Cleveland Town Council Meeting Approved Minutes August 13, 2026 The regular meeting of the Cleveland Town council was held at the Public Safety Building located at 130 W Main in Cleveland, Utah, on Thursday, August 13, 2026 at 7:00 pm. In attendance were: Mayor Shawna Horrocks, Kristen Vose, and Chance Thompson. Absent: Carl Sitterud. Public Attendance: Ann Murdoch & daughters, Lowell & Jaycee Gardner, Kelly Theobold, Kobi & Chantelle Erni, Cindy Ward Called to order at 7:03 pm. Pledge led by Shawna Horrocks. Minutes: At end of meeting came back to approve. Motion to pass the minutes for July by Chance Thompson. Second by Kristen Vose. All were in favor, motion passed. Public Comments/Questions: Mayor Horrocks explained that letters are sent to people about not following water restrictions. Mayor stated that they owe Mrs. Erni a public apology for how the situation was dealt with. Kobi Erni explained that his mom, Darlene Erni was using irrigation water and not secondary. He stated the only way that someone could see where the water was draining into an underground pipe to drain into the field below was if they were standing on his mother's property. He would like the video and the name of the person who took it, so they can charge them with trespass if they were on the property. He also asked it they had gone and checked out the complaint with her. Mayor stated that they had not. Mr. Erni stated that it would be better if council checked out complaints before sending letters to residents and upsetting them. Item #1 Discuss/Approve/Deny Proclaim September to be Suicide Prevention and Awareness month. Clerk read proclamation. Council approved proclamation and Mayor signed document. Item #2 Discuss/Approve/Deny Ann Murdoch and residents on 2nd S past 300 E would like to speak about the curb & gutter that was recently surveyed for their street. Ann Murdoch asked why does CVSSD want to put curb & gutter on 200 S and why do they want a sidewalk there. It was explained that CVSSD does the curb & gutter for the town. The town pays to have the sidewalks put in. Mrs. Murdoch then explained that they would take her fence and her grapes out if they put in a sidewalk or curb & gutter, so she does not want it on the south side of her property bordering on 200 S. Lowell Gardner stated that his secondary water hookup would have to be moved as well as his sprinkler system and pasture fence. He is also concerned that it will caused an issue with his front setback. The road is higher than his yard which will cause issues with his front yard. Mr. Curtis gave his concern about them removing his trees by his fence which shade his sheep. Also worried about property lines changing to make room for curb & gutter. Mrs. Curtis is worried about what they are supposed to do with their animals during the construction. Kelly Theobold stated that it would flood her property. Residents each stated that they did not want curb & gutter or sidewalks. Mrs. Murdoch asked if they had a say in whether it goes in or not. Mayor said she will voice her concerns to CVSSD at the meeting next Thursday night. She will also talk to Jacob Sharp, district manager, about it to find out how they make decisions about where to put curb & gutter. Mayor told public they could come to CVSSD meeting August 20 at 7 pm in Castle Dale. They could call and get on the agenda also. Item #3 Approve/Deny email from Ashley Pruitt requesting a moratorium on data and AI centers. Ashley Pruitt sent an email to the town council and commission to ask for a moratorium on AI and data centers moving into Cleveland. Mayor read email to council and public. It was noted that they need more research on that item. Item was tabled until research is completed. Item #4 Discuss/Approve/Deny sidewalk projects for CVSSD. 100 S 100 E Main needs corner fixed due to broken and raised up. In front of Laramie Jensen's house sidewalk is raised & broken. Sidewalk can be put at 300 N next to the Nabors residence since curb and gutter is complete there. Item #5 Discuss/Approve/Deny non-compliant ordinance and water issues. Mayor stated that this item was taken care of in the public comments. Item #6 Discuss Cleveland Days and set 2027 dates. Council set dates of July 22, 23, 24 2027 for Cleveland Days. Item #7 Approve/Deny having a council member attend the ULCT conference Oct 27-28 in Salt Lake City, possible scholarship available. Shawna Horrocks made a motion to approve a member of council attending ULCT conference on October 27-28. Second by Kristen Vose. All were in favor, motion passed. Item #8 Approve bills and city financials for payment. Motion to pay the bills and city financials was made by Kristen Vose. Second by Chance Thompson. Roll Call Vote: Kristen Vose-yes, Mayor Shawna Horrocks-yes, Chance Thompson-yes. All were in the affirmative, motion passed. Item #9: Council Reports. Chance Thompson(LEPC): no meeting. Carl Sitterud(Rec): absent Shawna Horrocks(CVSSD, EMS): EMS has CPR training at Cleveland Town Hall next week free to all residents. CVSSD meeting is next week. Kristen Vose(PZ): Planning & Zoning was cancelled. Sent email for extension power cord cover ups for Cleveland days. Public Comment: Cindy Ward asked about crosswalks for 4-way, school, and by post office. No one had an answer. Also wanted sign for no Jake-brakes going through town. Comment by Zoning Chair: Lowell Gardner asked to bring up a matter about a non-compliance shed. Mayor gave permission to speak. He asked if council was going to continue to pursue or drop issue with shed on 200 W 100 S? He stated that it had not moved. Council stated they would reach out with another letter. They would like to know how far it needs to be moved. Item #10 Adjourn Meeting. Chance Thompson made a motion to adjourn the meeting. Second by Kristen Vose. All were in favor, meeting adjourned.
