OPENING CEREMONY
The meeting was called to order at 5:30 PM. Councilman Mike Sarles led the Pledge of Allegiance and offered the invocation.

ADOPTION OF THE AGENDA
Motion to adopt the agenda as presented was made by Mike Sarles and seconded by Cindy Stewart. The motion carried unanimously.

Motion to approve the minutes was made by Tracy Wright and seconded by Cindy Stewart. The motion carried unanimously.

TIFFANY TWITCHELL-SMITH - ASPEN VALLEY FLOODING
Tiffany Smith, a resident at 264 West Aspen Valley Drive, addressed the Council about worsening flood damage at her property, noting $2,500 of damage in August 2024 and approximately $9,000 in the current year. She detailed her investigation, which revealed believed breaches in the West Panguitch Irrigation Canal, using a drone to show accumulated debris within the canal. A drainage ditch from developer Ezra Nielson also failed, causing water flow through neighboring properties. Despite speaking with the City Manager, Garfield County Public Works, and the canal company, no meaningful action was taken. Ms. Smith seeks a collaborative resolution involving these entities, believing the City bears responsibility for allowing development on outdated plats without drainage reassessment. Mayor Soper asked that the City's attorney research the matter and discuss it in the next Council meeting on September 22, 2026.

BUSINESS LICENSE - SHED SPACE SOLUTIONS AT 475 E CENTER
Motion to approve the business license for Shed Space Solutions was made by Cindy Stewart and seconded by Mike Sarles. The motion carried unanimously.

BUSINESS LICENSE - GARFIELD MEMORIAL HOSPITAL-GARFIELD MEMORIAL CLINIC
Motion to approve the business license for Garfield Memorial Hospital - Garfield Memorial Clinic was made by Cindy Stewart and seconded by Tracy Wright. The motion carried unanimously.

PLANNING COMMISSION MEMBERS
Mayor Soper presented the name of Tom Talbot, a citizen who had approached the City expressing interest in serving on the Planning Commission, for Council approval.
Motion to approve the appointment of Tom Talbot to the Planning Commission was made by Mike Sarles and seconded by Tracy Wright. The motion carried unanimously.

DEPARTMENT REPORTS/CALENDAR
City Right-of-Ways: Progress was reported on letters to property owners regarding items left in public rights-of-way.
New City Shop: Invitations to bid have been advertised for a new engineered metal building for the City shop, with the procurement to proceed in phases beginning with the structure itself.
Social Hall: The Social Hall roof leak has been identified as a lack of flashing around the chimney; Stout Roofing provided a repair bid of approximately $900. A full roof replacement bid was also requested given the roof's age, with the possibility of budgeting for replacement in the following year.
Triple C: The facility hosted Cowboy Days and the Senior Pro Rodeo in recent weeks. The National Rodeo Association representatives attended the Senior Pro Rodeo and expressed appreciation for Panguitch's hosting of rodeo events twice yearly, citing the location's convenience for participants. The facility was clean and fully operational throughout.
Panguitch Prevention Coalition: The Panguitch Prevention Coalition is hosting a key leadership event on September 14.
Quinoa Festival: The Quinoa Festival was noted as a well-attended, growing event that brings visitors to town and supports local businesses.
Library: Library shelving installation was completed successfully with assistance from City staff and state inmates.
Bike Path: A request was made to schedule crack sealing on the bike route; Dave Dodds suggested the county's crack sealing equipment could be borrowed, and that later in the fall is best for sealing the cracks that widen due to cold temperatures.
The Marilyn Buckley Memorial Park: The trails were mowed, and a large root log obstructing the bridge was removed.
Kiosks/Signage: A resident inquiry was raised regarding outdated kiosks at various community locations around the city. A concern was also raised about the historical signage placed on the sidewalks on Main Street, which some consider a pedestrian hazard.
Landfill: An update was provided on the landfill project. Fish and Wildlife is expected to provide a mitigation fee estimate shortly.
Water Tank: Approximately $55,000 is needed for planning and mitigation costs for water infrastructure. City Manager Houston, along with the Finance staff, will assess if these expenses can be paid without incurring debt, pending the current audit results. BLM's review involving prairie dogs and sage grouse may take 7-12 months, with construction possibly starting in 2028. The plan includes a 1,000,000-gallon tank, a new well, and a pump.
Pavilion Update: Two loads of materials, including large structural beams, have already been delivered to the ball field site. A final load is expected later in the week. Assembly was anticipated to begin shortly, with coordination between City staff on site planning and installation details.

Motion to enter Executive Session for the purpose of discussing possible litigation was made by Tracy Wright at 6:09 PM and seconded by Cindy Stewart, with Barry Huntington, Tyrissa Howell, Kim Soper, Mat Houston, Cindy Stewart, Tracy Wright, and David Dodds in attendance. The motion carried unanimously.
Motion to exit the executive session at 6:22 PM made by Mike Sarles and seconded by Tracy Wright. The motion was approved.
