NOTICE OF PROPOSED ANNEXATION
FLYWAY ANNEXATION
Notice is hereby given by William R. Wright, Payson City Mayor, and the Payson City Council as follows:
Petition
On September 8, 2026, a petition for annexation was filed in the office of the Payson City Recorder by ICP West Division, LLC c/o Brock Burns, for the purpose of requesting annexation of approximately 8.08 acres located at approximately 900 S Goosenest Drive (Utah County) into Payson City.
Receipt of Notice of Certification
The petition was certified as required by Utah Code Section 10-2-405(2), and the Payson City Council received the Notice of Certification on October 15, 2026.
Description of the Property to be Annexed
The area proposed for annexation is located at approximately 900 S Goosenest Drive (Utah County) as identified on the enclosed map and is more particularly described as follows:
A PARCEL OF LAND SITUATE IN THE SOUTHEAST QUARTER OF SECTION 16, TOWNSHIP 9 SOUTH, RANGE 2 EAST, SALT LAKE BASE & MERIDIAN, MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON A LINE DESCRIBED IN A BOUNDARY LINE AGREEMENT ON FILE IN THE OFFICE OF THE UTAH COUNTY RECORDER, ENTRY NO. 73019:2018, SAID POINT BEING LOCATED 1022.60 FEET N 00°45'25' W ALONG THE SECTION LINE AND 0.24 FEET EAST FROM THE SOUTHEAST CORNER OF SAID SECTION 16, AND RUNNING THENCE ALONG SAID BOUNDARY LINE AGREEMENT S 89°01'17' W 537.58 FEET MORE OR LESS EXTENDING TO A POINT ON THE EXISTING CORPORATE LIMITS OF PAYSON CITY AS SHOWN ON THE GOOSE NEST ANNEXATION PLAT, ON FILE IN THE OFFICE OF THE UTAH COUNTY RECORDER, THENCE ALONG SAID CORPORATE LIMITS AS SHOWN ON SAID GOOSE NEST ANNEXATION PLAT N 35°23'53' W 339.34 FEET TO THE SOUTHWEST CORNER OF THE STAHELI PAYSON ADDITION ANNEXATION PLAT, ON FILE IN THE OFFICE OF THE UTAH COUNTY RECORDER, THENCE CONTINUING ALONG THE CORPORATE LIMITS OF PAYSON CITY AS SHOWN ON SAID STAHELI PAYSON ADDITION ANNEXATION PLAT THE FOLLOWING FIVE COURSES: 1) N 89°31'27' E 280.48 FEET, 2) N 00°58'39' W 6.42 FEET, 3) N 86°50'54' E 58.71 FEET, 4) N 14°25'27' W 378.87 FEET, 5) N 79°16'34' E 352.16 FEET TO A POINT ON A BOUNDARY LINE AGREEMENT ON FILE IN THE OFFICE OF THE UTAH COUNTY RECORDER, ENTRY NO. 73020:2018, THENCE ALONG SAID BOUNDARY LINE AGREEMENT S 49°27'45' E 183.18 FEET TO A POINT ON A BOUNDARY LINE AGREEMENT ON FILE IN THE OFFICE OF THE UTAH COUNTY RECORDER, ENTRY NO. 21131:2016, THENCE ALONG SAID BOUNDARY LINE AGREEMENT S 00°24'28' E 392.99 FEET, THENCE ALONG A WARRANTY DEED ON FILE IN THE OFFICE OF THE UTAH COUNTY RECORDER, ENTRY NO. 47231:2026 S 00°24'48' E 199.83 FEET TO THE POINT OF BEGINNING. Inspection and Copy of Petition
The complete annexation petition is available for inspection and copying at the City Recorder's Office, 439 W Utah Avenue, Payson, Utah, between the hours of 7:30 a.m. and 6:00 p.m., Monday through Thursday, excluding holidays.
City May Grant Petition and Annex Property Unless Protest Filed
The Payson City Council may grant the petition and annex the above-described property unless a written protest to the annexation petition is filed with the Utah County Boundary Commission, and a copy of the protest is delivered to the Payson City Recorder no later than November 14, 2026, which is 30 days after the Payson City Council's receipt of the Notice of Certification.
Where Protests May Be Filed
Protests shall be filed with the Utah County Boundary Commission, 100 E Center St. #1100, Provo, UT 84606 between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday, except holidays. A copy of the protest must also be delivered to the Payson City Recorder's Office, 439 W Utah Avenue, Payson, Utah, between the hours of 7:30 a.m. and 6:00 p.m., Monday through Thursday, except holidays.
Who May File Protests
A protest to the annexation petition may be filed by the legislative body or governing board of an affected entity, or 'an owner of rural real property' according to UCA 10-2-810.
