At their 9/15/2026 Commission Meeting, the Morgan County Commission approved a franchise agreement with Comcast. At their 10/06/2026 meeting the Commission will decide on ratification of this franchise agreement in Ordinance.
ORDINANCE NO. CO-26-____
AN ORDINANCE OF THE COUNTY COMMISSION OF MORGAN COUNTY, UTAH, GRANTING A NONEXCLUSIVE CABLE TELEVISION FRANCHISE TO COMCAST CABLE COMMUNICATIONS MANAGEMENT, LLC; APPROVING A FRANCHISE AGREEMENT; AUTHORIZING ITS EXECUTION; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, Morgan County (the 'County') is authorized under applicable federal and state law to grant one or more nonexclusive cable franchises within its jurisdiction and to manage and regulate the use of County public rights-of-way; and
WHEREAS, Comcast Cable Communications Management, LLC ('Comcast') has requested that the County grant or renew a nonexclusive franchise authorizing Comcast to construct, operate, and maintain a cable system within the unincorporated areas of Morgan County; and
WHEREAS, the County and Comcast have negotiated a Franchise Agreement establishing the terms and conditions of the franchise, including the payment of franchise fees, construction and restoration requirements, customer-service obligations, insurance, indemnification, security, enforcement, and continued County authority over the public rights-of-way; and
WHEREAS, at a duly noticed public meeting held on September 15, 2026, a quorum of the Morgan County Commission was present, and all Commission members present voted to approve the Franchise Agreement; and
WHEREAS, the County Commission now desires to memorialize that approval, formally grant the nonexclusive franchise, approve the Franchise Agreement attached as Exhibit 'A,' and authorize its execution.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNTY COMMISSION OF MORGAN COUNTY, STATE OF UTAH:
Section 1. Approval and Grant of Franchise. The County Commission hereby approves and confirms its September 15, 2026 approval of the Franchise Agreement between Morgan County and Comcast Cable Communications Management, LLC, substantially in the form attached as Exhibit 'A' and incorporated herein by reference. Subject to the terms of the Franchise Agreement, the County hereby grants Comcast a nonexclusive franchise to construct, operate, and maintain a cable system in the public rights-of-way within the Franchise Area.
Section 2. Authorization to Execute. The Chair of the Morgan County Commission is authorized to execute the Franchise Agreement on behalf of Morgan County and to approve nonmaterial corrections necessary to conform the Agreement to the action taken by the County Commission, provided that no correction may materially alter the County's rights or obligations without further Commission approval.
Section 3. Nonexclusive Franchise and Reservation of Authority. The franchise granted by this Ordinance is nonexclusive. Nothing in this Ordinance or the Franchise Agreement waives, limits, or restricts the County's police powers or its authority to manage, regulate, and control the public rights-of-way as provided by applicable law.
Section 4. Prior Franchise. Upon the effective date of the Franchise Agreement, any prior cable franchise between the County and Comcast or its predecessor concerning the same Franchise Area is superseded, except that accrued obligations, liabilities, and rights arising under the prior franchise shall survive to the extent provided by law or the prior franchise.
Section 5. Severability. If any section, part, or provision of this Ordinance is held invalid or unenforceable, such invalidity or unenforceability shall not affect any other portion of this Ordinance, and all sections, parts, and provisions of this Ordinance shall be severable.
Section 6. Effective Date. This Ordinance shall become effective after publication in accordance with state law, but not before fifteen (15) days after its passage. The Franchise Agreement shall become effective on the later of (a) the effective date of this Ordinance or (b) the date on which the Franchise Agreement has been executed by both parties.
