PURPOSE OF PUBLIC NOTICE
The purpose of this public notice is to declare the State of Utah's intention to issue a Section 401Water Quality Certification with Conditions under the authority of the Federal Clean Water Act (33U.S.C. ยง 1341), and consistent with the Utah Water Quality Act, Title 19, Chapter 5, Utah Code and Utah Administrative Code R317-15.

BACKGROUND
The Utah Department of Transportation (UDOT) (Project Proponent) proposes to construct major infrastructure updates to the SR-39; 4700 W to Weber River Widening, 14517 (Proposed Project) in Weber County. The Proposed Project includes widening and replacing State Route 39 between Mile Reference Posts 0.0 and 2.98, signalizing the 3500 W intersection, expanding the adjacent northbound railroad crossing, extending drainage culverts, and adding roadside ditches. Construction will permanently impact approximately 1.66 acres of Palustrine Emergent Wetlands (PEM), 0.45 acres of canals, 0.29 acres of ditches, and 0.02 acres below the Ordinary High-Water Mark of an intermittent stream tributary to Walker Slough. The temporary impacts from utility relocations and stockpiling are 1.03 acres PEM wetlands, 0.06 acres canals, 0.01 acres ditches, and 0.04 acres stream for the Proposed Project but temporary impacted areas will be fully restored to pre-construction contours and reseeded. To manage impacts, UDOT shifted the road footprint north, eliminated large detention basins, and will utilize BMPs-including check dams, silt fences, inlet protection, retention swales, and culvert outlet riprap. The Project Proponent proposes purchasing compensatory bank credits to offset permanent wetland losses.
