and the Zoning Map of Orem, Utah, for property located generally at 616 North 1060 West from R7.5 to R6.

POTENTIALLY AFFECTED AREA: Geneva Neighborhood
BACKGROUND: The applicant requests the City Council rezone the subject property from the R7.5 zone to the R6 zone in order to allow the applicant to subdivide the property into 2 lots. The property is 17,895 square feet in size and has street frontage of about 113 feet. A home in a dilapidated condition exists on the parcel.
The lot does not have adequate street frontage to allow the creation of 2 regular lots, so the applicant would like to create a deep lot. However, the lot does not have enough square footage to create a deep lot under the R7.5 zone because a deep lot has to have 125 percent of the square footage required for a regular lot and because the area of the private drive leading to the deep lot cannot be counted in the required square footage of the deep lot.
A rezone of the property to the R6 zone would allow the property to be subdivided into 2 lots. If the rezone is approved, the existing home will be removed.
The General Plan states this property is appropriate for Medium Density Residential, which is identified as the R6, R6.5, or R7.5 zones. This request to rezone the property to the R6 zone is in harmony with the General Plan. The City Council recently approved a similar rezone a block to the south by changing the zone on 0.60 acres from R7.5 to R6 to make 3 lots from 2 parcels.
