NOTICE OF PROPOSED ANNEXATION (OC1, LLC Property - West Haven City) NOTICE IS HEREBY GIVEN, that Roy Water Conservancy District (the 'District'), has received a petition (the 'Petition'), proposing to annex certain land owned by the Petitioners identified in the Petition, OC1 LLC (the 'Petitioner'), into the boundaries of the District. The Petition has been filed by Petitioner pursuant to and in conformance with the provisions of Sections 17B-1-403(5) and 404(1), Utah Code Ann., 1953, as amended. The property proposed to be annexed (the 'Annexation Area'), is more particularly described as follows: Affecting Weber County Parcel Numbers: 08-022-0101 LEGAL DESCRIPTION: A part of the Southwest Quarter of Section 2, Township 5 North, Range 2 West, Salt Lake Base and Meridian, located in West Haven City, Weber County, Utah, being more particularly described as follows: Beginning at a point South 89º12'47' East 884.13 feet along the Section line and South 41.58 feet from the West Quarter Corner of Section 2, Township 5 North, Range 2 West, Salt Lake Base and Meridian running thence; South 89°01'21' East 204.25 feet; thence South 43°35'02' West 129.36 feet; thence South 45°30'36' East 178.50 feet to the westerly right of way line of Midland Drive; thence South 46°41'52' West 149.87 feet along said street; thence South 46°41'46' West 28.41 feet along said street; thence North 45°09'29' West 184.99 feet; thence North 04°56'49' East 23.82 feet; thence North 04°56'59' East 191.09 feet to the Point of Beginning. The District is authorized to provide and the Petitioner desires to receive from the District secondary irrigation water service for the Annexation Area. Ad valorem property taxes may be levied annually upon all taxable property within the Annexation Area and fees and charges shall be imposed by the District to pay for some or all of the services provided by the District. As set forth in Section 17B-1413(1)(a)(ii),Utah Code Ann., 1953, inasmuch as Petitioner is the owner of 100% of the property included within the Annexation Area, and there are no residents within said area, the public hearing, notice and protest provisions set forth in the applicable provisions of Sections 409, 410 and 412, Utah Code Ann., 1953, do not apply, and the board of trustees of the District has determined that a public hearing is not necessary.
