September 15, 2026 DIVISION OF WATER QUALITY UTAH DEPARTMENT OF ENVIRONMENTAL QUALITY NOTICE OF REOPENED PUBLIC COMMENT PERIOD PURPOSE OF PUBLIC NOTICE The purpose of this public notice is to declare the Director of the Division of Water Quality's intention to renew a Utah Pollutant Discharge Elimination System (UPDES) Permit under the authority of the Utah Water Quality Act, Utah Code § 19-5-106(2)(g). The draft Permit and the Fact Sheet (collectively, the draft Permit documents) are available for review and comment. The Division is reopening the public comment period under Utah Admin. Code R317-8-6.10(5). Comments received during the public comment period that closed August 6, 2026, raise substantial new questions concerning provisions of the draft Permit. Reopening the comment period gives interested persons an opportunity to comment on those questions before the Director makes a final decision. As required by Utah Admin. Code R317-8-6.10(6), comments filed during this reopened comment period are limited to the following provisions of the draft Permit documents: 1. The Joint Discharge Area Transitional Waters Monitoring Program, including the definition of the Joint Discharge Area, incorporation of the Field Sampling Plan as an enforceable requirement, sample media and analytes, bird egg collection, and annual reporting requirements; 2. The Implementation of the Se Tissue-Based Standard provisions, including the action thresholds and the requirements corresponding to each; 3. The selenium effluent limitations for Outfall 001; and 4. The statements in the Fact Sheet and Wasteload Analysis supporting the provisions identified above, including the antidegradation review determination and the basis for the selenium limitations. The draft Permit documents posted for this comment period are the same documents posted on July 7, 2026. The Division has not revised them since that posting. Revisions made from the draft Permit public noticed on August 11, 2025, are explained in the Fact Sheet. Comments submitted during the previous comment periods remain part of the administrative record and do not need to be resubmitted. The Director will respond to all comments in the response to comments issued with the final Permit decision. The plant is located near Jordan Valley's headquarters, adjacent to the Jordan River at 8215 South 1300 West, West Jordan, Salt Lake County, Utah, with two outfalls. Outfall 001 is located at latitude 40 45'37.59'N and longitude 112 10'13.32'W and discharges to Transitional Waters and Gilbert Bay of the Great Salt Lake. Outfall 002 is located at latitude 40 36'5.58'N and longitude 112 55'13.37'W and discharges to the Jordan River. The Southwest Jordan Valley Groundwater Project remediates deep groundwater contaminated from historic mining activities in southwest Salt Lake County. The project improves groundwater quality and prevents further contaminant migration by extracting mining-impacted groundwater with elevated total dissolved solids (salts) via a series of deep aquifer wells. The water is purified utilizing a reverse osmosis treatment process at the Southwest Groundwater Treatment Plant. The project also extracts shallow groundwater with elevated total dissolved solids that has not been impacted by mining activities. PUBLIC COMMENTS Pursuant to Utah Admin. Code R317-8-6(6.6), any interested person may submit written comments on the draft permit documents and may request a public hearing if no hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. All comments will be considered in making the final decision and shall be answered as provided in Utah Admin. Code R317-8-6(6.12). Commenters have an affirmative obligation to raise all reasonably ascertainable issues and submit all reasonably available arguments and factual grounds supporting their position, including all supporting material. Supporting material must be included in full and may not be incorporated by reference, unless the material is already part of the administrative record. Public comments are invited any time prior to the deadline of the close of business on October 15, 2026.
