CONDESNED SUMMARY OF ADOPTED ORDINANCE 2026-11
On September 3, 2026, in a City Council meeting, Ordinance 2026-11 was adopted. This ordinance amends Title 8 Chapter 3 to allow conditions for temporary sewer connection deferrals. The ordinance creates a limited process that allows the City Council to defer sewer connection requirements for properties with significant physical obstacles to connecting to the public sewer system, while keeping the general sewer connection requirement in place.
New Deferral Exception Added to Sewer Connection Requirement:
Properties that would otherwise be required to connect to the public sewer within 24 months may be exempt if they receive an approved sewer connection deferral from the City Council.
Septic System Failure Exception:
If a property's septic system fails during the compliance period, immediate connection to the sewer is still required unless the property has been granted a sewer connection deferral. Deferred properties must continue to comply with all applicable wastewater regulations.
New Sewer Connection Deferral Criteria:
The City Council may grant a deferral when:
- The property's location or elevation makes gravity sewer service impractical and would require a private sewage pump system.
- Installing a sewer connection would substantially interfere with an existing permanent structure, utility, geothermal system, or similar improvement, and no reasonable alternative route exists.
Standards for Granting Deferrals:
- Deferrals must be based on the physical characteristics of the property, not on the owner's financial or personal circumstances.
- Property owners must provide information requested by the City to verify the condition supporting the request.
- Deferrals remain in effect as long as the qualifying condition continues to exist.
- A change in ownership does not automatically end a deferral.
- The owner must maintain a lawful private wastewater disposal system at their own expense.
- The City Council may impose conditions, reconsider, or terminate a deferral if circumstances change and sewer connection becomes reasonably feasible.
- The ordinance does not create an automatic right to a deferral; each request is considered individually.
Amendment to Private Wastewater Disposal Section:
The requirement to connect to public sewer within 24 months of sewer availability does not apply to properties that have been granted a sewer connection deferral.
