SCHEDULED ITEMS
14. CORRIGAN FARMS REZONE
14.A. ORDINANCE - An Ordinance of Eagle Mountain City, Utah, Rezoning Certain Lands Known as Corrigan Farms
BACKGROUND: (Presented by Senior Planner, David Stroud) Corrigan Farms LLC seeks to rezone parcel number 59:068:0006 to add the RTI overlay zone to the property to allow it to potentially develop a data center project with a natural gas power plant.
14.B. ORDINANCE - An Ordinance of Eagle Mountain City, Utah Approving the Corrigan Farms Development Agreement
BACKGROUND: (Presented by City Attorney, Marcus Draper) The proposed agreement accompanies the rezone of a 41-acre parcel owned by Corrigan Farms LLC to the RTI Overlay Zone and establishes development and infrastructure requirements for the anticipated data center project. Corrigan Farms LLC owns a 41 acre parcel in the southern portion of our City. The parcel abuts other data center properties, as well as ENYO Energy properties. This agreement was prepared in conjunction with the rezone application for the parcel to the RTI overlay zone. It is consistent with other data center development agreements, except that it is for 20 years instead of 40. It is anticipated that the applicant will construct 2 data centers with an on site natural gas power plant. Article V of the agreement governs the infrastructure requirements to insure success of the project. The language recognizes that there are still unknowns regarding the specifics and maintains flexibility while insuring that the City has the final say.
The Development Agreement came before the Council for consideration on October 6th. The Council gave feedback related to concerns that it had for the development. Changes have been made to the agreement to account for the feedback. The matter is on for discussion to make sure that the changes address the previously raised concerns.
