1. Mayor's recognitions, proclamations, and updates.
2. Consent Calendar.
a. Consider approval of a purchase for computer replacements for the Police Department with Gov Connection, Inc.
BACKGROUND and RECOMMENDATION: This item is for the purchase of computer replacements for the Police Department. As part of the city's replacement program, city computers are refreshed every 5 years. This purchase is a part of the 5-year replacement cycle for the Police Department. The Police Department was recently awarded the FY26 COPS Technology and Equipment Program award to fund this purchase. A quote was received from Gov Connection, Inc. in the amount of $398,149.31 through Utah State Contract #MA4085. Staff recommends approval. Staff recommends approval.
b. Consider approval of the purchase of a Vac-Con Combination Hydro-excavation/cleaning truck for the Water Services Department from Cate Equipment Company.
BACKGROUND and RECOMMENDATION: The Vac-Con Combination Truck is used by the Irrigation Division on a daily basis for cleaning and hydro-excavation activities. The combination trucks in the Water Services Department are essential as they allow crews to excavate for a waterline repair prior to the area being marked for blue stakes, which is required for conventional excavation. This saves significant time, minimizes damage to infrastructure, and helps restore service sooner. A quote was received from Cate Equipment Company in the amount of $405,402.12 through State contract. Staff recommends approval.
c. Consider approval of change order for the new Suntran Transit Facility.
BACKGROUND and RECOMMENDATION: This item is for a change order to the contract with Bonneville for the construction of the new Transit Facility. This change order adds the automotive equipment for the six maintenance bays that is attached to the building or requires installation during construction. All of the equipment specifications were sent to the design team during the design phase, and the appropriate power requirements and related considerations are already accounted for. The proposed change order totals $663,239.24. This purchase was accounted for in the construction budget. Staff recommends approval.
d. Consider approval of an agreement to purchase a portion of real property (SG-MVF-11-142-A) from the Annika Rinehart Trust.
BACKGROUND and RECOMMENDATION: The subject property is located within a FEMA regulatory floodway and overlaps a city sewer easement. City staff determined that an encroachment occurred within the floodway/easement area, creating a FEMA compliance issue and potential risk to the City's sewer facilities and access. As part of resolving the floodway violation and preventing any future encroachment, the city negotiated a permanent solution to protect the floodway and sewer easement by agreeing to prepare an easement vacation and partial subdivision plan amendment for the newly configured property lines, allowing the property to retain its existing Open Space zoning and Floodplain designation, so the owners may apply to construct a detached garage on the parcel subject to compliance with all city requirements in exchange for the conveyance of 0.384 acres of the property to the City. The proposed garage is located outside the FEMA regulatory floodway and floodplain as well as outside the existing sewer easement. The cost of the easement vacation and partial subdivision plan amendment is $5,000 and is considered as the City's participation. Staff recommends approval.
e. Consider approval of an agreement with SISU Energy & Environmental, LLC for the installation of a Free Heat System for Millcreek II.
BACKGROUND and RECOMMENDATION: Millcreek II uses heat in its emissions-control process to reduce nitrogen oxide (NOx) emissions and maintain compliance with applicable environmental standards. The existing electric-heater vessel is nearing the end of its service life and is deteriorating. The proposed Free Heat System will use high-temperature turbine exhaust to supply the required process heat, reducing reliance on electric heaters.
f. Consider approval of an Interlocal Fence Agreement with Washington County regarding the Tortoise Fence in Divario.
BACKGROUND and RECOMMENDATION: The County and City need to enter into an interlocal fence agreement to address those lands in Divario that are adjacent to the Red Cliffs Desert Reserve and to be in harmony with the Habitat Conservation Plan. This interlocal fence agreement will address this issue and has already been adopted by the County. Staff recommends approval.
3. Consider approval of Ordinance No. 2026-080 amending the Fields at Mall PD-C (Planned Development Commercial) zone plan on approximately 2.24 acres generally located north of Mall Drive and west of 2780 East. (Case No. 2026-PDA-021 - The Plastics Clinic (Riverbend Point))
BACKGROUND and RECOMMENDATION: The proposal is for a new, three-story 45,000 sq. ft. commercial building. The underlying general plan is COM (Commercial). At their meeting held on September 22, 2026, the Planning Commission held a public hearing, and recommended approval with a vote of 6-0 with the following condition: 1. That a Master Sign Plan for Lots 5-8 be applied for and approved for any monument signage along Mall Drive.
4. Consider approval of Ordinance No. 2026-081 amending the Ledges Planned Development Residential zone on approximately 1,108 acres located on the east and west side of Highway 18. (Case No. 2026-PDA-019 - Ledges St George)
BACKGROUND and RECOMMENDATION: The proposal is to consider reallocating approved dwelling units in the Ledges PD-R zone. No increase in the total approved residential unit count is proposed. At their meeting held on September 22, 2026, Planning Commission held a public hearing, and recommended approval with no conditions, with a 6-0 vote; there were 20 comments from the public.
5. Consider approval of Ordinance No. 2026-082 amending the Rusty Cliffs South Planned Development Traditional Neighborhood Zone on approximately 49.3 acres generally located on the east side of Highway 18 between 4100 North and 4400 North. (Rusty Cliffs South - Case No. 2026-PDA-020)
BACKGROUND and RECOMMENDATION: In January of 2026, the City Council approved a rezone on the property to PD-TNZ (Planned Development Traditional Neighborhood Zone). Since that time, the applicant has reevaluated the project and is proposing to make some changes. The revised plan includes a decrease in density and removes the commercial, live/work and stacked multi-family units. The Planning Commission held a public hearing on September 22, 2026 and received public comment from one adjacent property owner. The Planning Commission recommends approval of the application with a 5-0 vote.
6. Appointments to Boards and Commissions of the City.
7. Reports from Mayor, Councilmembers, and City Manager.
8. Request a closed meeting to discuss litigation, security, property acquisition or sale or the character and professional competence or physical or mental health of an individual.
